Salisbury Elementary School Teacher Candace R. Pianka Arrested On Sex Abuse Charges
On May 18, 2010 the Wicomico County Child Advocacy Center began an investigation into the sexual abuse of a (13) year old female. The abuse was alleged to have recently been committed by her biological mother, identified as (30) year old Candace R. Pianka at their Salisbury residence.
On May 18, 2010 Investigators interviewed the victim at the Child Advocacy Center at which time the victim disclosed that Candace Pianka engaged in using a device on the victim sexually.
Detectives interviewed Candace Pianka at the Child Advocacy Center at which time she admitted to committing the acts on the victim. Detectives placed Pianka under arrest for multiple charges related to the incident including the sexual abuse of a minor.
The investigation also revealed that Pianka is currently employed as 4th grade teacher at East Salisbury Elementary School through the Wicomico County Board of Education.

Could Stevie Prettyman Be Right About Night Meetings?
As many of you know, I truly like Stevie Prettyman. I believe she has served the citizens honorably on the County Council. Just when I thought Stevie was wrong with the night meetings she said, Joe, when does the AFP hold their meetings? I replied, the third Wednesday of every month at 7 PM. She then said, when does the City Council hold their meetings? As everyone knows they hold it usually twice a month at 6 PM on Monday nights. She then asked, when does the Zoo Commission meet every month. I said, OK Stevie, let me hear your point.
Stevie replied, CONSISTENCY. Even the AFP has consistency in their meetings. It would get too confusing if the times changed all the time. Stevie went on to say, if they proposed ALL night meetings from here on out, that's a different story. Whatever the taxpayers want, I'm OK with that, Prettyman said. However, make up your mind. Either have the meetings during the day or hold them at night but I will not support bouncing them from day to night every other meeting.
You know what Folks, she's right. There has not been a proposal to hold all of the meetings in the evening and perhaps after this Post the AFP will bring it to the table. In the mean time, you won't get Stevie's vote in favor of changing the meetings unless you make them all one or the other. Good call Stevie.

City Budget and Raises
Many people continue to state that City of Salisbury employees did not receive a raise last year, but this is not totally true.
The City had several employees in Neighborhood Code and Compliance as well as departments downtown that only worked 35 hours a week. The City uses a 40 hour pay grading system and these people were paid for 40 hours a week. Last year the 35 hour a week people were bumped up to 40 hours and were given a raise to compensate them for the additional hours. I'm told the raise was in the neighborhood of 12.5%.
This caused a quiet uproar in Public Works.
There are positions, such as receptionist, that are paid by the grade. Consider if a receptionist in a random 40 hour a week department made $400 before last year. Their counterpart in the 35 hour a week departments would have been moved to finally work the same amount of time, but been given an additional $1300/year for working the same amount, in the same position. Giving NSCC and other departments a 12.5% across the board raise for working 40 hours (even though they were paid on a 40 hour pay scale to begin with) was a slap in the face of all City workers that get paid for 40 hours on a 40 hour pay scale and actually created a new pay scale. Now there are people that work 40 hours a week for 40 hours of pay and there are those that work 40 hours a week for 40 hours of pay +12.5%.
When the secret came out (and it was a secret) Public Works employees circulated a petition in protest with signatures from every department and included several department heads. The petition was read by both the City Council and the Mayor and they did nothing.
This is relevant now, because the current budget includes "reinstating lost work hours" of 8 employees of the NSCC. Basically, this means those 8 people will continue to be paid above the 40 hour a week model, while only working 40 hours a week.
I am told, but have not been able to yet verify that the rest of the positions have been moved back to working 35 hours a week, while receiving 40 hour a week pay.

RESUME: On Tuesday, May, 18, 2010 officers of the Fruitland Police Department observed the above named accused walking in the parking lot of 217 Popular Street, Fruitland, Maryland and recognized him as a person for whom an open warrant existed charging Possession of Marijuana and Possession with intent to distribute within 1000 feet of School Property. Officers approached the accused, placed him under arrest and during the search incidental to arrest, discovered him to be in possession of CDS.

