Cell Phone Stop Leads To Gun/Drug Charges

Defendants and Charges:
 
-Jaquan Leonard, 19, Delmar, DE (Carrying a Concealed Deadly Weapon, Conspiracy 3rd Degree, Possession of Marijuana, Possession of Drug Paraphernalia)
 
-Tevin Scarborough, 20, Pungoteague, VA (Carrying a Concealed Deadly Weapon, Conspiracy 3rd Degree, Possession of Marijuana, Possession of Drug Paraphernalia)
 
-Breon Scarborough, 20, Temperanceville, VA (Conspiracy 3rd Degree, Possession of Marijuana, Possession of Drug Paraphernalia)
 
Resume:  
Bridgeville- The Delaware State Police have arrested three men for drug and weapons charges after they were stopped east of Bridgeville last night.
 
The incident began at approximately 7:20 p.m. last night, Saturday, March 26, as a trooper on routine patrol observed a green sedan traveling northbound on US Rt. 13 east of Bridgeville. The trooper saw that the operator of the vehicle was talking on his cellular phone and conducted a vehicle stop of the car. As the trooper made contact with the operator of the vehicle, later identified as Breon Scarborough, he detected the odor of marijuana coming from the interior of the vehicle. The trooper removed Breon Scarborough from the car and secured him in his patrol vehicle. He then responded back to the sedan, and with the assistance of other troopers, removed two passengers from the vehicle. A pat down search was then conducted of both subjects at which time a 40 caliber handgun was located in the waistband of the rear seat passenger, Jaquan Leonard. Leonard and the front seat passenger, Tevin Scarborough, were then also secured in patrol vehicles. A subsequent search of the sedan revealed a 380 caliber handgun under the front passenger seat. Ammunition for the weapons was located in the trunk of the vehicle as well as 3.6 grams of marijuana and digital scales in the glove box of the car.
 
All three subjects were then arrested and charged with the above list of crimes. They were then arraigned at JP Court 3. Both Jaquan Leonard and Tevin Scarborough were then committed to the Sussex County Correctional Institution for lack of $6000.00 cash bail. Breon Scarborough was also committed for lack of $4000.00 cash bail.

I notice this press release doesn't state what kind of car they were driving. Two things:

1) I highly doubt the trooper stopped them for talking on cell hone rather than driving while black. Cops figure out which car is most likely to be drug dealers FIRST, then they figure out an excuse to stop them SECOND. Ask any officer and they will admit this, they have over 150 things they can stop you for memorized.

2) You'd think these idiots with all the guns, drugs and whatnot could afford a $29 bluetooth headset or have a passenger take the phone call!

If that was in MD, it would never have happened due to our rediculous cellphone law. We need to change our law that allows the police to pull people over as an initial offense, not secondary.

I can't keep track of the people each day I see still talking on their phone.

Anon 2:40, you answered your own question in point #2---They are Idiots. And so what if officers have 150 reasons to stop. If you are doing nothing wrong, you have nothing to worry about. Looks like they did a great job in this case.

We serve our government. The police are the muscle. Avoid the police at all cost. Stop talking on the phone etc. Just realize that your government is out to get you!

My point Brian is that any officer can follow you, me, anyone of us and find a "reason" to pull us over within 10 seconds. Touch the yellow line, follow too closely, not turn on turn signal soon enough, etc. There is not any of us that can drive perfect enough avoid one of the 150 infractions.

I'm white and just because I drive a dark color sports car and work late at night have been stopped for illegal U-turn twice (according to cops there isn't a LEGAL u-turn), crossing (non existant, non painted) center line going around a corner, taglight (when I got home it was working fine), was told once that I was going 72 around the S-curve in Salisbury yet he waited until Tastee-Freez to pull me over. There is no way I could even do 72 around the S-curve, besides I was in no hurry I had just eaten "lunch" and wasn't in any hurry to get back to work, when I called him on it, he told me to drive more carefully and let me go.

Luckily, I'm white, don't drink and drive and don't carry anything illegal. Once they see this they let me go.

These 3 needed to be locked up no doubt. But too many innocent people get harrased just because of who they are. Why don't you ask any black resident of Laurel what they think of driving in town. I know someone who's a single mom that had her car torn apart for going 6mph over the speed limit, when they didn't find anything, told her she could put everything back in her car. (single mom, carseat, tons of baby stuff, clothese etc. took her forever)

It's just scary at 2am, you could get pulled over by rogue cop, have evidence planted on you and end up in jail all because you were going to pick up lunch.

When the police live by the same rules we have to...then fine...but how many times have you seen a police officer of any level speeding and talking on his cell phone??? I can tell you it happens alot....I guess their better "trained" to do such.

1:49 missed the point.....the police SERVE the pepole, but its NEVER a "people" that's in front of them at any given moment. 6:56 was saying that IF the police want to pull you over, they WILL find a reason. You may be the most law abiding good citizen on the planet, but if you are in a luxury car at night, or are African-American with a couple of buddies in the car, too, or in a bad part of town, the police will pull you over....and this story shows why the police want cell phone use to be a primary offense. Has NOTHING to do with safety, EVERYTHING to do with money and the ability to get up close and personal....
