Appeals Court Dismisses Dan Rather's Suit VS. CBS

NEW YORK (Reuters) – A New York state appeals court on Tuesday dismissed former TV newsman Dan Rather's lawsuit against CBS Corp in which Rather claimed he was made a scapegoat in a scandal over a 2004 report on then-President George W. Bush's military record.

The ruling on Tuesday by a panel of judges of the New York State Supreme Court Appellate Division said Rather's $70 million complaint should be dismissed in its entirety and that a lower court erred in denying CBS's motion to throw out the lawsuit.

Rather says CBS breached his contract by not giving him enough on-air assignments after he was removed as anchor of the "CBS Evening News" in March 2005.

The appeals court ruled he failed to sufficiently support his claim that he lost business opportunities due to CBS's failure to release him to seek other employment.

Rather sued CBS, parent of the CBS television network, Viacom and others in September 2007, claiming he had been made a scapegoat to "pacify the White House." CBS was part of Viacom until the companies split in 2006.

Update- Suspect Arrested On Child Sexual Abuse Charges

State Police are seeking the Public’s assistance in locating a registered sex offender who is wanted on new charges of sexual abuse

Location: Country Five Drive, Dover

Date of Occurrence: September 25, 2009

Suspect(s): John E. Brittingham, age 63, of Dover

Resume: Delaware State Police Detectives are investigating allegations of child sexual abuse. The female juvenile victim told investigators that the abuse began in September of 2005 and continued up until last month.

The victim’s mother took her daughter to Troop 3, after the juvenile confided in her mother about the sexual abuse. The juvenile was taken to the Child Advocacy Center for a formal interview. Troopers then attempted to make contact with the suspect at his residence.

The suspect fled his residence on Country Five Drive, before State Troopers arrived. The suspect is driving a 1992 Red Ford F150 with Delaware Registration Plates CL50247. Brittingham is driving with a revoked license.

Brittingham is already a registered sex offender, stemming from a conviction on charges of unlawful sexual contact on September 13, 2006.

Reps. Kratovil And Childers Introduce Tax Credit Extension For Homebuyers

Legislation will promote growth, stability in housing market

Washington, DC – Reps. Frank Kratovil (D-MD) and Travis Childers (D-MS) have introduced important legislation to help families buy and sell homes and spur growth and stability in the American housing market. The Tax Credit Extension for Homebuyers with a Loss Deduction Incentive Act (H.R. 3640) will extend for one year the $8,000 home-buyer tax credit, expand the credit to all homebuyers purchasing a principal residence, and provide relief for individuals or families who are forced to sell their home at a loss.

“Realtors and home buyers alike are reporting that the first time home buyer tax credit is working to revitalize the housing industry. In this economy it would be foolish to allow something that is working to simply expire,” said Rep. Frank Kratovil (D-MD). “Instead we need to extend this tax credit so that more first time buyers have an opportunity to enter the market, but also expand the credit so that all American’s are able to buy a home and give the entire economy a shot in the arm.”

“As a veteran realtor for over 30 years, I have seen firsthand the ups and downs associated with the housing market. Recent signs of recovery in the market are certainly encouraging, but we must follow through and sustain the progress linked to the initial benefits of the homebuyer tax credit,” said Congressman Childers. “H.R. 3640 will allow more American families to take advantage of this tax credit, provide an incentive for people to sell homes that are inflating an already flooded marketplace, and help further stabilize the housing industry. I am proud to join with Rep. Kratovil to introduce this important and timely legislation.”

The loss deduction provided by H.R. 3640 will be carried over a three year period and is worth up to $4,000 on an annual basis ($12,000 over a three year period). This provision is directly correlated to what is offered on capital assets to Americans who suffer a loss within a given year.

Iran: We Put Nuclear Site There In Case Of Attack

TEHRAN, Iran - Iran's nuclear chief said Tuesday his country built its newly revealed uranium enrichment facility inside a mountain next to a military site to ensure continuity of its nuclear activities in case of an attack — an unusually detailed disclosure that may be intended defuse international pressure.

But Vice President Ali Akbar Salehi, who also heads the Atomic Energy Organization of Iran, took a hard line over the country's nuclear rights two days before the five permanent members of the U.N. Security Council and Germany meet with Iran in Geneva.

