Blue Cross Blue Shield of Delaware must create and fund a health care foundation to assist uninsured Delawareans if it wants to move forward with its proposed merger with Pittsburgh-based health insurer Highmark Inc.
That requirement came in a ruling Wednesday from Attorney General Beau Biden, who is using an untested 2004 law to exercise authority over the fate of the Blue Cross-Highmark deal. Biden's staff is still determining how much money Blue Cross must direct to the foundation, which will likely be funded from the Delaware insurer's $165 million pot of reserves.
