No enlargement needed. I listened to the tape off Pocomoke Tattler and he was shouting loud enough for everyone to hear; thus "null".

This is clearly a case of retribution from Boss Hogg for having the States Attorney seize the absentee ballots.

The recent election is being investigated for voter fraud and the odds are, they are going to find it.

The ONLY recording was made on the steps of Pocomoke City Hall and there were NO telephone conversations, ever recorded.

The Pocomoke Police Department whom only reports to City Manager Boss Hogg Russell Blake is trying to shut down the Pocomoke Tattler.

The search warrant was for ANY DEVICE THAT COULD CONNECT TO THE INTERNET...

With no definition of the type of Internet connection, e-mail, web, text, sms, USENET, telnet, ftp or whatever.

They took my childrens Macintosh, Wymzies laptop and non-working lapt top, my new digital video camera that had been used to record the opening of the fraudulent absentee ballots (with full disclosure) my pocket digital camera and my cell phone.

They also took a broken digital voice recorder and a broken external hard drive.

The intent of the seizure is not to find copies of the recording, heck

I SENT COPIES TO THE MARYLAND STATE ATTORNEY GENERAL & WORCESTER COUNTY STATES ATTORNEY...

With the question: Is destruction of public government documents still a crime?

Because if it is, Mayor McDermott laughed about Boss Hogg Russell Blake destroying an incriminating public document that was under an active FOIA request.

The city denied having the document and stated they could not find it. The Mayor was actually laughing on the recording when talking about watching Boss Hogg destroy the document.

So I ask the public, who committed a crime?

Prior to this incindent, I had no idea there was any sort of a law about recording a conversation and have never recorded one before.

Nobody every asked me for the recording and nobody has asked to have them removed from the website.

The charges are clearly political retribution and a feeble attempt to shut down the Tattler.

The people who need to worry about the criminal charges are the members of the openly corrupt Pocomoke City Government.

Plus they owe Stephanie and my family an apology for what they have done.

you need to sue sue sue!!! What crazy judge signed that bogus search warrant? any device that can connect to the internet???? I didnt know you needed to connect to the internet to record a conversation. WTF???? Make sure you sue every last one of them corrupt people!!

Oh, I have a comment! Billy, you need to find yourself a good, no great lawyer to kick these punks asses. You need your equipment and your personal information that is in that equipment back. You own that information and it was stolen from you under false pretenses by the local government. Copies they make are illegal. The financial, educational, political, and personal hardship that has been illegally taken from you needs restitution. Your Press rights have been violated. I could go on, but your lawyer needs to take over and kill Pocomoke's Bubba system.

I'm surprised not to read more from Don Elkins at WBOC since he was a former blogger himself... WBOC phone is 410-749-1111, I don't see Don's email, but I'd imagine it's delkins@wboc.com if not try shammond@wboc.com which is valid along with news director jdearing@wboc.com I can't believe WBOC isn't all over this.

I had some minor hostilities with you and Ms. wymzie on this site. I considered them nothing more than friendly, abrasive, vigorous debate on different views. The criminal way the state is harrassing you goes way beyond the comical vision of Boss Hogg type bully politicians; it smacks of Nazi jack boots trying to crush legitimate adversaries.

Of course I'm not the smartest m.f. on the block, but how the hell is taping an elected official in a setting where he had no expectation of privacy a crime? If he embarrassed, humiliated or incriminated himself, that's his own damn stupidity! I'm shocked that the state would harrass you in this instance where you obviously did nothing wrong. I kind of envy you and Ms. wymzie. This kind of reckless, illegal retaliation by the mayor and those who went along with his "plans" for jack booting an American citizen should result in
a huge cash judgement for the wrong done to you and, indeed, the freedoms that most Americans hope to retain in these Orwellian times.
Best of luck with destroying this travesty of legal process. But, honestly, if the circumstances are as presented, you should need no luck; the law and the people will be securely on your side.

Want comments, I'll give you a few. Apparently a court judge, not part of the local government, thought sufficient probable cause existed to issue a search warrant for your home. As far as you not knowing secretly recording a conversation was illegal, haven't you ever heard the old saying, "Ignorance of the law isn't a defense?" Seems to me you got caught in your own trap. It's seems fun slapping the grizzly bear in the face until the bear slaps back. You bloggers walk a very slippery slope. You all better be well versed in all aspects of the law, criminal and civil, if you're going to keep doing what you do and how you're doing it.

Now quiet down and dig deep to pay for that defense attorney.

If boss hog has a police detective/mayor in his back pocket, what makes you think he doesnt have a judge in there too. My guess the judge was Purnell. If you want to get to the bottom of everything, follow the dollar. My guess is that everyone that took part in this latest injustice should be looked at real close. Todd, Mcdermott, the judge, did I miss anybody?

what the Burke's mean by not knowing the tape was recorded illegally, has to do with a law relating to journalism, in which a journalist makes public something they KNEW was obtained illegally.
Never mind, I'm going to quit explaining-it just dawned on me-you'll never get it!

I have seen at least 2 lawyers blog on here, both of them say Billy should sue. Its funny how you dougheads that defend the mayor have no interest in what was on that tape.

Peter Wimbrow, offices in Ocean City, besides the usual criminal work, also has been known to staunchly defend those individuals whose rights were violated by law enforement officials and governments (local and state). I was looking at his website and noticed today is Pete's birthday!

Looks to me like McDermot is the one that broke the law, he is a sworn officer of the court, if he saw the city manager destroy the documents in question he(McDermot) should have acted on it then and there. I don't think the mayor should worry about running for state office, I think he needs to worry about his retirement. My opinon; stick a fork in his ass, he is done. We are behind the Burkes 100%. 9:34 No lawyer, at least no legitimate lawyer, would suggest, without knowing all the facts of a particular incident, suggest anyone sue. And if there are legitimate merits for a civil suit, a real and legitimate attorney would wait until the criminal case plays out and all the evidence is produced during the trial before making such a claim. Wise up.

Mayor Mike Macheese left his morals at the door when he found out that Honiss the Hamburgular could line his pockets, why else would any self respecting republican cozy up to the likes of drug lord cane and eddy lee of the NAACP?
it's pretty bad when even mayor mike macheese's father does not even like him. it's just a shame that the Burke family had to be subject to such underhanded tactics. Mike Macheese, Joel Todd and their posse should all be ashamed of themselves. Billy Burke is not the problem, if they look in the mirror, the problem will be steering then in the face. If I were a Pocomoke police officer that was involved in this I would resign now and apologize. If not, I hope you can find a job changing tires or cleaning porta-potties like officer Townsend.