He said Iran is willing to have a general discussion about nuclear technology in Geneva but will not give up its right to uranium enrichment and conversion. The security council has called on Iran to suspend uranium enrichment and return to negotiations on its nuclear program, which the U.S. and its European allies believe is aimed at producing nuclear weapons. Iran insists its program is purely peaceful and aimed solely at producing nuclear energy, which is allowed under the Nuclear Nonproliferation Treaty.

Thomas P. Evans – Mr. Evans is a licensed Pharmacist for the State of Maryland and works as a Pharmacy Supervisor at Maryland General Hospital where he supervises all aspects of the pharmacy operation, plans and implements automation of medication dispensing. Prior to that, he worked as an Informatics Coordinator at St. Joseph Medical Center. He is the former Commissioner of the Maryland State Advisory Board on Medical Privacy and Confidentiality, a member of the Maryland Society of Health System Pharmacists, President and Founder of the Bel Air Investment Club, and a former member of the Fallston Community Council. He received his Bachelor of Arts in Psychology from the University of Maryland, Baltimore County in 1980, his Bachelor of Science in Pharmacy from the University of Maryland at Baltimore in 1983, and received his licensure to practice pharmacy in Maryland in August of 1983. Mr. Evans received his Masters of Administrative Science from the Johns Hopkins University in 1988. He is a resident of Fallston, MD. Mr. Evans’ oldest child attends Fallston Middle School.

Wicomico County Board of Education Appointees:

Donald L. Fitzgerald – Mr. Fitzgerald is a retired Vietnam Veteran and mechanic. In 1966, he was drafted into the U.S. Army and served with the 227th Aviation Battalion, 1st Air Cavalry in Vietnam. In 1967, he served as Platoon Sergeant for the Signal Corps at Fort Knox, Kentucky and in 1968 was honorably discharged. From 1965 to 2002, Mr. Fitzgerald worked at E.I. DuPont where he worked as a Service Operator and then Mechanic. From 2000 to 2002, he served as President of SNEC, an independent worker’s union. Mr. Fitzgerald attended Wicomico High School and graduated in 1964. He is a member of Grace United Methodist Church, the Veterans of Foreign Wars Post 194, the Moose Lodge 654 and the Optimist Club of Salisbury. He is a resident of Salisbury. Mr. Fitzgerald coaches girls’ varsity softball and is a member of the Wicomico County Softball Federation.

Larry W. Dodd – Lieutenant Dodd is a Firefighter and Paramedic at the City of Salisbury Fire Department where he has worked since 1994. Lieutenant Dodd is also an MFRI EMT Instructor and Fire Instructor at the University of Maryland. From 2002 to 2006, he served as a member of the Wicomico County Council and from 2001 to 2005, he served as President of the MIEMSS Region IV E.M.S. Council. Mr. Dodd received his Bachelor of Science in Biological Sciences at Salisbury State University in 2000 and his Masters of Science in Applied Health Physiology from Salisbury University in 2004. He attended the University of Maryland Institute for Governmental Services Academy of Excellence from 2001 to 2005. He has two children attending Wicomico County public schools and is a member of the Beaver Run School PTA. He is a resident of Salisbury.

TROOPERS, ALLIED POLICE SEARCHING FOR JUVENILE ESCAPEE

(White Marsh, MD) The Maryland State Police and allied law enforcement are searching for a juvenile who escaped from custody.

The escapee is identified as Jordan Stephan Dupont, 17, who was being held at the Chesapeake Treatment Center, located on the grounds of the Charles H. Hickey School in Parkville, Maryland. He is an African American male, 5’11” and weighs approximately 197 pounds.

Dupont was last seen running towards I-95 last night in the White Marsh area. He was wearing a white Polo tee shirt and blue jeans. Police believe he could possibly be headed towards the Eastern Shore.

Maryland State Police were contacted at 9:30 p.m. last night by staff members of the Chesapeake Treatment Center who reported Dupont had escaped from custody. Baltimore County Police were also notified and an immediate search of the area was conducted. Maryland State Police K-9 Unit also assisted. The search for the juvenile escapee is ongoing.

Anyone who may have seen Dupont is urged to contact the Maryland State Police at Golden Ring Barrack at 410-780-2700.

Questions about the circumstances of the escape should be directed to the Maryland Department of Juvenile Services.

