Lawsuit Over Health Care Tax Could Kill ‘Obamacare’

“Obamacare” looks increasingly inevitable, but one lawsuit making its way through the court system could pull the plug on the sweeping federal health care law.

A challenge filed by the Pacific Legal Foundation contends that the Affordable Care Act is unconstitutional because the bill originated in the Senate, not the House. Under the Origination Clause of the Constitution, all bills raising revenue must begin in the House.

The Supreme Court upheld most provisions of the act in June, but Chief Justice John G. Roberts Jr. took pains in the majority opinion to define Obamacare as a federal tax, not a mandate. That was when the Sacramento, Calif.-based foundation’s attorneys had their “aha” moment.

Liberal dems can call it what they want but it's still a mandate and, therefore, illegal.

LOL The mandate is a REPUBLICAN IDEA ORIGINATED BY REPUBLICANS AND ENDORSED BY THE CONSERVATIVE HERITAGE FOUNDATION. lol You guys were only against it when a Democrat was in the White House. LOL Not to mention, it's not even a mandate, moron. You don't have to get insurance a) if you can't afford it, and b) if you CAN afford it and don't get it (which means taxpayers have to pay for YOUR medical bills - thanks a lot, jerk), then you pay a fee to make up for the fact that taxpayers would have to foot the bill for your medical problems. Got a better idea? Oh, yeah, it was called having a public option, which over 75% of Americans wanted, but you didn't think the insurance industry could handle any competition, apparently - which means you must not think the insurance industry is very good, eh? You don't even know WHAT you want, do you? Good grief, you people are awful for this country.
