Scandal in 38-B?

After nearly losing his seat in 2006, is Del. Norm Conway (D-38B) so afraid of facing two strong GOP opponents in November that he and his allies will stoop to circa 1972 Nixonian dirty tricks to win an election? I don’t know, but connect the dots and see where it leads you….

Tomorrow morning the Daily Times will run a piece (probably front page) by Worcester reporter Jenny Hopkinson that discusses the “emergency” suspension of Worcester County Sheriff’s Deputy Lt. Mike McDermott. COINCIDENTLY, McDermott has been the strongest GOP candidate running in District 38-B, which covers all of Worcester County and about 1/3 of Wicomico County. Here is the expected lead for tomorrow’s story:

Worcester County Sheriff’s Lt. Michael McDermott was temporarily stripped of his police powers while the department investigates a Sept. 2009 incident involving a service weapon, according to his lawyer. McDermott is the mayor of Pocomoke City and a Republican candidate for the Maryland House of Delegates in District 38B.

Worcester County Sheriff Charles T. Martin confirmed that McDermott’s power to arrest was taken away on July 22, and said McDermott is now on administrative office duties. An incident involving McDermott is being investigated, Martin said, but he declined to comment on the specifics of the case because it is a personnel matter.

“Those powers remain suspended until they are reinstated by me or the case is adjudicated,” Martin said. “It’s something that is going to be adjudicated within the system, and he knows the system as well as I do."

Sounds terrible on the surface. Let’s start at the beginning and see where the story leads.


How Do You Lose A Weapon When Your Boss Has It In His Possession?

According to sources in the Worcester County Sheriff’s office, Lt. Mike McDermott was called into the office of Sheriff Chuck Martin on July 22 and asked the whereabouts of second handgun which had been issued to McDermott. McDermott claimed that the piece was packed away and locked in his pick-up truck as he had recently been moved out of his office. Sheriff Martin is reported to have asked him to produce the weapon. When McDermott could not, the Sheriff stated that he had the weapon. He reportedly admitted to accessing McDermott’s locked office last fall and took the weapon (which had been packed away in a box) into his possession.

Sheriff Martin then stated that he was placing McDermott on “emergency suspension”. Martin was reminded that he could not do so without doing it in writing. At that point he dismissed McDermott.

On Saturday, July 24, McDermott was formally served written notice of an “emergency suspension”. It is our understanding that this type of action is reserved for the most severe type of complaint. However, it is our understanding that as of 5PM today, no “Notification of Complaint” has been served on McDermott. Such notification is supposed to be the first step in any formal disciplinary procedure.

The Shoe Is Gonna Drop!

For some months, non-specific rumors have been spreading around political circles in both Worcester and Wicomico counties that something was going to happen to discredit McDermott. One Wicomico source has been dropping hints for the last three months that “the shoe is gonna drop” on McDermott. Two Democrat sources separately intimated that McDermott would be “run out of town on a rail” by the September 14th primary.

While attending an event for 38-A candidate John Phoebus July 23rd, I was told by two credible sources that “McDermott had been placed on ‘administrative leave’”. Oddly, our sources in the Sheriff’s office state that McDermott was not served with his official suspension until the next day.

The Suspension Is Reversed, Sort Of …

As would be expected, McDermott appealed his suspension. On Tuesday, July 27, a review board consisting of three senior deputies in the Worcester County Sheriff’s office met to hear McDermott’s appeal. The board found that the suspension of McDermott was unwarranted and that he should be returned to active duty. Unfortunately, such a finding must be upheld by Sheriff Martin. The finding continues to gather dust on his desk while no notification of complaint has been filed and no investigation has begun.

It’s A Personnel Matter

When reached for comment, McDermott would only state that I should speak to his counsel. However, as the Daily Times has already reported, Sheriff Martin doesn’t seem to have any problem discussing the matter EXCEPT when it comes to the parts that could exonerate McDermott:

The problem is that our sources state that the problem ISN’T being investigated. No formal complaint has been filed TO BE INVESTIGATED. YET, Martin is discussing a personnel matter – which violates the policy of his own department.

WHY?

Start by looking at this video:

Our sources in the Worcester County Sheriff’s office inform us that it is a violation of department policy to appear in uniform supporting a political candidate. Yet, who do we see going the extra yard for Norm Conway? Sheriff Martin and several uniformed deputies performing in a campaign video.

Given that McDermott poses the greatest threat to Conway keeping his seat, is it mere coincidence that a man willing to use his own department to promote Conway wouldn’t take the extra step and attempt to destroy McDermott’s candidacy? I honestly don’t know.