The Beverly Hillbillies Of Delmar: Just after Noon today the Delaware State Police called the Delmar Police Department in for assistance searching for a young man who reportedly threatened his own life as well as others.

When they arrived at the first residence they came to learn it was the wrong address, so the search went on. It didn't take long for law enforcement to find the proper residence but their suspect was nowhere to be found.

After some discussion with other family members they came to learn their suspect fled on foot and within no time one Delmar Police Officer found their suspect hiding in the woods. The Delmar Police used their K-9 to help apprehend the suspect.

Guns were drawn as it was reported that their suspect was armed, this may not be the case though. We're awaiting a formal Press Release to get access to all the details and as soon as it comes in we'll update this Post.

Jury was only out for 35 minutes before returning Guilty verdicts on First Degree Premeditated Murder, First Degree Felony Murder, Armed Carjacking, Carjacking, Armed Robbery, Robbery, First Degree Assault and Grand Theft. Because Alvira was not death penalty eligible due to his age, Brittany Barkley was not death penalty eligible.

The States Attorney's Office will seek Life Without Parole and a consecutive 30 year sentence which is the maximum she can receive. Judge D. William Simpson ordered a Pre-Sentence Investigation at the request of the Defense Attorney. Sentencing will occur within the next 45-60 days.

GOVERNOR O’MALLEY TO KICK OFF MARYLAND GREEN REGISTRY

Jury Is Back in Anitra Pirkle Case

The jury was out for 35 minutes deliberating the fate of Brittany Barkley. Barkley was found guilty of murder in the first degree. The state is trying to get a life plus 30 year sentence for her part in the carjacking and cold blooded murder of Anitra Pirkle. The judge has ordered a pre sentence investigation before sentencing.

There is justice in Wicomico County.

Troopers Investigate A Series Of Burglaries

Location: 14000 block and15000 block of Cokesbury Road, 18000 block of Seashore Highway, 14000 block of Hastings Farm Road, and 12000 block of Old Furnace Road

Date of Occurrence: During the night between Saturday September 26th and early Sunday September 27th, 2009

Suspect(s): Two white males- first described as tall, thin, clean shaven, and in his early twenties. The second suspect was described as being shorter, heavier, in his early twenties, and unshaven.

Resume: On the early morning hours of Sunday September 27th, 2009, Troopers responded to several reported burglaries and other related crimes that occurred during the night. The reported burglaries include two local Georgetown churches.

The suspects broke into the Cokesbury Church on Cokesbury Road during the night. The suspects stole three guitars, knocked over electronic equipment, poured cleaning equipment all over items inside the church, and the church was left in disarray.

Troopers also handed a burglary complaint at the Hebron M.P. Church on Seashore Highway. The church is no longer an active church. The suspects entered the church and caused damage to a wooden cabinet and a bible, however nothing was taken from the church.

While investigating the burglary at the Hebron M.P Church, troopers discovered a kiosk located on the church property was also broken into during the night. The kiosk, owned by Georgetown Kawanis, listed several sodas as being stolen from the refrigerator.

Troopers also responded to a couple of other complaints in the area, which appear to be related to the church burglaries. The break-ins were all within a ten mile area.

Trooper responded to the 14000 block of Cokesbury Road at approximately 4:10 a.m. for a report of an assault. A 17 year old male victim was assaulted by unknown suspects, while he was asleep in a vehicle parked on his property. The victim received minor injuries, but did not need medical attention.

Prior to the assault, the suspects had removed several tools from a shed on the property and took a motorcycle. The victim later located the motorcycle. He also found an ATV that he recognized as belonging to a neighbor.

Police then responded to the neighbor’s house on the 14000 block of Hastings Farm Road to take a report on the stolen ATV and process the scene for evidence. The ATV was recovered and returned to the owner.

Later in the morning, troopers responded to the 12000 block of Old Furnace Road for another burglary complaint. The victim reported his chicken house, which has been converted to into storage space, was broken into during the night. Several doors were pried open and items from inside were taken.

The victim also reported a vehicle on the property was entered and a purse from the vehicle was removed. The suspects also attempted to break into the vehicle via the sunroof, causing damage to the vehicle.

