Location of Incident: Boarders Café, Christiana

Date and Time of Occurrence: 07/09/09 at approximately 0341 hours

Defendant (s):
Klapcuniak, Erik, of Curtis Ave, Wilmington.
Fortner, Justin, of Thomas Jefferson Blvd, Newark

Resume: On 7/09/09 at approximately 0341 hours Troopers responded to the Boarder Café in reference to a burglary alarm. During this time a New Castle County Police officer conducted routine traffic stop on a Black Chevrolet Blazer in the area of Chapman Road for operating without headlights. While the New Castle County officer was speaking to the driver and passenger of the vehicle the officer observed in the vehicle, two cash tills and three lock boxes in plain view. Upon Troopers arrival at the scene of the burglary alarm they discovered the rear window of the business broken out along with US currency and cash tills missing from the business. Upon further investigation by both Delaware State Troopers, and New Castle County Police it was determined that the items observed in the Black Chevrolet Blazer where in fact the items taken from the Boarder Café. The driver of the vehicle Fortner, Justin, and the passenger Klapcuniak, Erik, where both taken into custody without incident. Both subjects have been charged with Burglary 3rd and Conspiracy along with other burglary related charges. Both subjects were later arraigned by Justice of the Peace #2 and released on unsecured bail. Due to an ongoing investigation no further information can be released at this time.