Holy potholes, this pair must be costing the City about 200K per year in salary and related things.
Ms. Chamber’s position was reclassified last year, for a $8,326 pay raise. And this year Jim Ireton wants to increase her pay by almost $10,000.
POLLITT DECLARES WAR WITH WICOMICO COUNTY COUNCIL
Rick Pollitt’s anger at the Council for asking for reasonable details about his proposed budget has boiled over into formal hostility. He is now publicly criticizing the members for their diligent action as the County’s legislative body. Elected on repeated promises of “transparency,” Pollitt is now exposed as yet another “don’t tell, don’t ask” politician in terms of how public funds are to be spent.
His tactic for responding to the loyal opposition is that perfected by Clinton and Obama and used for years by Barrie Tilghman (remember the “Dirty Dozen”): attack them in the media. Maybe Mr. Pollitt really does need a “public information officer” on his staff to tell Bubba, Barack and Barrie that there’s a new kid on the block.

Escape Restaurant Being Treated Unfairly
While the new owners of the Escape Restaurant are doing everything they can to survive on the Downtown Plaza, certain residents are making their lives miserable.
Last weekend they had a small band playing music outdoors on their commercial property and one resident made numerous phone calls to the Salisbury Police Department and they were ultimately forced to shut down the music. They even complained about the music being payed in the garden center at Parker Place.
Mind you Folks, this is a commercial property and they are allowed to hold music. Those residents who live on the Downtown Plaza knew what they were getting into when they PURCHASED their commercial property and turned it into residential. Mind you, there's only ONE person complaining.
How are any of the businesses supposed to survive when and if the Downtown Plaza is in fact revitalized? Because of one resident, the Police are going to enforce such a thing? Where's Urban Salisbury when you need them!

Downtown Mixer Tonight At Parker Place

Sarah Foxwell Remembered & Celebrated On What Would Have Been Her 12th Birthday
Last night a large group of people gathered at the Shorebirds Stadium to celebrate Sarah Foxwell's life as well as her Birthday. Pastor Warren lead off with a prayer while Jennifer Foxwell, Aunt Tracey Powell and Sarah's Father Tom Foxwell thanked everyone for attending.

Sarah Foxwell Remembered & Celebrated On What Would Have Been Her 12th Birthday Part II
As Kelsey Johnson, (12 years old) sang Happy Birthday, everyone gathered to release hundreds of balloons into the sky. At the end of her traditional Happy Birthday song she continued singing, "rest in peace little Sarah, Happy Birthday to you." It was a very touching ending.
I want to thank all of you for attending this very special event. The cake, (shown in our next post) was just unbelievable. When Cakes By David opened the back of their vehicle and I saw the 3' x 6' long cake resting on a table I just couldn't believe what I was seeing.
The Shorebirds have proven once again that they are community oriented by allowing everyone to gather on Christmas Day as well as yesterday, thank you.
White House Health Czar Repeats False Claim Of Lower Health Costs
White House health care czar Nancy-Anne Deparle repeated the claim that the health care reform law signed by President Obama will result in lower health care costs despite a well-known government report to the contrary.
Deparle, speaking to the American College of Emergency Physicians (ACEP) in Washington on Monday, said that the new health care reform would make health care more affordable by lowering premiums and reducing costs.
“The new law makes health insurance affordable for [the] middle class and small businesses,” Deparle said. “It’s one of the largest tax cuts for health care in history – reducing premiums and out of pocket costs.”
However, a report from the Medicare chief actuary found a “negligible” impact on the cost of health care. The only provision of the bill it found might have an impact on health costs was the government spending on comparative effectiveness research – a reduction of a mere $800,000 per year from the trillions in annual national health expenditures.
“We show a negligible financial impact over the next 10 years for the other provisions intended to help control future health care cost growth,” the report found. “There is no consensus in the available literature or among experts that prevention and wellness efforts result in lower costs.”
In fact, the report found that not only will the health care reform not significantly reduce health care costs – at least not for anyone but government – it won’t even stop them from increasing – a purported benefit known as ‘bending the curve.’