Investigators believe all of the above crimes are related. Detectives were following up on several leads on Monday, but have been unable to positively identify the suspects. State Police Detectives are asking for the public’s help in identifying the suspects.

On September 25, 2009 at approximately 1:25 pm, Officers of the Salisbury Police were on routine patrol in the area of Rt. 13 and Wilson St. and stopped a vehicle operated by the below listed suspect for traffic violations. The officers attempted to calm the suspect, to end the altercation, with negative results. A number of attempts to calm the suspect were unsuccessful and the suspect was ultimately arrested.

TEEN DRIVER FOUND DEAD IN CRASH

(Towson, MD) – Maryland State Police are continuing their investigation into a single vehicle crash claiming the life of a teenager today.

The deceased is identified as Kwest T. Logan, 17, of the 200-block of Lord Byron Lane in Cockeysville, Maryland. At this time, police believe he was the only one in the vehicle at the time of the crash.

Around 10:00 a.m. this morning, troopers from the Golden Ring Barracks responded to a report of a possible vehicle buried in the woods off of the I-83 South exit ramp, which merges onto the outer loop of the beltway. The phone call came from a motorist in slow moving traffic, when he noticed light reflecting off of what appeared to be the chrome bumper of a car.

The preliminary investigation indicates Logan was driving a 1997 black Nissan Maxima on southbound
I-83 when he took the exit for I-695 West and left the roadway. Investigators believe the vehicle drove deep into the woods and hit a tree where it came to rest, about 75 feet off the roadway, causing the black car to be virtually invisible from the road. It is believed that Logan was not wearing his seatbelt at the time of the crash.

At about 9:00 p.m. on Sunday, September 27, 2009, Logan and the vehicle he was driving were reported as missing. The Baltimore County Police Department received the phone call from his mother.

The cause of death is under investigation and has not yet been determined. The body will be transported to the Office of the State’s Medical Examiner in Baltimore for an autopsy.

The left lane of the exit ramp merging from I-83 South onto I-695 West was closed at approximately 10:45 a.m. and will remain closed until approximately 1:45 p.m. today. Personnel from the Maryland State Police CRASH Team, State Highway Administration, Baltimore County Police Department and Texas Station #17 of the Baltimore County Fire Department responded to assist with the incident.

It has now been 12 months since gun owners in Australia were forced by new law to surrender 640,381 personal firearms to be destroyed by their own Government, a program costing Australia taxpayers more than $500 million dollars. The first year results are now in:

While figures over the previous 25 years showed a steady decrease in armed robbery with firearms, this has changed drastically upward in the past 12 months, since criminals now are guaranteed that their prey is unarmed.

There has also been a dramatic increase in break-ins and assaults of the ELDERLY. Australian politicians are at a loss to explain how public safety has decreased, after such monumental effort, and expense was expended in successfully ridding Australian society of guns. The Australian experience and the other historical facts above prove it.

You won't see this data on the US evening news, or hear politicians disseminating this information.

18 REASONS WHY YOU SHOULD NOT VACCINATE YOUR CHILDREN AGAINST THE FLU

This year it is more important that you protect your children and loved ones from the flu vaccines than influenza itself. Here are the reasons:

1. This flu is simply another flu. It is not unusually deadly. In fact, the H1N1 swine flu in circulation is less deadly than many other influenza outbreaks. The first 1000 confirmed swine flu cases in Japan and China produced zero deaths. The Centers for Disease Control alleges 36,000 Americans succumb to the flu each year, but so far, since March through August of 2009 (6 months), the swine flu has been attributed to ~500-600 deaths in the US. The swine flu of 2009 has already swept through the Southern Hemisphere’s flu season without alarm. Only exaggerated reports have been issued by the World Health Organization regarding hospitalizations required during the flu season in South American countries. Getting exposed to influenza and developing natural antibodies confers resistance for future flu outbreaks. Artificially boosting antibodies by exposure to flu viruses in vaccines is more problematic than natural exposure. Americans have been exposed to the H1N1 swine flu throughout the summer of 2009 with far fewer deaths and hospitalizations than commonly attributed to the seasonal flu.

2. Health authorities tacitly admit prior flu vaccination programs were of worthless value. This is the first time both season and pandemic flu vaccines will be administered. Both seasonal flu and swine flu vaccines will require two inoculations. This is because single inoculations have failed to produce sufficient antibodies. This is an admission that prior flu vaccines were virtually useless. The same people who brought you the ineffective vaccines in past years are bringing you this year’s new vaccines. Can you trust them this time?

