A retired U.S. Army chaplain is being threatened with legal action for flying the American flag in his front yard, the Daily Mail reports.
Fred Quigley, 77, of Macedonia, Ohio, a minister who served active duty during the Vietnam War, has been told by the homeowners’ association that his flag violates the property rules.
The association has offered to fly the flag at the entrance of the building development, but Quigley refused the offer.
“If they can dictate to me that I cannot fly an American flag in America, then, to me, the country is lost,” Mr. Quigley told the paper.
Quigley's lawyer Gerald Patronite said the association has no right to stop his client.
According to the Mail, Joseph Migliorini, the representative for the homeowners’ association and former mayor of Macedonia, which is between Cleveland and Akron, said he plans to take Quigley to court if the flagpole is not removed.

The HOA's lawyer should be fired right now for letting them pursue this stupidity.
That is one reason I wouldn't live in a development with a Homeowners association. Ive seen these associations dictate what color you could or could not paint your house, what type of outdoor electrical fixtures you had to use and so forth. If I own the property Ill fly whatever flag I want. Im paying for the land not the Homeowners Association. They (Homeowners Association) should be taken to court for treason for not letting someone fly Old Glory on their own property. How un-American can you be to tell someone they cant fly the American flag on their land. How sad is that.
If you don't like the HOA rules, then get on the Board and change the rules. Otherwise, sell out and move away.
Maybe some of Quigley's neighbors know all about the evils and lies of the VietNam era and don't care to see that filthy flag every day.

You have the right to say those things because people like Fred Quigley laid their lives on the line to protect that right. Countless others paid the ultimate sacrifice to defend your right to be a coward and an ass.
I notice that you make a statement like this without signing your name. Would you say such a thing if you had to tell the world who you are?
Your caption is incorrect -- rules are rules and he has violated them.
It may just be the height or placement of the flagpole. Some HOA's would claim that having such "structures" lowers the value of neighboring homes. Not the flag, the flagpole. But I still side with the homeowner.

So many patriots have fought and died and worked tirelessly for the future of the country we have enjoyed all of our lives. If the HOA rules state , "no flag poles", you need to follow the rules. When you purchase a property in a subdivision that has an HOA, you need to read the bylaws before purchasing your home. You can't expect everyone to change for you. Maybe they would let him fly it from his porch or deck. We have an HOA and I feel the rules are written for a reason. I do not want someone painting their house pink or purple next to me.
