Jury in EEOC Suit Says Dollar General Must Pay Former Employee Over $277,565 For Disability Discrimination

KNOXVILLE, Tenn. - A federal jury has found in favor of the U.S. Equal Employment Opportunity Commission (EEOC) in a federal disability discrimination lawsuit against the retail giant Dollar General, the federal agency announced today. EEOC had charged Dollar General with firing a cashier at its Maryville, Tenn., store because of her need to treat her diabetes.

According to EEOC's suit, the cashier, an insulin-dependent diabetic, told her supervisor she was a diabetic and requested on several occasions that her supervisor allow her to keep juice near the register to prevent a hypoglycemic attack. At trial, the cashier testified that her supervisor told her that Dollar General did not allow employees to keep food or drink near the register. Although Dollar General had an accommodation policy that could have allowed the cashier to keep juice near the register, the employees, including management at the Maryville store, did not know about the policy.

While alone in the store one day, the cashier drank orange juice prior to purchase, in violation of Dollar General's "grazing" policy, in response to symptoms of a hypoglycemic attack and to protect the store. As soon as the medical emergency passed, the cashier paid for the bottle of orange juice that cost $1.69 plus tax. Later, the district manager and loss prevention manager appeared in the store to address inventory shrinkage and fired the cashier after she admitted to drinking orange juice prior to purchase. The store fired the emp­loyee even though it knew she drank the orange juice because of her diabetes and that she had requested to keep juice near the register.

EEOC filed suit (Civil Action No.3:14-CV-441) in U.S. District Court for the Eastern District of Tennessee) against Dolgencorp, LLC, dba Dollar General Corporation, on Sept. 23, 2014, after first attempting to reach a pre-litigation settlement through its conciliation process. The discrimination victim joined the suit as a plaintiff in her own personal lawsuit on Dec. 18, 2014.

The jury returned a verdict on Friday afternoon for EEOC and the victim, awarding the former cashier $27,565 in back pay and $250,000 in compensatory damages.

JUST IN: Suspect arrested in Cascade Mall shooting; attack may have been random

BURLINGTON, Wash. -- A 20-year-old Oak Harbor, Wash., man was arrested Saturday in the shooting at a Burlington mall that left five people dead.

The man was arrested in Oak Harbor before 7 p.m. Saturday, about 24 hours after the shooting at Cascade Mall that left four females and one male dead.

A highly-placed source tells KING 5 News that there is no apparent connection between the suspect and the victims, leading to the possibility this was a random attack.

As America awaits to see if Charlotte will burn for the third consecutive night, Paul Joseph Watson points out something troubling: thugs burned down a city because a black cop shot someone, yet meanwhile the mainstream media spun it, or at least tried, as as "peaceful protest." There is just one problem: violent criminals looting, attacking bystanders, attacking journalists, setting fires, smashing up cars, smashing up businesses and shooting at each other is not the a "peaceful protest."

And with all of these activities having been documented in the clip below, it is worth pointing out that:
Stealing and looting cash registers from local businesses is not a legitimate form of protest
A “protester” shooting another “protester” is not a legitimate form of protest.
Physically attacking reporters is not a legitimate form of protest.
Throwing rocks off bridges at passing vehicles full of families is not a legitimate form of protest
Beating up innocent people in parking lots because they’re white is not a legitimate form of protest.
Smashing up apartment windows where black people live to “protest” in favor of ‘Black Lives Matter’ is not a legitimate form of protest.
Trashing your own neighborhood is not a legitimate form of protest.
Looting the Charlotte Hornets team store so you can steal basketball merchandise is not a legitimate form of protest
Attempting to hijack cars and terrify their innocent occupants is not a legitimate form of protest.

What was unfolding in Charlotte - and may still be - is not a protest. It’s a violent, unjustified riot by criminals and thugs. The question is why is the media giving it legitimacy by still referring to it as a protest?

As Watson points out, if mobs of white supremacists were looting stores, setting fires, attacking journalists and shooting guns, would the media call it a protest?

