Tracy Ross Sparpaglione, was charged in the Circuit Court with 2nd degree rape, 3rd degree sex offense, 4th degree sex offense, misconduct in office, 1st and 3rd degree burglary. Following a bench trial, he was convicted of misconduct in office and acquitted on the remaining charges. The court sentenced him to one year in jail.
Upon filing an appeal the the conviction has been reversed and all costs are to be paid by Wicomico County.
Upon reading the opinion of the court there are questions raised.
Will he be reinstated in his job at the Salisbury Police Department?
Will he now file a claim against all involved?

OK, I read it. And would suggest that he leave well enough alone.
AND, that he find another form of employment...SBY has enough problems with the police dept. without a guy who believes a quickie is one of his benefits.

Another prime example of TOTAL IMCOMPETANCE on behalf of the State's Attorney's office. They can't even get one word right in the charging document. Anothe waiste of taxpayers dollars at Davis' expense.
Wow! I read the whole thing as well. He may have been cleared of criminal wrong doing but he still violated department policy by admitting to a sexual encounter while on-duty which is grounds for termination. Plus, being a new officer and still on probation this makes his firing even easier. Law enforcement does not need a guy like this in uniform.
Was this a slip-up in the charging document? An idiot's mistake, the confusing of misfeasance, malfeasance and non-feasance.
As for filing a claim to regain the job or suit for unlawful termination, I think not. Regardless of court proceedings, the police department has rules that prohibit such activity while in uniform and on duty. Break the rules, lose the job.
If only it worked that way all the way up the chain of command...

Once again, SPD and the Davis Ruark cluster flub rush to judgement and prosecute a innocent man. Having sex on duty is a violation of department policy, however there are dozens of local officers, deputies and troopers that have done the dirty on duty. If they were all fired or charged with malfesence then we would be looking for a lot of more officers.
I think he did all of those things, and to think he can get off becasue he is or was a cop and probably had someone help cover it up... Not to mention he got off becasue of the Wording the state used? it can't be that easy...
Like the 911 perpetrators, there was no need to have a trial. We all know he did it.

The Court's ruling on the underlying sex offenses changed the whole nature of the case. Not the fault of the SPD investigators or the State's Attorney.

I know alot of police officers who are guilty of this same crime, but look at what alot of them deal with, typical man gets something thrown his way normally they dont pass it up!! He was just the unlucky who got caught!
It's the case of; another easy lawsuit allow to happen costing the taxpayers. They all knew the error was made in the document. And, they all did nothing. Let's see who gets paid after everything has settle down among the community. Just watch and remember allparties involved, how their lifestyle will change. Even and including the women. wording error, still on my mind, so i looked up misconduct, three elements are required, able to hold office, act in office this case on duty and commit a unlawful act, if he was found not guilty of any criminal charges sex on duty is not in any criminal law book, so he should of been aquitted during his trial, i read some this about a bill of particulars?? the criminal charges in this case were the that, stating each charge on the date time location and so forth right? but the jugde couldn't set him free because he beat the system, so decided to right law at the bench (Sonya Sotomyor), they must of took the same law classes, and now we the citizens of Wicomico must pay once again for another mistake from our wonderful elected officals.. what a nice day.

This kind of misconduct is a power trip, not just I'm-gonna-git-me-sum.
Our officers (and firefighters, too) have to have their big heads on straight under stress. If they can't do it when not under stress or let their little heads rule, I sure as hell don't want my life in their hands when all hell busts loose.

Jackson and Gordy took advantage of a college student who visited station 16 several times. They told everyone how they had sex while riding down Camden Ave. and then in the dorm. She was under age and Jackson had a girlfriend, one child and one on the way. They wre both over 21 and she was a minor. SPD will not reinstate him. Why would they reinstate him after a criminal offence? He was fired for a disiplinary issue. If he sues the city then Kramer would have a better case than him.
