Tom Cotton: Supreme Court must act against left-wing 'resistance judges'

The Supreme Court must take action against left-wing "resistance" judges, Sen. Tom Cotton, R-Ark., urged Tuesday.

In an interview on "Fox & Friends" with hosts Steve Doocy, Ainsley Earhardt, and Brian Kilmeade, Cotton said that behavior from liberal judges like Justice Sonia Sotomayor and Justice Ruth Bader Ginsburg is what is "unprecedented."

After a dissent Friday, in the case of Wolf v. Cook County, Justice Sotomayor -- who was appointed by former President Barack Obama -- wrote that the Trump administration repeatedly uses the reason of "emergency basis" to bypass lower courts.

She wrote in her dissent, on a case dealing with the Trump administration's expansion of situations where the government can deny visas to non-citizens looking to enter the U.S., that it is troubling how often the administration is running to the Supreme Court for relief from injunctions against its policies, and how often the court is granting President Trump's requests.

The legacy of the 'wise Latina' rolls on. Sen. Cotton is correct; he's from rural AR, graduated Harvard magna cum laude in 3 yrs. and then Harvard Law. He enlisted in the Army and chose Infantry over the cushy JAG path. Tours in Afghanistan and Iraq and promotion to Captain. So he's walked the talk.

Groups opposed to various of President Trump's executive actions have resorted to Lawfare. The venue shop and get a Federal District judge to issue an injunction that stays the President's action; many of these injunctions or orders have been nationwide in their scope. This runs against common sense.

District courts should have power to rule on events in their physical district, period. The losing party can appeal to the next higher court which hears appeals for that circuit. Then an appeal can be lodged for all of that circuit's Appeal judges to hear. Final step is the Supreme Court. That can take a long time; the case they are hearing today is eight (8) years old which is why the wrench in the gears of Lawfare has become so attractive to political and policy opponents.

It's worth noting that Republican appointed judges are much less likely to become tools of Lawfare jockeys; Democrat appointees have proven much more amenable to participating in this stall tactic.
