Another George Zimmerman/Casey Anthony fiasco.
Absolutely no way murder 2 will stand. Maybe manslaughter but even that's a stretch.

Unfortunately, this is what I thought would be the case.

I said it repeatedly, (Mike Lewis Interview Post).

Everything she mentioned-not calling for medics/no seat belt doesn't rise to criminal charges only civil.

Only God himself knows what truly happened. May He be with this wicked country!

Such Bs. Just more corruption from Murdermore, Md. The AG is married to a councilman.

Anonymous said...

It's about time officers were charged for the things they do. They had many opportunities to get medical help for this man and just stood and looked at him and did nothing.

No matter what the outcome turns out to be, I don't think she had much choice. If she didn't charge them, this whole country would have exploded!

2nd degree murder for the driver. I believe his name is Caesar Goodson.
She didn't mention anything that rises to the level of 2nd degree murder but what she did say is that Gray was lying on the floor at some point. Could it be that the driver slammed the door while his head was slightly outside the back of the van and the force of the door slamming pushed his head so forcefully it broke his neck. It's only a guess but I did read that the "bolt" they speak of are at the bottom and the top of the interior back door of the van. If the bolt injury/impression was at the top of his head this theory would make sense.

11:23 The country has already exploded. It is now up to fair minded LEADERS to put it back together. Thanks NObama and other SOCIAL JUSTICE advocates.

Luke Rommel has brought SEVERAL lawsuits against the City of Salisbury for their own alleged abuse. Thank God no one has been killed.

The interesting part to me is, it isn't about black or white here in Salisbury. It's more about I RULE THE WORLD mentality.

I would suspect that the Officer that has been sued multiple times here will soon lose his job. He is now a target, period, right or wrong, he's now a liability and this case, (Baltimore) will forever play a role in law enforcement history in the state of Maryland.

That states attorney's a shifty eyed looking thing herself. She couldn't look the spectators in the eye, as if she wasn't confident in her determinations herself.

I hope that now those that injured the 100 officers will also be charged with assault, attempted murder, etc.
Was that mentioned?

Anyone that has watched t.v.could expect the police were going to be the fall guys. Just to keep Baltimore from burning down. Such a great shame that the police have to be placed in this B.S.. I support the men and women in blue. Keep your heads held high.

The Mayor and SA are passing the buck to avoid further protests/violence and criticism. Whatever the outcome of a trial, they can place blame on the court/jury.

Mosby noted that "no crime had been committed by Mr. Gray." Police had said Gray was arrested for possessing a switchblade, but Mosby said Friday the knife in Gray's possession was not a switchblade and was lawful, and said officers "illegally arrested" Gray.

To charge with any degree of murder there has to be intent. The lawyers for those charged are now going to ask for a prelim. I guarantee they are doing it at this moment, as we sit here. S/A will take to Grand Jury before no doubt. That's when it will get interesting.

This was a givin, they had to blame the cops, or Bur-it-more would be burnt to the ground. Giving room for those who want to destroy. Now, when the verdict releases the cops, the city will blame the violence on the jury.

She really probably should have taken this to the Grand Jury before all of this. What she didn't say is more important than what she did say. Not one mention of anything that takes this to the level of criminal culpability.
It does seem at this point in time that she is pandering to a certain segment, who haven't the knowledge and/or the desire to so much as ask-what specific actions occurred that bump this up to the criminal level.

Growing up in Baltimore, I'm hardly surprised. I've been roughed up plenty of times during my teenage years, and I'm white as hell. Still have a clean record though. Explain that...

There is a certain element that is certainly about "I have power", as you pointed out Joe. It's the reason I lay on my horn when a state trooper passes me doing 80mph on rt 50.

But race absolutely plays into this, which is the most disappointing part. It's easy to say that it doesn't if you've never first-hand experienced it. I would have gotten a lot worse treatment if I was black back in the day. I've seen it happen to my friends.

Anonymous said...

Blue Flu in Baltimore. I hope they all call out sick. They did years ago and they fired all the white cops lol.

When these officers are acquitted they will burn that city down. She is pandering to the Black community and it will cast her dearly. There is no indication of criminal intent. It was a civil case from the start. Maybe one of them will be convicted to appease the tribe.

Baltimore makes me sick I do not spend my hard earned money there. I do visit there. It is a dirty from the ground up.

This is why I live on the Shore. I left Charm Shitty because I could not stand seeing all those people not working eating better that I was and I worked sixty hour weeks. They also drove better cars.

All the politicians are getting rich and doing nothing to help that city or its people.

When people change their behavior I am sure the cops will. The cops have a horrible job. There is not enough money for me to do it. They are heroes for just suiting up every day in that ghetto.

Anonymous said...

12:06-because when charged with a major felony a defendant has a right (in MD) to either a preliminary hearing (within 30 days) or a Grand Jury hearing. Usually the S/A takes it to the GJ before the 30 days are up.

Anonymous said...