3. In addition to failure to produce sufficient antibodies, this swine flu vaccine is brought to you by the same people who haven’t been able to adequately produce a seasonal flu vaccine that matches the flu strain in circulation. In recent years flu vaccination has been totally worthless because the strains of the flu in circulation did not match the strain of the virus in the vaccines.

4. The vaccines will be produced by no less than four different manufacturers, possibly with different additives (called adjuvants) and manufacturing methods. The two flu inoculations may be derived from a multi-dose vial and in a crisis, and in short supply, it will be diluted to provide more doses and then adjuvants must be added to trigger a stronger immune response. Adjuvants are added to vaccines to boost production of antibodies but may trigger autoimmune reactions. Some adjuvants are mercury (thimerosal), aluminum and squalene. Would you permit your children to be injected with lead? Lead is very harmful to the brain. Then why would you sign a consent form for your kids to be injected with mercury, which is even more brain-toxic than lead? Injecting mercury may fry the brains of American kids.

49 Of 50 States Never Saw Certification Of Eligibility?

Researcher: Democrats dodge Constitution, even in primaries

A commentator at Canada Free Press who earlier exposed the Democratic National Committee used two separate forms to affirm Barack Obama's constitutional eligibility to be president has heard back from readers and research – and now reports Democrats failed to certify their candidate's eligibility in 49 of the 50 states.

The writer, JB Williams, further reports that in most cases, certification of eligibility was also missing from DNC filings during the primaries.

"In most states," Williams writes, "it appears that the DNC never certified constitutional eligibility for Barack Hussein Obama, despite their many claims of proper vetting and certification, all of which we now know to be false."

As WND reported, Williams released copies of two documents apparently prepared by Democrats to certify Barack Obama as their nominee for president, one that contains language affirming his constitutional eligibility and filed in Hawaii (where state law requires the specific language) and another omitting the language and filed in the remaining 49 states.

The first includes a verification that Obama and Joe Biden, then-candidate for vice president, "are legally qualified to serve under the provisions of the United States Constitution."

Elderly Moving Against Obamacare

America's elderly are finally realizing that President Barack Obama's healthcare changes are largely financed by cuts in Medicare and are rallying against his proposals in increasing numbers.


The latest poll by Scott Rasmussen not only shows national opposition to Obamacare rising — now it is 41 percent to 56 percent against — but also shows the elderly moving against it even more strongly by 33-59 or almost 2-1.


And well they should. Three-quarters of Obamacare is to be financed by slashing $500 billion from Medicare over the next 10 years. That comes to an 8 percent cut. Next year's total Medicare spending, for example, will be about $500 billion by itself, so this is like having one year without Medicare at all. Obama's fatuous claim that the cut will not affect care for the elderly is specious as any thinking person would realize. We have gone through previous incarnations of those who wanted to slash Medicare and pretended that it would not affect the elderly. Newt Gingrich tried to sell this act of alchemy in 1995. The elderly didn't buy it then and aren't buying it now.


It is obviously impossible to cut Medicare reimbursement without slashing the time doctors spend with patients. It is equally obvious that you cannot cover 30 million new patients without more doctors and nurses. And the Medicare cuts in doctors' fees will, of course, cause a decrease in the number of medical professionals. Investor’s Business Daily conducted a poll of doctors in September that showed that 45 percent of them said they would seriously consider retiring or closing their practices if the Obama bill passes.

Obama's Top Aide Gaspard Tied To ACORN

Patrick Gaspard, considered one of the most powerful figures in the Obama White House, is a "longtime ACORN operative" and former union official, according to a report posted Monday on the American Spectator's online blog.

Gaspard's name recently surfaced as the official President Obama dispatched to urge beleaguered New York Gov. David Paterson not to run for another term. Paterson insists he'll continue to run for governor even without Obama's support.

Gaspard has extensive ties to organized labor and community-organizing groups. One measure of his influence in the White House: He holds the same "political affairs director" title that belonged to Karl Rove during the Bush administration.

