Is There A Press Release, Or Not?

Last night at around 11:30 PM I spoke with Mayor Mike McDermott of Pocomoke and he said he expected a Press Release on the Billy Burke arrest that night.

I called the Pocomoke Police Department around midnight and asked to speak to the Captain and they informed me he wasn't in but that he would be in tomorrow between 8:00 AM to 4:00 PM.

I had read elsewhere that there was a press release available so I called the Pocomoke Police Department and asked for Captain Brumley. The woman who answered the phone said, he's not in today. I explained how I spoke with the Mayor last night and then confirmed after calling the Police Department last night that the Captain would be in today. She replied, Sir, this is a Holiday and none of the administrators will be in today. MUST BE NICE!

Nevertheless, I expressed how I had heard there was a Press Release, could you forward me to anyone that could forward me that Press Release. She replied, No. Wanna bet our telephone conversation was recorded, yet they didn't say I was being recorded?

So if any of you know of a Press Release out there and want to tell us where we can obtain it, say so in comments please. Have a nice Holiday Administrators. So you know, news doesn't stop on Holidays, NOR DOES CRIME!

Sometimes we bite off more than we can chew, and sometimes you get fired for it.

welcome to the pocomoke machine.
they will promise you everything but provide nothing until they know they are 100% in the right, even then if it looks negative for the city you wont get it. Everything has to be approved by Russ Blake before it's released. Your best bet is to call city hall and ask when boss hogg will review and release the information.
The only person in pocomoke allowed to submit documents is Harvey Davis for grass being to tall.

Joe, It's on the WBOC website. I believe it to be a press release issued by the mayor himself, not the Pocomoke City Police Dept.

Corrections and police Depts. have no work schedules for top adminstators on fridays or mondays if a holiday falls on sats.or suns. They will usually take fris. and mondays off. Good luck.

Well first of all, maybe you should read up on your laws. You are expressing consent anytime you call a police department. It is considered implied consent because you have called a police department or when you call 911.

Furthermore, maybe if you would stop bashing everyone about everything, you would get some slack Joe. Give this town a break and do some good reporting and less bashing. I think you can be a great reporter becuase you do have the talent to find out information, but ive lost a lil respect here lately because you seem to be bashing any type of government affiliate.

Lay off and enjoy your holiday.

2:47 PM There are people that like to know the truth so you give it a break. Joe is doing a good job and that really scares some of you.

How is it implied consent when you call the non-emergency number?

Anonymous said...

since when does a non emergency call express consent to be recorded?

as for as pocomoke, it is what it is and it's finally coming to light. Maybe this is what was needed to bring justice to the criminals that suck on the city's teat and has done for years and years. it's just a shame it had to come at yet another citizens expense.

Maybe you should contact Mike McDermott the mayor, OR Mike McDermott the detective, OR Mike McDermott the private citizen. I am sure all three have access to a computer and would be happy to type you up a press release.

Maryland Md. Code Ann., Courts and Judicial Proceedings §10-402 yes yes yes - § 10-410.
http://www.ncsl.org/programs/lis/cip/surveillance.htm

"State courts interpreted laws to protect communications only when parties have a reasonable expectation of privacy.

Speaking on the steps of City Hall in Pocomoke City, a public forum, gives Mayor McDermott NO "reasonable expectation of privacy".

Billy Burke is obviously being harrassed by Mayor McDermott who openly supported Tracy Cottman against Mr. Burke's wife, Stephanie, for 5th District Council seat.

Billy Burke is innocent of all charges and quite likely has a civil suit case against the City of Pocomoke.

Maybe, finally, the Mayor has stepped too far in his quest to hide the illegality and fraud of the recent election, and his reign of terror on the citizens of Pocomoke City will end!

Billy, Post it all, and own pocomoke after the fray. Then Wymsie will take her rightful place!

POCOMOKE: Candidate's wife charged with illegally taping mayor
By Jenny Hopkinson • Staff Writer • April 10, 2009

SNOW HILL — Local blogger William Burke has been charged with a wiretapping offense after he recorded a conversation between himself; his wife, District 4 city council candidate Stephanie Burke; and Pocomoke City Mayor Michael McDermott, and posted it on a Web site.......

Shows how you people aren't independent thinkers and believe whatever you read here. Albero merely suggests his phone call to the police department may have been recorded without him being advised it was being so, and you people run with it. Since Albero doesn't live in Pocomoke City, it's doubtful he contacted the department through their 911 line. If he called via their routine line, those lines are not recorded. If you have ever called into a 911 center, you will hear a slight audible beep which informs the caller the call is being recorded. When you call a company, do you recall hearing the automated system of representative from the company telling you the call will or may be recorded for training and/or customer service purposes? That's simply a nice way them saying they're fulfilling their requirement mandated by law that all parties involved in a phone call be informed the call is being recorded.

5:22 Hey Perry Mason. I haven't read anything to suggest the mayor was giving a public speech. If he wasn't, and he was simply having a conversation/discussion with the defendant alone or the defendant and several other citizens, there is no difference if this conversation occurred on the steps of city hall or within the confines of the mayor's office.

7:08 If you're going to be real honest about it, I think all these local bloggers are a few turns short of being wrapped tight.

The mere fact they were on the steps of a public buiding DOES not mean there wasn't an expectation of privacy....Take it to court and let's see! People need to work together to solve Pocomoke's problems. The Burkes are instigators, nothing less, maybe more!

That captain you mentioned is a criminal himself. Is their a statute of limitations on having sex with a minor? I remember when I was younger he was a trouble making officer back then. He had a habit of preying on high school girls and having sex with them in the Pocomoke City police cars. I wonder if he remembers Rae Ann. LMAO

Anyone remember the incident of the 'outhouse'? Schaefer commented on the Eastern Shore, calling it the 'outhouse' of Maryland, which was overheard and RECORDED by someone.

Schaefer had the nads to pull it off, and the gentleman that it was said to, also did, but it was a recorded conversation in a public place - the steps of the State House.

Somewhere where McDermott will never be (in office) . . .

I think most of these comments under anonymous are Billy Burke himself. He's circlinig his own wagons. Kinda funny if you ask me.

Hey Officer Bromely I remember when you were hitting up on my sister. I wish I knew now what I didn't know then because your a$$ would be on the sex offenders registry. You took advantage of your position and violated my sister and several of her friends. I am going to ask her if she wants to come forward with that information.

All this discussion of the Pocomoke Police reminded me of something that happened after the former Pocomoke chief left Pocomoke. The chief had purchased a small sofa and chair for his office. The company that sold it to him keep calling because it was not fully paid for. Pocomoke did not purchase it, the former chief did, allegedly for purposed beyond his scope of duty.

Other than a 911 call to Police is not automaticly recorded unless you are notified. If it is recorded without your consent by the Police or any Public Servant has violated MD law. This makes them liable in a civil case.

8:39 You don't know what your talking about when you say the Pocomoke Police Department does not record their main line. Because in fact they do, and without telling the caller either. Get your facts straight.