My family and I have always had the greatest respect for Sheriff Martin. I hope that this whole affair turns out to be a gross overreaction to a minor problem rather than a political hatchet job. That said, only time will tell.

If McDermott is returned to duty (per the review board), the matter dropped or a formal complaint filed, and promptly investigated (if a formal complaint is filed), then the entire affair could simply be chocked up to a misunderstanding. Each day that this affair continues without an objective conclusion in sight makes the matter appear more and more sordid. This does not bode well for either Conway’s candidacy or the last few months of Sheriff Martin’s distinguished career.

First let me say I respect and enjoy reading G.A.'s posts.
I can't buy into what he is saying now, though. Seems to me McDermott is spinning this and G.A. has bought into it. I have no knowledge of what McDermott has or has not done and I don't have a dog in that race but I will be glad when all this election stuff is over. Time will tell regarding McDermott but the damage has already been done.

They are going to be past history, Mardela. I can tell you the momentum for Mike McDermott in northern Worcester county is unbelievable. When you mention Conway, the residents are like "who's that". It seems as though our incumbants have been asleep and no one even knows who they are. Mike McDermott signs are everywhere.

GA, I respect you but I would pose the question as to whose story this is? There is ways 3 sides to any story and I suspect you only have 1 at this time. I'm not a friend of Norm Conways nor Chuck Martin nor for that matter Mike McDermott but your version doesn't make sense. A long time respected sheriff does not suspend a long time deputy because of a missing service weapon. Nor has Norm Conway used these kinds of tactics during elections. Something doesn't add up.

I have been working side by side with GA on this story and let me assure you, McDermott has done absolutely nothing wrong. Look deeper into the evidence we have provided here. Look at the video. They broke the law, period. Shame on Joel Todd as well.

McDermott has been set up by a Sheriff who is mentally incapable of doing anything. This is a man who has not shown up for work for MONTHS on end and he is retiring after his own Wife stated he's not mentally capable of doing his job.

While GA states he and his family hold the Sheriff to the highest regards, this guy is an Idiot! Why would any leader attempt to destroy a mans carreer when he has never been written up for anything in all his years in law enforcement.

I happen to believe this will actually boost attention towards Mike McDermott and help his campaign. Time will tell.

Conway must really be sweating it. McDermott is a good man and is running a great campaign. This will probably give him some sympathy votes.

It is time for Norm to retire. He has participated in putting Md in debt and its $2,000,000,000 budget deficit. It time for fiscal responsibility, and Mike is the man!

You are correct that it SHOULDN'T add up. However, did you really read the whole post?

As of today, this is how it stands. I hope that it is a misunderstanding.

However, there are certain facts that are not in dispute. Martin is politically tied to Conway. There has not been a formal charge brought against McDermott, yet he has been suspended. The suspension was reversed but the Sheriff hasn't returned McDermott to active duty.

As someone who has always respected Sheriff Martin I hope this is a misunderstanding.

You know what pisses me off most about this situation. Here you have a LEADER who has no respect for BROTHERHOOD. I'm not at all suggesting that a leader should ever cover up for an Officer. However, planting a hidden gun by stealing it away from an Officer without their knowledge and then coming back and demanding that Officer present the gun is complete bullsh!t.

It was a secondary gun, or as some call it a back up gun. It was registered to the department and assigned to McDermott. In my honest opinion, when a Sheriff sets up an Officer, (clearly for political gain) and throws out BROTHERHOOD and screws a fellow Officer, that person is a scumbag in my book. I'm personally glad to see this guy stepping down but don't forget to look at the timing of all of this. A pannel already cleared McDermott of ANY wrong doing. The Sheriff has the power to over turn their decision. Can and will Mike win a lawsuit down the road, yes. However, could he lose an election because these good old boy crooked jackasses made it happen, absolutely. Salisbury News is simply sharing the other side, the real story, the truth. Believe me, there's a whole lot more to the facts behind this case but we'll respect those involved and not share it until the timing is just right. I will say this however. From what I do know and from what we have already confirmed, it doesn't look good AT ALL on the retiring Sheriff and other law enforcement leaders have already expressed their disgust with this man as well.

Come on people look at this whole thing and think about it. Martin is not running again so he has nothing to loose he has rubbed elbows with Conway for years. So what if McDermott is cleared all Martin has to say is he made a mistake trouble is a good man has already been damaged with no way to make up for the damage done. Conway has done much for the Shore but new blood in his position could prove to do much more. It's time to give Conway a retirement from politics and get someone new in there!