What is most disturbing is that behind the pent up rage and thuggish violence, dressed up in the socially-acceptable package of "black lives matter" is the reality that white violence is the last thing blacks should be "protesting."

Four Powerboats Added To Cruisin Parade

OCEAN CITY — The grand spectacle of offshore powerboat racing returns to Ocean City in early October and this time race enthusiasts will have the opportunity to view the powerful boats up close and personal with a handful participating in the annual Endless Summer Cruisin’ parade on the Boardwalk.

Offshore powerboat racing has been a staple of the resort’s shoulder seasons off and on for the last decade or so with the Offshore Powerboat Racing Association (OPA) making stops in the resort as part of its summer-long racing series. Because of the timing of the summer season in Ocean City and the need to close off a vast area of ocean to accommodate the racing, the OPA typically puts its Ocean City stop near the end of its schedule and this year is no different.

Over the weekend of Oct. 7-9, the OPA will host its penultimate event of the summer series with the Ocean City Grand Prix in advance of the world championships in Florida a week later. Event headquarters are located in West Ocean City in and around the public boat ramp at the harbor with public viewings, meet and greets with the racers and the associated events at the race village. However, as an added twist this year, as many as four offshore powerboats will be added to the parade on Saturday, Oct. 8, on the Boardwalk as part of the Endless Summer Cruisin’ event, which takes place the same weekend

Entry Deadline Announced For Berlin’s Annual Christmas Parade

BERLIN — Berlin’s 46th Annual Christmas Parade will be held Thursday, Dec. 1, at 7 p.m. The parade rain date is Dec. 8. The parade officially kicks off numerous Christmas events scheduled for December in Berlin. This year’s parade theme is “Christmas Dreams”.

The parade is sponsored by the Berlin Main Street program, in cooperation with the merchants of the town. All costs of conducting the parade are covered by donations from Berlin area merchants and entry fees. Due to the increased costs, most categories will be asked to pay a small entry fee of $10. Commercial entries will cost $25.

Due to time constraints, this year’s parade will be limited to 80 entries. Entries are reminded that the parade route will be the same as last year. To alleviate congestion during the line-up of the entries, there will be two entry points. Entrants will be contacted the week of the parade with a line-up number and entry points. Berlin town staff and volunteers will be located along the route and specific spots to direct entries to their line-up number. The parade will commence at the corner of Powellton Avenue and Main Street and conclude at the corner of South Main Street and Tripoli Street.

Haitian immigrants cross border through Mexico, claim asylum for quick processing and entry

Haitian immigrants are surging across America’s southwest border, blazing a path through Mexico to the U.S., where they have been coached to claim asylum, earning them quick processing and almost immediate entry into the country.

Analysts called it a backdoor amnesty that’s increasingly being abused by illegal immigrants who normally would have no shot of staying in the U.S., but who, by claiming asylum, can gain a foothold here. The Haitians are the latest to discover the route, likely encouraged by smugglers who stand to make thousands of dollars from each migrant they transport through Mexico and up to the U.S. land border.

A video obtained by Rep. Duncan Hunter, California Republican, which originated with U.S. Customs and Border Protection, shows Haitians massing outside of a Mexican detention facility on that country’s border with Guatemala, ahead of what analysts said was likely a long journey north to the U.S.

“It’s a method for backdoor entry that presents a real exposure, because it’s virtually open to anyone to enter the U.S. without any real scrutiny or undergoing the regular process,” said Joe Kasper, chief of staff to Mr. Hunter. “The fact that 300 Haitians show up in Mexico and from that point are virtually guaranteed entry into the U.S. underscores one of many major problems with the president’s immigration policy — and Americans need to recognize it.”

OC’s Newest Beach Play Structure Needs Exterior Repair

OCEAN CITY — Months after it was added as a new play structure on the beach at Somerset Street, Wally the Whale apparently is already in need of a facelift.