White House: Kagan Broke No Law Restricting Military Recruiters At Harvard
The White House will not explore whether Supreme Court nominee Elena Kagan violated the law when she did not allow military recruiters at Harvard Law School.
“I don’t think anybody in the White House Counsel’s office had to research that,” White House Press Secretary Robert Gibbs said on Monday. “I don’t think anybody has ever brought anything to say she has ever been in violation of the law.”
A conservative advocacy group, however, says Kagan’s refusal to comply with federal law by cooperating with military recruiters at Harvard is reason enough for the Senate to reject her nomination as Supreme Court justice.
As dean of Harvard Law School, Kagan prohibited military recruiting on the campus because she disagreed with the “don’t ask, don’t tell” policy that prohibits homosexuals from openly serving in the military. Kagan argued that such a rule violated Harvard’s anti-discrimination policy.

Obama Administration Commiserates With China About 'Human Rights Violations' in Arizona
In a "candid and constructive" human rights dialogue with officials from the People’s Republic of China last week, Obama administration officials brought up Arizona's new immigration-enforcement law, telling the Chinese Communists it was an example of a “troubling trend” in the United States and an indication of “discrimination or potential discrimination” in American society.
Ironically, the State Department’s most recent report on human rights in China indicates that the government there restricts the internal travel of its own citizens.
The human rights talks, held at various locations in Washington last week, focused on issues that both countries are dealing with, State Department Assistant Secretary of State Michael Posner told a press briefing on Friday.
Asked by a reporter if the Arizona law came up in the discussions, Posner said it did--and it was U.S. officials, not the Chinese, who brought it up.
"We brought it up early and often," Posner told reporters on Friday. "It was mentioned in the first session, and as a troubling trend in our society and an indication that we have to deal with issues of discrimination or potential discrimination, and that these are issues very much being debated in our own society," Posner said. The Chinese did not raise any concerns about Chinese people visiting Arizona, Posner added.
Posner's comments prompted the New York Post to editorialize on Tuesday that the Obama administration is once again bashing America on the world stage.
"China is one of the most flagrant violators of human rights on the planet, and for the Obama administration even to hint that America is on the same plane is despicable," the Post wrote on Tuesday.
On Fox News Tuesday morning, State Department spokesman P.J. Crowley--trying to defend Posner’s comments – was asked if he had read the ten-page Arizona law. He said he has not read it, although he did criticize it.

On Monday, by a 6 to 3 vote the Supreme Court ruled that it is unconstitutional for the United States to sentence juvenile offenders to life in prison without parole in non-homicide cases in Graham v. Florida, released May 17, 2010. The Court cited the UN Convention on the Rights of the Child (UNCRC) and other international law to buttress its constitutional interpretation.
“It is bad enough for the Supreme Court to engage in judicial activism. It is far worse when the justices employ international law in support of their far-reaching edicts,” said Michael Farris, chairman of HSLDA. “We have not ratified the UN child’s rights treaty—its provisions should not be finding their way into Supreme Court decisions.”
Farris was the author of a brief in Graham v. Florida on behalf of 16 members of the U.S. House of Representatives. The majority opinion twice references Farris’s brief in its discussion of international law. Farris is also the chancellor of Patrick Henry College where he teaches constitutional law.
“There is simply no place for international law or practice in interpreting the American Constitution. International law has its place in deciding truly international cases—but a case involving juvenile offenders in Florida is a domestic case through and through,” Farris said. “It was plainly gratuitous for the majority to employ international law in this context.”
Farris’s brief was filed in direct response to a brief from Amnesty International which had urged the Court to use international law as a binding rule.
Amnesty also argued that the United States was the only nation in the world to sentence juveniles to life without parole. “The materials submitted by Amnesty International included a hodgepodge of letters and emails supposedly on file in Amnesty’s offices. Such ‘evidence’ would not be admissible in a traffic court; it is shocking that the Supreme Court relies on such data to make constitutional decisions,” Farris said.
“Our brief demonstrated that the UN Committee on the Rights of the Child (the UN’s official monitoring body) had found that dozens of nations were in violation of the juvenile sentencing standards of the UN child’s rights treaty. It is simply fiction to say that the United States is the only nation which authorizes such sentences.”
Senator Jim DeMint (South Carolina) introduced a resolution (S. Res. 519) last week that urges President Obama to refrain from sending the UN Convention on the Rights of the Child to the Senate for ratification.
“S. Res. 519 seeks to put the Senate of the United States on record that American law and only American law should govern our families and our juvenile courts,” Farris said. “I hope that every American who believes that we should remain a self-governing nation will call their Senators today to urge them to become a co-sponsor of S. Res. 519.”

