HAGERSTOWN, Md. (AP) — The uncle of a 9-year-old Maryland boy who was fatally beaten over a missing piece of birthday cake is asking a judge to throw out his statement to police.
The hearing for 24-year-old Jacob Barajas (bah-RAH’-hahss) ended Tuesday in Hagerstown with no immediate ruling. Barajas is charged with second-degree murder and first-degree child abuse stemming from Jack Garcia’s death last July.
Hagerstown Police Detective Anthony Fleegal testified Barajas was not considered a suspect when he told investigators he handcuffed Jack to a chair as punishment for stealing. Barajas told police Jack was then beaten by the mother’s boyfriend, Robert Wilson. Wilson pleaded guilty to second-degree murder in March.
Defense attorney Stephen Sacks contends the questioning of Barajas amounted to an interrogation, so Barajas should have been read his rights.

Imagine the hell that boy lived through in his short life.
Unless you think this beating and murder of a child was the very first time they ever beat that little boy. HANDCUFF a child to a chair and then, being really tough guys, start beating him??
He probably was beaten every day. Like a dog.
I'd like to "interrogate" the whole family for about 10 minutes.
His lawyer would be next.
958 ok trooper calm down.
Trooper? Lol.
If I was one of them, I'm pretty sure that fat bastid would have made a play for my weapon. In which case, I would have had no choice, being afraid and all, except to turn him into a finely chopped taco. Just another day at the office.
Anyone who grew up with parents like that would understand.