Worcester County deputies are on the review board reviewing one of their own? Sounds rife with conflict of interest. What a dumb system. What about officers (or others) from other agencies being on a review board that are independent from the Sheriff's office and have "no dog in the fight".

It all sounds so unprofessional - it's laughable.

Anon 11:14, Norm Conway has never used these kind of tactics before because he's never faced serious opposition. In this election the only thing worse than being an incubant is being a democratic incumbant. I'm guessing Conway going to lose the general to the republican nominees by about a 10 percent margin.

Yes he is sweating and it isn't because of the heat. I just saw him and had a small talk on politics and he is obviously worried about his seat. He has been attending every function he can for exposure...and free food of course.


If you remember the numbers of the last election Conway was behind Mathias in numbers and just above Michael James in the general election. It was obvious that Conway was riding the coattail of Mathias which I found hard to believe. Mathias isn't in the 38B race this cycle and that definitely makes Conway sweat more. Conway certainly has helped certain people and special interest groups but the majority of people are sick and tired of the tax and spend mentality of the Democrats.

I supported Mike McDermott since the first time I heard him speak and will continue to support him. How desparate can Conway be? I will not support anyone that reduces their campaign to smear tactics. I don't care if it is my mother running for office, if they can't run on their own merit my vote will go to those that can. Many of us are sick of the negative campaign tactics. That's why I didn't vote for Harris the last time around, his attacks on Kratovil turned me to Kratovil.

Well said, Joe. When this all started last year Mike was dumbfounded by Chuck's initial attempt to suspend him after entering Mike's locked office and rifling through Mike's personal possessions and making copies of some of the contents of Mike's briefcase. It was at that time that Chuck stole Mike's back-up weapon.
I've supported and defended Chuck against all enemies for over 16 years. I even changed parties to vote for Chuck in in first election (I changed my party affiliation back to Republican the day after that election). I am a strong supporter and campaign treasurer for Mike McDermott. So I'm watching one friend trying to destroy another.
Joe's right about the Brotherhood... you just don't do something like this to a brother. But Chuck has stepped over that line. Chucks actions disgust me.

Mike McDermott WILL win this election and go on to be a stellar representative for the Eastern Shore. Chuck will go down in history as a good cop gone bad.

Why - might you ask? They have both been free loaders on the public dole for so long that they have forgotton what its like to make it on their own.

We need some new entreprenerial blood in office. It is high time to get rid of all the public dole freeloaders.

"Free Loaders" are like Billy & Stephanie Burke who suck off the taxpayers by collecting welfare and food stamps, then sit around on a blog all day and bitch about the system. Being a public servent is a thankless job. I can't thank Norm Conway enough for the service he has provided for the Eastern Shore. Do I agree with many of his decisions, absolutely not.

Mike McDermott has been treated with disrespect from an alleged Brother. He has been set up and as I stated last night, other law enforcement officers have lost all respect for the Sheriff. The mere fact he would use himself and his staff to shoot such a video is disgusting and illegal.

Mike McDermott will come out of this with more votes than ever before. Shame on the rest of the Press for not digging deep enough and simply using the excuse that they can only say so much. Where's Kenny Beck when you need him!!!!!!!

Norm Conway has done nothing for anyone other than himself. Yea he has voted on issues that have helped farmers in the past because he had to. Conway has taken care of education. The fact he and his wife get pensions from the B.O.E. He is a little weasal.

Conway attempted to hold up legislation on collective bargaining for police officers. That was a shock to me because I have been told what a great supporter of law enforcement he was. Well the facts came out he has never done anything pro- police in his career. Yes he did endorse a couple of M.S.P. applicants packages and they never should have been hired. When you have to get a delagate to endorse your application there is an issue.

Bottom line Conway has stayed way to long. He is anti police for some reason. Hmmmmmmmmmmmm. Maybe someone should take a long look at his hard drive. He is just greasy to me.

He has- Retired Chief Deputy Reggie Mason (a Republican) has been appointed by Sheriff Martin as acting Sheriff until the election. The entire office could hardly wait for Chief Mason to come back once the word spread. He has been there for months as acting Sheriff and is running for Sheriff in this election. From what I understand, he probably has more than 90% of the votes from the Worcester County Sheriff's Office current employees! They love him, and he loves them and his community. He is a hard worker with great dedication and has been with that agency for a few decades now, and if I might add, he is definitely THE MAN for the job, and I (alongside many) truly hope he is voted in as the new Sheriff!! I also vote McDermott, and hope that he returns to them soon with full active duty privledges!

Lyme disease is quite debilitating. It affects the memory and some cognitive processes.