I want to thank Shanie Shields for standing up for those that she serves, the people of Salisbury. As far as I know she was one of the Council Members that was familiar with the Fair Housing laws and tried to convince the City Council not to enact the zoning restricting group homes in residential neighborhoods. Way to go Shanie!! I personally am against discrimination in any manor and make it a rule to know the laws that pertain to my job. Just in case you wanted some additional information about fair housing I am including a link http://www.justice.gov/crt/housing/final8_1.php that will tell you everything you ever wanted to know about FHAA but was afraid to ask. If you want more information on fair housing I will be delighted to send much much more, but I am sure in the next short while you all will be learning a lot more about Fair Housing and how it pertains to your duties as a public servant. It's common practice in America. A government-Wall Street cabal caused the financial crisis and subsequent fallout. Now debated financial reform is a stealth scheme to let bankers self-regulate. Rogue Democrats rammed through health reform to ration care and enrich corporate providers. It's too big even for the major media to ignore - to wit, on May 15, New York Times writer Justin Gillis headlined, "Giant Plumes of Oil Found Forming Under the Gulf of Mexico," saying:
Alarming reports show "Scientists are finding enormous oil plumes in the deep waters of the Gulf of Mexico, including one as large as 10 miles long, 3 miles wide and 300 feet thick in spots. The discovery" shows that BP and the Obama administration lied about the incident's severity, and they're still lying.
According to University of Georgia researcher Samantha Joye, "There's a shocking amount of oil in the deep water, relative to" what's visible on the surface, the tip of a big and growing iceberg, this one containing oil. "There's a tremendous amount of oil in multiple layers, three or four or five layers deep in the water column."
Worse still, it's depleting Gulf oxygen, prompting fears about killing sea life in the effected areas and permanently destroying the livelihood of area fisherman who supply 20% of the nation's supply.
Already since April 20, oxygen levels are down 30%, a pace that if maintained "could draw (it) down to very low levels that are dangerous to animals in a couple of months. This is alarming."
Even The Times admits the daily flow may be as high as 80,000 barrels (3.4 million gallons or the equivalent of an Exxon Valdez spill around every three days). Yet the Obama administration and BP still claim only 5,000 barrels a day, and company officials won't let scientists use sophisticated instruments to measure the output more accurately on the ocean floor. Clearly they have something to hide, but there's no way to suppress the growing ecological devastation once clear evidence substantiates it.

Napolitano Hasn't Reviewed 'In Detail' The Arizona Immigration Law She's Criticized
(CNSNews.com) -- Homeland Security Secretary Janet Napolitano, who has been a vocal critic of the new Arizona immigration law, told Sen. John McCain (R-Ariz.) and the Senate Homeland Security and Governmental Affairs Committee Monday that she had not reviewed the law in detail, but nevertheless repeated criticism she made in April on ABC’s “Good Morning America” that the law is a “bad law enforcement law.”
Last week, Attorney General Eric Holder said he hadn't read the law either, although he too has criticized it. He told the House Judiciary Committee he'd "expressed concerns" about the Arizona law, "on the basis of what I've heard about the law" from newspaper and TV reports. Holder has questioned whether the law is constitutional and has said the federal government may challenge it in court.
On Monday, Sen. McCain asked Napolitano, who is the former governor of Arizona, about the law during a hearing on the federal response to the oil spill off the Gulf Coast --“Have you had a chance to review the new law that was passed by the state of Arizona?”

