Incident: Illegal Possession of Untaxed Cigarettes
Date of Incident: 24 March 2015
Location: U.S. 13, Salisbury, MD
Suspects:
1. Markins Evans Noelus, 25, Nashville, TN
2. Markinston K. Noelus, 25,Nashville, TN
3. Marc A. Louis, 24, Brooklyn,NY
Narrative: On 24 March 2015 at 2:58 PM a deputy stopped a vehicle occupied by the above three subjects for a traffic violation on US 13 in Salisbury. During the stop the deputy observed furtive behavior by the occupants and also discovered that none of the three were listed as authorized users on the rental agreement. A WCSO Drug K9 team arrived that alerted to the presence of the odor of illegal drugs in the vehicle. A subsequent search revealed marijuana paraphernalia in the vehicle along with marijuana secreted in the sock of Marc Louis.
Further search of the vehicle revealed 130 cartons of cigarettes in the trunk that were being transported through Maryland without paying the required Maryland tax.
All three subjects were arrested for bringing the cigarettes into the State of Maryland, presumably on their way to New York with them. All three were transported to the Central Booking Unit where they were processed and taken in front of the District Court Commissioner for their initial appearance.
The deputy also located 135 fraudulent credit cards in the vehicle. The investigation into the credit cards is ongoing.
Agents from the Maryland Comptroller’s Office and Homeland Security assisted with this investigation.

So weed was found. Its now legal so the search shouldve been stopped. No searches should ever stem from a traffic stop. How can a k9 tell a cop its weed ? They can't. Now a k9 is giving alerts to cops and searches are happening for legal substances. You pigs are gonna have to stop training your smarter counterparts to look for weed. This case will be tossed and should be!

It isn't "legal" at all. It is a citable offense. Meaning it is still illegal. And any paraphernalia is still considered an arrestable offense. As much sense as that makes.

Guaranteed it was cigars. Legal to own. Cops can not assume cigars are for drug use. A pipe yes , if its been used. And last I heard cops smell weed they aren't to use that for a search anymore and Matt told officers not to charge the cigars n weed pipes. Now that weed isn't a criminal offense cops have no reason to search with their dogs until new ones are trained to search for all but weed. Or search! That's my point. This is a traffic stop. Dogs alerted to what? Weed. No probable cause is there to warrant the search. Dogs giving alerts for is mute now. They need new dogs trained without weed. If the cop sees the weed that's when he can act.

Yes, what they were doing was illegal, solely because it deprives the government of tax revenue. Taxes on cigarettes are so high in NYC nowadays that there is good money to be made transporting them from out of state and reselling them in NY. The government itself has created this "crime", which in itself is appalling.