It is not clear that the disease must be contacted through exposure to a tic. Many have suggested that Lyme and other diseases may be contracted through vaccines including seasonal flu shots.

Lyme is more widespread than most people realize. There are many in Salisbury who have the condition and some of them are involved in public positions where they make decisions for spending public money.

2)Why did you open the article by insinuating Mr. Conway was the perpetrator in the McDermott quandary?

3)Is there a witness to the Sheriff “breaking into” McDermott’s locked office, or is this hearsay?

4)Who is the witness who heard the Sheriff admit to “breaking into” McDermott’s locked office, or is this hearsay?

5)How are you aware, (besides “our sources”) that no investigation is taking place?

6)Another person is also on Administrative Office Duty. Does this relate to the McDermott case?

“It is my understanding” was used several times in the article, so is it possible your understanding was wrong in some instances? Gossip, innuendoes, and rumors do not make for facts. There are always at least three sides to every story. We each tend to state what makes our side sound the best.

Just for clarification, the Deputy in the Video does not work for the Sheriff's Office anymore, and hasn't for a few years... resigned around 2007 I believe.

** Check Martin told Mike that he had entered his office. Chuck rifled through Mike's personal briefcase, made copies of some of Mike's paperwork and took the weapon that was locked in the office. Chuck has the key to every door in the Sheriffs Office.

** He stated that he entered Mike's office in front of then Chief Deputy Doug Dods. Dods was one of the Command Staff members that sat on the review board that voted 3 - 0 to lift the suspension.
5)How are you aware, (besides “our sources”) that no investigation is taking place?
** What's to investigate? At least in the Sheriffs Office. There is, however an outside investigation being conducted regarding Chuck's actions. I am not at liberty to say by who or give the substance of that investigation. But it will come out when it's complete.
6)Another person is also on Administrative Office Duty. Does this relate to the McDermott case?
** NO The other person is, however, a candidate for sheriff.

ok my question is why if the gun was taken last fall why didnt know Mcdermott know his gun was missing? I would think that a officer would know at all times where his gun was. Yes he said he locked it up in his office, but why didnt he ever check on it!

OK, nevermind that it was in his LOCKED office, which should have meant it was "safe"- it is a government builing and can be checked at any given time by anyone of higher rank/superior. That being said, Chuck wasn't wrong for going in Mike's "locked" office, and I don't think Mike was wrong for having his BACK UP gun LOCKED in his Office located IN the Sheriff's Office which you have to go through security and then have a key card access to enter...how is that wrong, or at least wrong enough to warrant an emergency suspension, or better yet, WHY if this happened in September 2009 (and the issue is that the gun was packed away in a locked office)is it just conveniently being brought up in the middle of an election where Mike is running against an obvious friend of Chuck's?? I wish I knew either of them personally so they could have more credibility one way or another...

We all know that Conway is most like connected to Martin through budgetary legislation. You can't be in office as long as both Conway and Martin have been to deny this connection. Their paths have probably crossed many times. As for McDermott - maybe he should step down like Sam Vincent was going to do.

I just say get rid of them all.

McDermott has been an outstanding law enforcement officer for many years. He has been a deputy in our county for many of those. It isn't right how one can justify treating a loyal public servant with such contempt no matter his political affiliation or aspirations. We need to ENCOURAGE good people to run for office, even if their views do not align with ours. Far too long have elections been won on party lines. It is a candidate's character that matters most in these trying times and McDermott's character and record of service are far above the level we see in most candidates.

This has nothing to do w/Pocomoke other than McDermott is the mayor of the city. All this if true occured at the sheriff's department in Snow Hill. Sheriff Martin holds an elected county position, McDermott is running for a state office but is currently an elected Pocomoke city official.

What do you mean this has nothing to do with Pocomoke. Doesn't Pocomoke lie in the County of Worcester? For that matter Snow Hill lies in the County of Worcester. They all have a common tread!!

And by the way. . . it now appears the WORCESTER'S LIQUOR INDUSTRY is also Worcester County's biggest industry -alcohol. And you can add that to their repertoire. Point is that I heard Jack Dillon on WQMR make a snide remark about Salisbury politics as being nasty. Well in the case of the Worcester Liquor Dispensary system . . . they have officially outdone Wicomico's Dispensary shenanigans.

Excatly moron it has nothing to do with Pocomoke other than the fact McDermott is the current Mayor...it is about the entire county as you just stated your self(see your comments on snow hill and pocomoke 2 major cities in worcester county). It is ok we can not all be the brightest light bulb in the bunch.