What specific actions bump this up to a criminal level? It's an ILLEGAL ARREST - she stated it plain as day for those of you who only wish you were lawyers. Running away from the cops is NO REASON FOR PROBABLE CAUSE, and on top of that, the knife he had (the only potential argument for probable cause) was perfectly legal. Then, on top of an illegal arrest (and the potential for civil and yes criminal liability for assault), the cops killed someone in their unauthorized custody. The ENTIRE PROCESS was criminal. Christ, learn the law people.

What I'm not liking is that Billy Murphy who is the Gray family attorney donated $5000 to the Mosby campaign and was a member of her transition team when she was elected. This is a conflict and a special prosecutor should have been called in the moment Murphy injected himself in this case.

Anonymous said...

Yep 1:22-this shows incompetence and ineptness and unethical behavior on her part. $5000 could just be a part of it. He has several lawyers employed at his firm and who knows how much they donated if they did.

MOSBY needs to step off the case , too many conflicts of interests on both sides of her.

Anonymous said...

The probable cause this and that is not much cause for concern. This is more a technicality because the cop used "eye contact" as one of the causes for giving him suspicion to give chase when Gray ran. Eye contact is not one of the factors which allows LE to chase someone. High crime is, but he didn't give that as a reason. I wouldn't read too much into those charges. As for the knife, it's not up to the cop to decide if it's legal or not at that point in time esp if it's larger than the 2 inch things people use to clean their fingernails. That's a determination a prosecutor would make when deciding to file the charges or not. They only thing is on Gray's statement of charges it does say Switchblade but elsewhere it describes the knife as being spring assisted which would be a pen knife type of thing.
The 2nd Degree depraved heart murder-what? Where did they dig that one up from?

Anonymous said...

Besides the clear conflict with regards to the Murphy donation and involvement, she's overcharged and the charges are redundant.
She doesn't know what she's doing.

Anonymous said...

Sorry, I don't think this was a police related death. Even the liberal Washington Post doesn't think so.

What is interesting is they said they wouldn't be releasing any information on Friday after they first said they would. Now they went ahead and released the information Friday. First they don't work on weekends. Second, they are doing this to stop the scheduled protests tonight and tomorrow by the low life Black Panthers and Nation of Islam.

These 6 officers put there lives on the line for the citizens and visitors of Baltimore City and now there careers are over. This black states attorney is married to a black Baltimore City Council member, the mayor is black. Black Congressman Elijah Cummings and black State Senator Catherine Pugh were hugging and sucking up to the gangsters and thugs. City Council member Carl Stokes was sucking up to the black criminals and thugs and defending their actions and now these police officers are toast because America has stooped so low to defend a criminal thug who injured himself. America has stooped so low to endorse looting, rioting, cop hating and murder just to patronize the black illiterate thugs of this country. I hope many police officers quit their jobs now because they are not allowed to do their jobs thanks to black elected officials and you stupid idiot Democrats!!

Anonymous said...

Like the prosecutors in Florida w/Zimmerman and Anthony, she overcharged for political reasons. She knows where her votes are, and is indifferent to prosecutorial ethics.
I hate the word but the Billy Murphy relationship is a bombshell. I wonder why this didnt' come to light sooner.

" “Depraved heart” murder does not require any specific intent to kill or injure. Moreover, “depraved heart” murder must be based on general recklessness; the act on which the charge is based must be dangerous to a number of persons, but not directed at any particular person."

Robinson v. State, 307 Md. 738, 743, 517 A.2d 94, 97 (1986)

Wonder how they can show that the officer's act was "dangerous to a number of persons"?

"We hold, therefore, that when injury is intentionally inflicted, without intent to kill, and the victim subsequently dies as the result of the injury, the assailant may be guilty of “depraved heart” murder, if no excuse, justification, or mitigation is present, and if the circumstances are such as to demonstrate the requisite element of depravity."

There are two things that the officers attorneys will ask for very soon. First that Mosby recuse herself and a an independent prosecutor be appointed. The reason being Billy (William) Murphy, the families attorney was Mosby's biggest contributor to her campaign. Can you say conflict of interest !! 2nd they will ask for a change of venue because we surely know they will never get a fair trial in that Jungle ! While I'm on the subject I'll also say that Rawlings Blake the so called mayor should resign or a recall should be initiated due to her actions and the inflammatory comments and actions she has denied. (even though they are recorded). Whatever happened with "innocent until proven guilty". If you go by Blakes and Mosbys comments that they have already made public, all 6 of the officers are already guilty. And for the president, well we won't even go there !!

Joe you Mr. Turlock may be happy to know there five shootings in the last twenty four hours. There were three rapes. They also found a dead person inside a tractor trailer just down from the CVA store that burned. Is that making your day any brighter on Charm City. I am sorry but the crime is maddening. I wish Mosby's demeanor was the same for prosecuting her husband's constitutes.

Billy Murphy a former judge turned defense attorney is one of Mosby's biggest contributors. I don't know I just find that odd.

These men and woman charged today are nothing more then lambs led to slaughter for political gain. They are also being used to deflect from Mayor Blake's blunders as a leader. Blake put Chief Batts in a position to have to lie as to the Monday fiasco.

