The retiring chief judge of Maryland's highest court says Gov. Martin O'Malley has chosen Mary Ellen Barbera to be the first female chief judge of the Maryland Court of Appeals.
Judge Robert Bell said Tuesday night in an interview with The Associated Press that the governor had informed him of the selection earlier in the day.
O'Malley declined to comment while leaving an event at the Maryland State House recognizing attorneys who do pro bono legal work, an event Bell also attended. O'Malley said he would have more to say on Wednesday, when a news conference was scheduled to make an announcement on judicial appointments.

legislating from the bench...you mean like Scalia and the rest of the conservatives did when they overturned Section 4 of the Voting Rights Act, that was overwhelmingly passed by Congress?
