Officer Involved Shooting In Sussex County: UPDATE


Sussex County: Warrants have been approved for Chad Fulginiti. The charges are as follows:

Burglary (felony)- Fulginiti had unlawfully entered the automotive shop at the Lewes Auto Mall (17861 Coastal Highway, Lewes, Delaware) where he damaged the vehicle mentioned in the first Updated News Release
Criminal Mischief (misdemeanor)- Damaged the vehicle again mentioned in the first Updated Release
DUI (traffic offense)
Disregarding a Police Officer’s Signal (felony)- led Troopers on a high speed vehicle pursuit along the Route 1 corridor

Mr. Fulginiti has been transported to Christiana Hospital for treatment to his hand. He is expected to arraigned later today or tomorrow.
Sussex County: The following information outlines the initial investigation into the officer involved shooting which occurred earlier this evening.

At approximately 2:43 p.m., a female subject called 911 to report a domestic related argument between herself and her husband- Chad M. Fulginiti, 38, of Millsboro. The caller advised the initial incident occurred on Route 24 in the area of Burton’s Pond Road. The female said she got out of the vehicle, a gray Nissan pick-up, and her husband fled the scene. The female told the 911 operator that her husband was distraught and suicidal.

A short time later, the female advised she discovered the suspect had taken his handgun from their home.

Allegedly, Fulginiti next drove to the Lewes Auto Mall, to CP Diver, where he located a vehicle belonging to a subject he believed was romantically involved with his wife. The suspect then significantly damaged this vehicle.

Units began to check the area and located the Nissan pick up on Van Dyke Street in the development of Bayside. By this time, a Delaware State Police Crisis Management Team Member was on the phone with the suspect. Fulginiti pulled out onto Route 1 and started southbound.

For the next hour, the suspect drove along the Route 1 corridor, while continuing to talk to officers on the phone. During the phone conversations, Fulginiti confirmed that he was armed. He also threatened to harm himself and ram a police car.

The Nissan eventually pulled into the development of South Shores Marina on Marina Drive. The DSP units converged in on the development and set up a perimeter to keep the suspect from fleeing again.

Troopers continued to speak with Fulginiti in an attempt to end this situation peacefully. The suspect was angry and threatened ‘suicide by cop.’ He threatened that he was going to harm himself and other people. Troopers attempted to keep Fulginiti at bay, however, he started to flee the scene in a reckless manner at which time a Trooper fired his departmentally issued weapon a single time, striking the suspect in the hand.

The Nissan came to a stop and the suspect was taken into custody. First aid was immediately rendered and the suspect was transported from the scene to Beebe Hospital.

The Trooper involved in this shooting is a 7-year-veteran of the Delaware State Police assigned to Troop 7 in Lewes. He has been placed on administrative duty pending the outcome of this investigation. His name will be provided to the media tomorrow.

This investigation is continuing and charges are pending. An additional news release, including a mug shot of Fulginiti, will be disseminated tomorrow when additional details are known and confirmed. This release will also contain the charging information.

Great shot, Trooper! Sounds like you ended the situation with the minimum amount of deadly force required. No bloodbath, no injured or dead officers or citizens.

I understand the men around here are low lifes but the women who shack up with them lol come on. "Oh he was a nice guy, He never did this when we first started dating, It's my fault!" The problem is, Women sleep with the men, then start dating. They fall in love the dingaling and do not get to know the man. THATS the issue!

Isn't it amazing how DSP can take one shot and just injure. While MSP take 20 shots and kill!

"Shacking up?" They were married. While I whole heartedly do not condone the man's actions, maybe she shouldn't have been cheating on him. With someone he works with no less. If you do a little research, you'll also discover he was a loving father and family man totally devoted to his wife and son. What do you think set him off? I also realize the saying "It takes two", but it sounds like it only took poor judgement from one (Mrs. Fulginiti) to put it in motion.

I am Proud of the DSP for not making the situation any worse than it needed to be. What they did was above and beyond, and no matter what mistakes Mr. Fulginiti made yesterday, his Son still deserves a father.

10:27 Shoot one time the perp may cause an officer to not make it home that evening, shoot 20 times and kill, he goes home to his family. If it is necessary to shoot, double tap!!! Had a bad guy down here in Florida shot around 50 times or so and our great sheriff when asked whey his deputies shot the guy so many times, he answered, "They ran out of bullets". Need more LEOs with that mentality. If Leggs had been shot years ago, Sarah would still be with us. jackkcharl@aol.com

Looks like he was heart broken to learn of his wife's affair. I don't condone the behavior but I can understand when your heart has been crushed like this. Been there, done that! When you truly love someone and do all you can for them, and then something like this happens, the man flipped out!

