Tilghman & Comegys Violate COMAR Laws!








There are only two photo's in this series of pictures that doesn't violate the law.

Imagine riding in the right hand lane of the road on a Bicycle, or wait, even worse, a wheel chair. As you're cruising along you're forced to ride over one of these storm water grates and your tires lock in between them!

This is why COMAR has LAWS against these kinds of violations. While Barrie Tilghman and Gary Comegys continue to sell the Public on Bike Routes, they're asking for extremely hefty fines as well as massive lawsuits for NOT following the Code.

Go look it up Barrie & Gary. You're clearly in violation throughout the Downtown area. Mind you, that's the only area I looked and there were probably 20 of them I found in violation. I could have walked further but I'm kind of tired of taking pictures of that black Crown Vic always popping out of nowhere.

It seems like everywhere YOU go there is that Chiefy guy watching. Does he not have a real job involving paperwork or something?
I have actually seen him stalking you, with my own eyes. I understand his unhealthy fixation with you and your activities, but really, does he have nothing more important going on? If he doesn't, he should.
At least use a marked cruiser for your Joe-watching, Chiefy. You might, accidentally, deter some criminal from commiting a crime of some sort.

Why, may I ask, did no one else notice this? There is a SHA guy regularly skulking about, probably on company time. Does he not ever look down? Does he not know what the laws are? Is he an incompetent boob?

842 Bubba looks at the paper in the WAWA parking lot, while sitting in his SHA vehicle with the engine and A/C running. That's as far down as he can see, his belly gets in the way. The man hasn't seen his feet in years.

Chiefy likes the prostitutes! Always calls out, "I'll be out with a #2 female, at the super market. Can I get another unit out here"? Because I dont do anything else! Let me tell you what! If I lock a skank up becasue of him, guess whos name will go down on the Witness area at 411! Chiefy! What an ass!

If he looks down his view is blocked by his gut,he doesn't know the law, and yes he is incompetent, but corruptable which is the criteria for a Barrie sycophant.

If a bicyclist gets a front tire locked into on of those grates and sustains injury, the citizens will be paying MORE money out because someone in the govt. isn't doing their job. God forbid someone in a wheel chair gets locked into one and falls out. I spoke to someone last night who works at wor-wic who fell into one in the industrial park. Luckily for them they were going slow and didn't get hurt.

The cost of a remedy would be crumbs when compare to the potential cost of damages in a law suit.

Do you think they care about lawsuits? They welcome them. How else would they justify the $300k+ in legal fees annually? They can't blame it all on Debbie and Terry.

Well, Again I find myself looking into allegations which might be or MIGHT NOT BE TRUE.

First, the dangers of these grates still being on our roadways is a disgrace. I agree, cyclists and narrow wheeled vehicles will in deed surcumb to serious injury if their operators place the vehicles atop them.

Second, FEDERAL LAW does provide laws which mandate cities and municipalities to change these grates to provide a safe riding haven for cyclist and narrowed wheeled vehicles BUT,

in the fine print of such laws, it does allow cities to prolong the change over to OSHA approved drainage covers "....once a road succumbs to major overhaul...."

The area if gray if you ask what establishes a major overhaul. Well, that is a the opion of federal investigators.

So what does that mean....When I called the Washington DC branch of OSHA, they were not able to give a clear and cut definition of when the grates have to be changed. They did say, there was NO SET DATE when they have to be changed. So when asked, the OSHA investigator stated, when a town, municipality or state roadway is changed proper paperwork must be provided to ensure Federal and State Law is being followed.

Basically, they don't check as often as they should.

As an avid cylcist, I assure you Salisbury is not the only city with these dicrepancies in the area. Fruitland and Delmar also have these grates. Are they a danger, absolutely, but until the road is overhauled, the cities are not required to change them. Hence a savings to the tax payers and to the city juridictions.

If you want a first hand view of how this system works, take a ride through Fruitland. On Main Street there are tens of these style grates, but move one street over which now has been overhauled with state and federal money and you will see they have complied with all Federal and State regulations.

Sorry folks, until someone injures themselves, the road is overhauled or someone donates enough money to change them, you are more than likely going to see them there for a long time.

Sorry......but just a little research, a thirty minute phone call, three transfers to other people and a long time hopeing for the change too....we may get some satisfaction.

Thank You for taking the time to research this further.

I will add, Comegys and Tilghman have taken Grant Money from the State to enhance the "Bike Routes" throughout Salisbury. That being said, one would have to believe while they were re working these routes they would have upgraded at least the Bike Path routes. That has not been done.