The Spectator's Matthew Vadum, a senior editor at the Capital Research Center think tank, reported that Gaspard was the New York political director for top ACORN official Bertha Lewis before 2003. Lewis is the CEO and "chief organizer" for ACORN, which is the subject of more than a dozen investigations for vote-registration fraud nationwide.

The House and Senate recently moved to cut off ACORN funding after a series of videos revealed the willingness of its staff to help establish a reputed child-prostitution ring based in San Salvador. Obama refused to support ending federal funding for ACORN, however, telling ABC: "It's not something I'm paying a lot of attention to."

Use Of Federal Health Clinics Soars

LEESBURG, Va. -- Federally funded health centers, originally created to serve the poor, are seeing a surge of patients as more Americans struggle financially.
The centers are on track to handle more than 20 million patients this year, up by more than two million from last year and twice the figure of a decade ago, according to surveys by the National Association of Community Health Centers.
"They're seeing lines out the door," said the association's research director, Michelle Proser.

On a recent afternoon at the Loudoun County Community Health Center here, patients came in at a rate of one every two minutes. Operating chief Stephanie Kenyon said the waiting list has jumped to 500 from 20 in a few months. Some of the new patients are college-educated and, until recently, held jobs that put them in the middle class.

Former President George W. Bush doubled financing for the centers, bringing their number to 1,200 nationwide. President Barack Obama included $2 billion for them in his stimulus package, and a House bill would add $38 billion over a decade. That could double again the number of patients treated.

The centers are addressing in a smaller way two issues that also underlie Mr. Obama's health-care proposals: lack of access to care and high costs. The uninsured often need pay only $20 or so for an appointment with a center doctor. The no-frills centers receive block federal grants for much of their funds and pay medical staff a fixed salary, so they have little incentive to jack up costs with unnecessary care.
Still, they're no panacea. Many centers have long waiting lists, and they offer only basic services. Uninsured people who need heart surgery or an MRI still must rely on charity care from a hospital, their own savings or other means. Any attempt to provide more comprehensive care at centers would require significant federal money at a time of concern over spiraling budget deficits.

Loudoun County, in the more distant Washington suburbs, was once the richest county in the nation, but the housing bust hit it hard.

O'Delia Mandrell, 57 years old, said she got "pretty desperate" last year and went to the center for the first time. The former Navy reservist won't receive full health benefits until she turns 60, and said she had to quit working other jobs because of a virus that has weakened her body. Doctors think it may be Lyme disease.
"They haven't charged me a dime and really work with me 100%," she said.

"There is a different group of folks coming in now who might not have come in in the past," said Dan Hawkins, policy director at the national health-center association.
Community health centers charge patients on a sliding scale, usually starting at about $20 a visit and going up to several hundred dollars for the more affluent. Occasionally, those without money can get care for free.

The average cost to the center is about $145 a visit, according to national data from the Health Resources and Services Administration, which oversees community health centers. That's a lot less than it costs hospitals when the uninsured use emergency rooms for treatment of everyday ailments that aren't emergencies.

A new report by researchers at George Washington University estimated that additional funding for centers in the House bill would save the health-care system $212 billion to $251 billion over the next decade, in part by reducing the number of visits to hospitals and more highly paid private doctors.

Kratovil Takes Constituents’ Healthcare Reform Concerns To House Leadership

Leads Freshman Colleagues on Letter to Leadership highlighting the need for inter-State competition, tort reform, and deficit neutrality.

Washington, DC – In a letter sent to House Leadership earlier today, Congressman Frank Kratovil and a group of his fellow freshman Members of Congress urged their party’s Congressional leaders to consider adopting a number of proposals raised by their constituents regarding healthcare reform. The letter, which grew out of the thousands of conversations each of the freshman members have had with constituents during and since the August recess, urges House Leadership to address concerns about deficit neutrality, interstate competition, tort reform, and small business protections.

“The goal of any health care reform must be to protect and expand patient choice, rein in skyrocketing costs for consumers and businesses, and break down the barriers that prevent millions of Americans from accessing coverage,” said Rep. Kratovil. “In a debate this important, it is critical that we listen to our constituents. The proposals we conveyed in this letter would improve this legislation for all Americans.”