So Jack R. having served and knowing of the wieght of taking another's life, I commend the DSP and them using their best judgement in the situation. This man was a distraught family man, not a drug crazed career criminal. You know nothing of what a double tap is except some expression you've heard in movies or on TV. 50 shots? I've heard the story. Any professional knows 50 is dangerous and highly unprofessional. That's an undisciplined amateur hour right there. While I believe in the law and gun rights, I also believe that those charged with upholding those laws and in charge are held to a higher standard. The DSP did the right thing here, and it wasn't some hillbilly Florida shootout. I understand and respect the loss of that Sheriff's life, but when people sign on in this line of work, we understand the risks we take. Sometimes we don't come home, and that's the risk we take so people can make a quick, uninformed armchair judgement like yourself. Put yourself in that guy's shoes. Are you married? Do you have a child?

No one on here knows the "real" situation. The accused friend did nothing wrong and the simple fact that Mr. Fulginiti is extremely jealous over ANYTHING even a phone call led him do do these hanus things...Its quite pathetic actually. IF he were such a good father he wouldnt have done anything like this to begin with to jeoparize his life.

I agree with 9:00 am. While they were shacking up, people shack up all the time without getting to know each other first. Mainly for sponging reasons.

Both parties are too quick to jump into the sack before they get to know each other.

Did he have any idea she was a hoochy? Did she have any idea that he would go off the hook when he found out she was a hoochy?

If they got to know their true characters before bumping ugly's this whole incident could have been potentially avoided.

What horrible thing did Mr. Fulginiti do? He smashed the car of the guy that his wife was having an "alleged" affair with? In this day and age, if it's usually "alleged", it's pretty spot on. People don't have "alleged" affairs. Alleged just means nobody was sure to what extent. Maybe the other guy shouldn't have put himself in such a position with a married woman? And shame on her for breaking her vows. Jealous over a phone call??? Sounds like someone knows the guy and is defending him. Why was Mrs. Fulginiti or this man calling each other that the husband didn't know about it then? Sounds fishy to me.

Correct me if I am wrong, but isn't the rule of thumb if you make the decision to fire your weapon, you put it center mass and shoot to kill, otherwise you shouldn't have fired in the first place. If you ask me the trooper needs to spend some more time at the range. But don't get me wrong here, I am proud of our men in uniform and I applaud them for putting their life on the line everyday to keep us safe.

First of all, don't judge if you don't know them! Yes I know them! Very well as a matter of fact considering one of them is my immediate family member!! Chad is NOT a bad guy. He had a broken heart. That doesn't excuse him but love makes you do stupid things. How would you feel if this was your fucking family? I have an idea..don't throw a stone at the glass house that everyone one of you live in!!!

7:05, I was under the impression that an officer is supposed to use the minimum amount of force possible to deal w/ the situation. Blowing a hole in the perp's intestines doesn't sound like it was called for here (though I personally like that idea).

Again, that's just the impression I was under. You may well be right in what you said in your post.

"That Guy"-So you wanted them to kill a distraught family man is what you're saying? You, my friend, are a moron. At no point from what I've found did it say he EVER pointed the weapon at anyone, and from what I'm reading he went AROUND the police. Not towards. I'm sure you can relate to the police rather well and their shooting center mass as I'm sure your job requires you to make these judgements every day. Quit being an armchair warrior. Be glad it had a happy ending for his family and show some respect!

Chad is not a bad man at all! I know him and I am shocked he went to this extreme. I will pray for him and his family as this is a very bad time for him. This is the perfect example of not judging or throwing stones. Thank God the situation ended as it did.

I went to school with Chad and never thought he could actually do something like this. It seems to me as if his wife wouldn't have been cheating on him, this would have not happened. There is always another side to the story. Nobody besides himself will ever understand. Lord knows what she has put him through

I worked with Chad and have absolutely nothing bad to say about the man. I can understand the heartbreak he must have felt when he heard his wife cheated on him. Chad told me he had stopped drinkin, sounds like he relapsed due to the anguish. He was always polite and helpful at work. Justin didn't come off that way. He had a negative vibe about him. Chad's wife was considerably younger than him. I can see how this could've occurred. Very disturbing to hear about.