TROOPERS CHARGE MAN WITH POSSESSION WITH INTENT TO DISTRIBUTE MARIJUANA
On Tuesday, May 18, 2010 at 8:30 pm, A Trooper from the Salisbury Barrack of the Maryland State Police stopped a blue 2001 Mercury Sable for a traffic violation in the 300 block of Chestnut Way in Salisbury Wicomico County Maryland. While contacting the driver of the vehicle, the Trooper was able to locate a small amount of marihuana on the driver’s person. The Trooper took the driver into custody and performed a search of the vehicle incident to a lawful arrest. Inside of the vehicle the Trooper located more than 1 pound of marihuana, digital scales, several empty plastic baggies, and more than 100 dollars in cash. All of these items, including the Mercury Sable, were seized and transported to the Salisbury Barrack. Troopers charged Evan Christopher Ward, 19, of Salisbury with possession of marihuana with the intent to distribute, possession of CDS manufacturing equipment, possession of marihuana, and possession of drug paraphernalia. Ward was turned over to a District Court Commissioner pending a hearing.

The Washington, D.C. newspaper – Roll Call – has finally printed what many of us have known for a long time – Frank Kratovil’s days as a Member of Congress are numbered. Moreau Fans Seven Over Four Innings In Game Two
Charleston, W.V. – The Delmarva Shorebirds and the West Virginia Power split a doubleheader on Tuesday night at Appalachian Power Park. The Power took game one 8-3, while the Shorebirds won game two 6-2.
In game one, the Power plated five runs in the bottom of the sixth inning to break a 3-3 tie. Maurice Bankston earned the win, while Matt Hobgood was pinned with the loss.
Nathan Moreau retired 12 consecutive batters in game two following a lead off walk. He struck seven batters over four hitless innings.
The Shorebirds got on the board first and never trailed. Tyler Kolodny hit a two-run homer in the third to give the ‘Birds a 2-0 advantage. Brian Conley connected on an RBI double down the right field line in the fifth to push the ‘Birds in front 3-0. In the sixth, the Shorebirds plated three more runs to build a 6-1 edge. Michael Ohlman delivered a two-run double to right-center field.
Randy Henry and Josh Dowdy finished off the Power in the final three innings. Henry earned the win in two innings of work.

In the Kentucky Republican primary Dr. Rand Paul, son of Texas Representative Dr. Ron Paul, rode a tide of discontent to victory by the tune of 58%-34% (with 99% reporting). Paul's candidacy was buoyed and pushed over-the-top by the Tea Party. Meanwhile, his foe Secretary of State Trey Grayson received strong endorsements by Republican and Senate Minority leader Mitch McConnell as well as former Vice President Dick Cheney and most of the establishment. With Kentucky a very red state, the chances of the winner of the Democrat primary, Attorney General Jack Conway, to win against Paul in the general election are slim. In essence, unless Rand Paul finds a lover in South America, comes "out" or perishes before the general election, it looks like he will be the new Junior Senator from Kentucky.
In Pennsylvania Democrat Senator Arlen Specter lost to two-term Representative Joe Sestak. Specter was seeking his sixth term, but first as a Democrat. He was asking the Democratic Party of Pennsylvania and the voters to send him back to Washington, even though for five previous terms he was their foe. They rejected him flatly giving Sestak 54 percent of the vote to 46 percent for Specter. President Obama and Vice President Biden had made no overt attempts to save Specter in the last weeks of the campaign as his inevitable defeat became clear. Biden was even in Pennsylvania in the past week, but did not stump for his former Senate colleague. Maybe this will send a message to politicians that switch parties: there is a price to be paid for disloyalty. Former Representative Pat Toomey won the Republican nomination.
In Arkansas Democrat incumbent Senator Blanche Lincoln held a narrow lead over Lieutenant Governor Bill Halter of just a few thousand votes (85% reporting). Since neither will reach 50% by Arkansas rule they must run against each other in a runoffs. On the Republican side Representative John Boozman will await the winner for a general election showdown.
In a special election, the Pennsylvania 12 House seat was won by Democrat Mark Critz as he defeated Republican Tim Burns. Critz will now serve the final few months in the term of the late Rep. John Murtha. With 70 percent of precincts reporting, Critz had 53 percent of the vote compared with nearly 45 percent for Burns, the AP reports.
Oregon gave us no surprises as incumbent Ron Wyden garnered 90% of the Democrat votes (79% reporting) and Republican Jim Huffman 42% in a crowded field of 7 candidates, his next closest challenger had 15%.
