Why Is Alleged 17-Year-Old Rape Victim Being Held Behind Bars Before Trial?

An alleged 17-year-old rape victim is behind bars. She’s being held in juvenile custody and a judge is keeping her locked up to make sure she appears for the trial of her accused rapist, Frank William Rackley, who has a 20-year criminal history and who prosecutors believe may be a serial rapist.

Criminal Defense Attorney Chip Merlin said that while the DA needs this teen’s testimony, “the problem here is the way they are going about it. The prosecutor is making the victim of a criminal case, a juvenile, a victim again, a second time, by placing her in jail while the accused is going scot free right now.” Merlin suggested that there are other ways the prosecutor could have made sure that the victim showed up at the trial, including the use of an ankle bracelet.