In July, Rep. Kratovil publicly called on his party’s leaders to delay a vote on health care reform legislation until after the August district work period, arguing that Members of Congress needed more time to listen to their constituents’ thoughts and concerns about healthcare reform. During the work period, Kratovil hosted a dozen public meetings across the district, spoke with thousands of constituents on three Telephone Town Hall forums, and visited with numerous providers and stakeholders to seek broad input and feedback. After returning to Washington, Kratovil compared notes with a number of his freshman colleagues, who had heard many similar ideas and concerns during their own town hall meetings.

“When we first came to Congress, our senior colleagues would joke that freshman are supposed to be seen rather than heard. But on an issue as important as healthcare reform, we all feel a responsibility to make sure that House Leadership hears what our constituents are thinking,” said Rep. Kratovil. “We cannot afford to let obstructionists derail this debate, but nor should we be afraid to acknowledge that many of the concerns being raised are real and legitimate. Personally, I think our leaders ought to take this opportunity to step back, acknowledge and address these concerns, and show the American people that their voices are being heard.”

The letter, signed by Kratovil and 9 Freshman Democratic colleagues, supports proposals to:

Protect Medicare and extend the solvency of the Medicare Trust Fund, including closure of the Medicare Part D prescription drug “doughnut hole” and empowering Medicare to negotiate cheaper drug prices;
Guarantee 100% deficit neutrality, stating that “any health care reform legislation that increases our national deficit or debt is a non-starter for us.” Specifically, the letter notes the need to “bend the cost curve” in the long run;
Increase competition across state lines as a key component of reducing costs, “allowing all businesses and individuals the opportunity to purchase insurance from entities beyond their state lines;”
Address tort costs by reducing litigation, medical error, and overutilization, proposing real reforms such as “Certificate of Merit” provisions and “Early Offer” programs;
Allow every American the opportunity to choose the same quality healthcare that Members of Congress enjoy;
Incentivize wellness and preventive care and encourage personal responsibility for living healthier lifestyles; and
Protect small businesses and allow them to calculate for themselves how health care reform would impact their bottom line.

“The message I have heard from my constituents is clear: we need reform, but we need to take the time to get it right. This letter outlines common sense reforms that will cut costs, increase competition, and protect seniors,” said Rep. Kratovil. “Anything short of this isn’t real reform.”

Dear Nichole,

I am married with a son of 5 ½ years old. I know how blessed we were to be able to bring him into our lives when we did. For you to post something like this to the owner of a nationally known blog is unbelievable. All this while you are running for public office? Are you serious? I’ve handled many campaigns for politicians (I own a printing and mailing company in Berlin, MD) as well as ran for public office myself. I have to say that if you are trying to lose the race before it has begun, I believe you have reached your goal.

This is a family that is going through some very, very rough times. I know what that is like because my family, unfortunately, has been through many. To claim that you were in a room full of people that felt the same way as you? You’ve got some kind of friends. These statements are so mean spirited it makes me wonder just what kind of a person you and your husband are.

To delay the inevitable is just cruel? I’m sorry Nichole but I must have missed your great speech. I also missed where you turned water into wine. I’m assuming that perhaps you also possess the ability to part seas and walk on water. Just because you feel “spending hundreds of thousands of dollars on a person who will die at some point just seems out of line” means that we should not try to help this little girl? I didn’t know you knew that was her ultimate fate. If you ever gave money to this cause, I’m sure we can get that back to you immediately.

Narrative: On 25 September 2009 at 9:23 PM, deputies from the Wicomico County Sheriff’s Office responded to a reported hit and run accident. Upon their arrival, they located a subject who had been rear ended on Jersey Road in the area of Bailey Lane. The operator of the vehicle that had been rear ended told the deputies that the vehicle that struck her left the scene and travelled east on Bailey Lane. As the deputies investigated further, they discovered that the same vehicle ran over a mailbox and crashed into a fence on Hearne lane near Thomas Lane where the vehicle became disabled. Upon reaching the vehicle, they located the operator, Patrick Land, sitting on the ground nearby. After contacting Land, the deputies detected that Land appeared extremely intoxicated. Land was positively identified by witnesses as the individual driving the vehicle at the time of the collisions.

Land resisted arrest by struggling against the deputies. Upon being handcuffed, Land continued to try and kick the deputies.

Land was transported to the Central Booking Unit where he was processed and taken in front of the District Court Commissioner. After an initial appearance, Land was detained by the Commissioner in the Detention Center in lieu of $5,000.00 bond.