No Chief wants to stand before the nation and say we retreated by orders of the mayor.

They now say that Baltimore is a product of White supremacy. I see it with their Black Mayor, Black Police Commissioner, Black President Of the U.S., Black Attorney General. Really you are just like those that blame White America for your failing African American colleges. Blame Whites for all your unwed mothers. The list goes on.

What you need here is a huge dose of integrity and accountability. The deflection of African America has become contagious to its youth. They to have become entitled. No Mayor Blake you had it right Monday night when they trashed your city "Thugs" it is spot on. I was sorry to see you back pedal in your most honest statement since this started.

I expected you lie and back pedal on the comment "give them room to destroy" You had to. With over 150 businesses looted. Numerous more torched. At a cost of millions to hard working tax payers.

If in fact you have criminal evidence of a murder then why wait so long to charge. This is without a doubt a civil case. Mr. Murphy can not bring Freddie back but he will make sure his mom and dad are driving Escalades soon trust me on that.

The Mayor said she is sickened. I mam are sickened by your racist, bigoted comments. You have done far more to make pure hearted people put black America under a microscope then the death of Freddie Grey ever will.

If you want to polarize you city you have succeeded. I for one will never spend a breath in that city as long as racist run the show. Blake needs to step down and Mosby should be removed as well. What hypocrites. Where is the due process period.

"Officer William G. Porter, who is charged with involuntary manslaughter, second-degree assault and misconduct. Porter, 25, joined the police department in 2012.

Porter became involved in Gray’s arrest after Goodson requested back up as he was driving Gray to Central Booking, according to a narrative provided by state’s attorney Marilyn J. Mosby on Friday morning.

Porter checked on Gray’s condition and asked him if he needed medical assistance. When Gray told him he could not breathe, Porter helped him off the floor of the van and onto a bench. The officer failed to restrain him with a seatbelt, Mosby said. Nor did he call for medical help, despite Gray’s request."

How do any of these allegations rise to the level of manslaughter and assault? They don't.
They don't have a clue how Gray died and are hoping by throwing everything except the kitchen sink at the cops, someone will roll. The problem is it's hard to imagine that even they-the cops involved- know exactly what happened.
All smoke and mirrors in an attempt to calm the species of whatever it is that inhabits Baltimore City, because one thing is certain, they aren't human beings by anyone's stretch of the imagination.

He did not break/sever his neck by himself. Not possible. How does one break their own neck while shackled and handcuffed lying on their stomach on the flour? Someone had to have been responsible in some way for this tragic fatal injury.

If this happened to YOUR family member or loved one would you still think it is BS to prosecute the police offers involved? (Didn't think so).

Let the trial play out and run its [fair] course. May the real whole truth come out whatever it is. This deceased human being, and his family, deserve that much.

"This is a very sad day for justice in the United States, in Baltimore and in Maryland,” (Alan) Dershowitz said. “Today had nothing to do with justice. Today was crowd control. Everything was motivated by a threat of riot and a desire to prevent riots.”

“There is no plausible, hypothetical, conceivable case for murder under the facts as we now know them. You might say conceivably, there is a case for manslaughter,” he continued

He added, “My prediction—they have overplayed their hand. It is unlikely they’ll get any convictions in this case as a result of this and if they do there is a good possibility they will get reversed on appeal.”

Just what I've been saying since Day 1.

"BALTIMORE (AP) — When police spotted Freddie Gray and he took off running through his Baltimore neighborhood, officers made a split-second decision to give chase, setting in motion his death in custody and rioting in the streets.

Fleeing from police is not, by itself, illegal in America, and the U.S. Supreme Court has made clear that in safe neighborhoods, people not suspected of criminal activity can ignore a police officer who approaches them, even to the point of walking away.

But courts have set a different standard for places where street crime is common, ruling that police can chase, stop and frisk people if their location contributes to a suspicion of criminal activity."

Someone really needs to check on Mosby to see if she's in a coma or a persistent vegetative state or something. This and similar sentiments were echoed around the Baltimore Bar (association and not an establishment serving alcohol) today.
When Alan Dershowitz comes out short of saying she's nuts, then you know something is seriously wrong.

Mosby’s probable cause affidavit merely supports the officer’s arrest. She has 30 days to present an indictment sheet to the grand jury. The charges listed on indictment sheets are often quite different than the charges listed on probable cause affidavits. Since most in the legal community think Mosby has overcharged the six officers, some of the charges mostly likely will be reduced or dropped.

Anonymous said...

None of bones she threw the mob are going to stick. This is a regurgitation of the Duke Lacrosse players, Casey Anthony, George Zimmerman and Ferguson.

Anonymous said...

This is not true. She has absolutely no obligation to present an indictment sheet. These officers have been charged and will now have a preliminary hearing during which a judge will review the evidence and determine whether or not the evidence supports the charges. If the judge so determines, the case will be move forward to the circuit court for trial. If not, the charges will be dropped at that point. The judge can drop all charges or determine that the evidence supports some but not all charges - at that point some charges can be dropped and the others move to circuit court.
