Maryland: Senate Committee to Hear Legislation to Criminalize the Private Transfer of Long Guns

Introduced by state Senator William Smith, Jr., Senate Bill 948 seeks to criminalize the private transfer of long guns in Maryland.  While SB 948 has been referred to the Senate Judicial Proceedings Committee, it has not been scheduled for a hearing at this time.  NRA members and Second Amendment supporters are encourage to contact members of the Senate Judicial Proceedings Committee and urge them to OPPOSE Senate Bill 948 when it comes up for a vote.
Senate Bill 948 would require individuals to appear before a licensed firearm dealer to request a criminal background check prior to transferring a long gun, absent limited and vague exceptions.  The dealer would also be required to create a record of each sale.  This flawed legislation is being pushed by an out-of-state anti-gun group who is trying to impose their misguided policies on the law-abiding gun owners of Maryland.

I think the Eastern Shore of Maryland needs to seriously look into separating from Maryland. We are not being properly represented by our elected officials. Are way of life is and has been under attack and ruled by those who live in the metro corridor. Andy Harris has been the only representative in my 58 years of living hear to defend our way of life. We, like Western Maryland are being treated like the proverbial 'red headed step child', what we want and need is of no concern in the least to them.

Very simple solution - move. DE is a few miles north and VA is about 35 miles south

This is a means of creating a database of long guns. There have been so many transfers, gifts and inherited long guns without needing paperwork that the government doesn't know who owns them or where they are.

I have roots to this area which date back to the 1700's and family that was in the legislature and what is going on is not what they envisioned for this area. The Eastern Shore and our way of life is under attack so moving is not the solution. Annapolis could care less what the people of the shore want or need. I rt 113 was in Metro core area it would have been dualized 20 years ago and not taken 20 years to do! Just one of many such projects needed but the core comes foremost, that needs to change and self rule is the only way it will happen!!

As a responsible gun owner and avid gun collector, this isn't a bad idea (finish reading before you crucify me...). Long guns can be just as dangerous as pistols and other regulated firearms when placed in the wrong hands. Somebody with the marksmanship like myself can turn a rifle into a precision killing device (like the DC sniper) or use a pistol to wreak havoc in close quarters. Not to mention that the idiots making laws in this state actually de-regulated "assault weapon" style rifles so that they are actually EASIER to purchase than they were before. This law actually makes sense in that it will help keep firearms of any kind (long gun AND pistols) out of the hands of criminals.

HOWEVER, even though I think that it could be a good law with good intentions, I will NOT support this law for several reasons.

1) The State will use these transfers as a revenue stream. Evrybody knows that Maryland values money over lives (try getting a Concealed Carry permit without making large bank deposits). Nothing is free when it comes to regulations so if I were to inherit my father's gun collection of 40+ guns, my FFL would charge me $35 per firearm. That's $1,400+ out of my pocket - that isn't acceptable to me.

2) Currently, long guns purchased from a dealer only require a NICS background check. I would imagine that would be the same proposed for private transfers, but I wouldn't put it past the State of MD to make that more complicated. You know, like the HQL requirement that basically added fingerprinting to what is otherwise the same process as before, but with a few more unnecessary hoops to jump through to slow regulated firearm purchases, but does nothing to reduce gun violence.

3) Long guns are not federally registered so if the gun being transferred is owned by a non-Maryland resident, there is no way for the State of MD to actually know if the seller actually owns the gun being transferred. Seems like it could be a way to put a gun that was illegally owned on the books in a "legal" manner.

4) I simply don't trust the liberals running this State and the more guns that I own that they don't know about, the safer I am.

5) CRIMINALS DO NOT OBEY THE LAWS - so quit making laws that are aimed at regulating the people would will not follow them. You are only affecting law abiding citizens with this law.

6) and most importantly, this would be just one more step to stripping law abiding citizens of their 2A rights. The Democrats have learned that gun bans do not work, but they know that taking little steps and winning small victories will eventually lead to the elimination of our 2A rights. They win this battle, what would the next step be? They will not stop and this is mainly why I would not support this.

My never registered long guns will be passed on to my relatives and friends and will never be recorded. I don't intend to sell any of them, and I will not ever "volunteer" to take them to a dealer for transfer. Remember when they started the gun control push? They said it was only handguns, like Saturday night specials, that could be easily concealed, that they were trying to regulate, or eliminate. Then it became all handguns. Next was "assault" style weapons, both handguns and long guns. Now its all long guns. Our politicians that support this new assault on our right to own guns are dishonest about their true intent, and always have been since they started their march against private ownership of guns. Guess what their next step will be when they have all the guns in the state registered? That's right, they will outlaw all the registered guns and require that they be turned in for destruction. They will imprison all those that do not turn them in. This is exactly the path Great Britain took in their path to a gun free society. Keep your guns until death is on your doorstep, then make sure you pass them on the the ones that will have to fight to take control of our government back from the corrupt politicians.