Suspect: Female Juvenile, 17, Salisbury, MD

Narrative: On 27 September 2009 at 12:14 PM, a deputy from the Wicomico County Sheriff’s Office responded to investigate an altercation occurring at a residence in the 200 block of Harford Road. Upon arrival, the deputy discovered that two residents, a mom and daughter, became involved in a physical altercation. During investigation, the deputy learned that the mother took a cell phone away from her daughter when the daughter became mad and began assaulting her mother.

The deputy charged the juvenile on a juvenile referral that will be sent to the Department of Juvenile Services. The juvenile remained with her parents pending formal court action by the Department of Juvenile Services.

Suspect: Male Juvenile, 17, Hebron, MD

Narrative: On 27 September 2009 at 6:07 PM, a deputy from the Wicomico County Sheriff’s Office investigated the intentional damaging of a vehicle in the parking lot of the Hebron ball park on West Church Street. While investigating the incident, the deputy learned a 17 YOA juvenile became mad at another subject on the property of the park and began punching that subject’s vehicle causing it to become dented.

The deputy located the juvenile responsible for the damage at his residence and completed a juvenile referral for Malicious Destruction of Property. The referral will be sent to the Department of Juvenile Services. The juvenile was released to a parent pending formal court action.

GOVERNOR MARTIN O’MALLEY TO JOIN NFL NETWORK, VERIZON AND BALTIMORE RAVENS TO LAUNCH 2009 KEEP GYM IN SCHOOL PROGRAM

ANNAPOLIS, MD – Governor Martin O’Malley will team up with NFL Network, Verizon FiOS TV, and players from the Baltimore Ravens to launch the 2009 Keep Gym in School Program at Corkran Middle School in Glen Burnie.

After a school-wide pep rally led by NFL Network Analyst Jamie Dukes celebrating the refurbished Physical Education facilities funded by a $50,000 Keep Gym in School grant, Baltimore Ravens Brendon Ayanbadejo and Matt Birk will lead students through fitness tests and football-inspired drills during an on-field minicamp. Corkran Middle School is one of four middle schools nationwide receiving a Keep Gym in School PE revamp this year, and one of approximately 150 schools that will benefit from the NFL Network’s Keep Gym in School Fitness Program.

Health Officials Confirm Season Flu Has Arrived in Maryland

GLEN BURNIE, MD – As state health officials confirm that the seasonal flu has arrived in Maryland, Governor Martin O'Malley joined and about 200 state employees at the Motor Vehicle Administration headquarters in Glen Burnie this morning to get vaccinated for seasonal flu. The seasonal flu vaccine that is available now will protect people from the seasonal flu strain that has been detected by Maryland's Public Health Laboratories.

“In big ways and in small ways, this is a patriotic duty, and we especially want to encourage Marylanders who haven't gotten a flu shot before, to get vaccinated for the first time,” said Governor Martin O'Malley. “Each of us, by working in our own lives to take care of our own health and the health of our families, can help prevent and contain potential outbreaks while lowering health care costs and strengthening our communities and our workforce.”

State employees by the thousands have been lining up to get their seasonal flu shots at locations across Maryland. Marylanders are encouraged to speak with their health care providers about getting their seasonal flu shot. They may also check with their local health departments for times and locations of local vaccination clinics or, seek a vaccination at one of hundreds of local retail outlets across the state. Information on how to get a seasonal flu shot is available at www.flu.maryland.gov.

“Vaccination is the best protection against the flu,” said John M. Colmers, Secretary, Maryland Department of Health and Mental Hygiene (DHMH). “When you get vaccinated you not only protect yourself, your family and your co-workers or classmates from the flu, you also protect the health care system from a preventable overload of patients, helping our health care providers care for others who need it.”

The seasonal flu vaccine does not protect people from the H1N1 (Swine) Flu. They are different strains of the flu and require different vaccinations to be protected from both. Symptoms of influenza include fever, cough, and sore throat. Additional symptoms may include chills, headache, fatigue, vomiting, diarrhea or shortness of breath. Based on CDC figures, it is estimated that 1,000 Marylanders die every year from seasonal flu or its complications. Complications and death are more common among those with serious underlying health conditions.
