New Castle Man Charged With Aggravated Menacing

Location of Incident: 1900 block of Maryland Avenue, Wilmington, Delaware, New Castle County

Date and Time of Occurrence: Saturday, April 11, 2009, at approximately 2:30 p.m.

Suspect(s): Josue Hermida-Rivera, 19, of Amstel Drive in New Castle, Delaware

Resume: This past Saturday afternoon, Troopers were called to the area of the 1900 block of Maryland Avenue for the report of an armed subject following another subject in his vehicle.

The Delaware State Police dispatch center, RECOM, continually gathered critical information pertaining to the whereabouts of the suspect and kept responding units updated as they closed in. A Newport Police Officer was first to arrive in the area and apprehended the suspect, Josue Hermida-Rivera, driving in his blue Ford Explorer on Middleboro Road.

Troopers then contacted the victim to ascertain the facts of the case. It had been alleged that a dispute took place the day before between the victim and Mr. Rivera at Delaware Park. The victim said he broke out a window to Rivera’s vehicle. At the time of the original incident, the victim agreed to pay Rivera for the damage and the two parties went about their business.

At about 2:30 on Saturday, the day after the Delaware Park incident, the victim was driving on Maryland Avenue when he spotted Rivera. Rivera drove up along side him, brandished a handgun and threatened the victim with it. The victim fled into Banning Park and the suspect followed.

With an understanding as to how the case originated, officers then conducted a canvas of the area and located a loaded Glock 9mm handgun Troopers believed Rivera tossed out of the window when he saw officers behind him.

Josue Hermida-Rivera was formally charged with Aggravated Menacing (felony) and Possession of a Firearm during the Commission of a Felony (felony). He was arraigned and ordered held by the Department of Corrections in lieu of $5,000.00 secured bond.