Last January, the Mayor and Council approved Wally the Whale as the newest addition to the downtown beach at Somerset Street adjacent to the Boardwalk area. The play structure includes a whale’s head emerging from the sand on one end and its tail protruding from the beach at the other end. It includes barnacle-like fixtures on the head and tail, allowing kids and presumably adults, to climb on the structure.

The newest addition to the beach toy collection on the beach in the downtown area was installed this spring, but after a full summer under its belt, it already needs some rehabilitation. During his report on the Recreation and Parks Committee meeting last week, Councilman Dennis Dare told the Mayor and Council on Monday the whale structure was due for a renovation after just a few months in the often harsh beach conditions.

Legal Rebellion in Michigan Over Refugees Could Help Trump Win State

Oakland County Executive L. Brooks Patterson intends to file an injunction calling for a temporary ban on the resettlement of all refugees in his Michigan county.

Patterson broke the news on the Frank Beckmann Show, on WJR radio in Detroit.

“I’ve brought in my legal team from the county, and we’re about to sue them [the federal government] to get an injunction to stop them from relocating more people into this community until the rules are adhered to,” Patterson told Beckmann.

“The federal law could not be more specific,” Patterson continued.

“It wasn’t you [the federal government] may want to inform local county officials” about resettling refugees in their jurisdiction, the county executive added. “It says you shall inform the local county officials.” (emphasis added)

Maryland Well-Represented In New African American Museum

WASHINGTON (AP) — Although the Smithsonian’s new National Museum of African American History and Culture opens Saturday in the heart of Washington, its neighboring state of Maryland has a strong presence.

From a freed slave house in Montgomery County to photographs of Baltimore’s unrest after Freddie Gray’s death, Maryland’s black experience throughout history is broadly represented. According to the museum’s online collection, Maryland was in the top 15 states with the most artifacts.

Artifacts from Maryland on display include an early 1800s stone slave auction block from Hagerstown, a paper cutter from the Baltimore Afro-American newspaper and a copy of the book “This Child’s Gonna Live” by Maryland-born Sarah E. Wright, who portrayed the lives of a black family set by the state’s Eastern Shore.

Paul Gardullo, a curator at the museum, said it’s crucial to reflect the “deeply important” history of Maryland to African-American life.

King's appeal to female voters comes as Trump seeks to close the gap among this voter bloc, which has largely flocked to Democratic presidential nominee Hillary Clinton.

Liberal College Administration Shuts Down “America” Themed BBQ

Students at Ramapo College were going to have an American themed BBQ co-sponsored by College Republicans and the College Democrats, but were forced to change the theme because the administration deemed it too “offensive.”

According to emails obtained by Campus Reform, Ariana Rivera, the Assistant Residence Director of Bischoff Hall sent an email to the two student groups, inviting them to set up tables at the BBQ Bischoff and Mackin Halls to promote their organizations as well as encourage students to register to vote.

On September 14, two days before the scheduled event, Rivera wrote to President Taylor Gilson of the College Republicans telling her that Bischoff Hall would no longer be co-sponsoring with the CRs because the American theme was “considered offensive.”

Gilson responded to the email asking why the American theme was considered offensive, and if the “offensive” concerns came from students or the administration.

WASHINGTON (CNN Newsource) — Angry at the way her custom-made cake turned out, a Michigan woman drop-kicked the cake across a grocery store, CNN reports.

Witnesses say that while sending the dessert airborne, the woman also dropped some less-than favorable language before storming out of the Kroger store.

Tricia Kortes faced a judge on Thursday, who sentenced her to 300 hours of community service, in addition to paying a $500 fine.

CNN says that the incident took place back in June when Kortes wasn’t satisfied with her son’s birthday cake.

In Dramatic Twist, Wells Fargo Said To Retaliate, Fire Whistleblowers Who Exposed Bank's Illegal Practices

While the recent congressional hearing targeting John Stumpf, in which Elizabeth Warren suggested he should resign and be criminally charged, was nothing more than a "kangaroo court" meant to refocus public anger on banks, with good reason, the reason why we concluded that nothing would actually change is that ultimately there was no evidence the bank's executive management was aware of the bank's illegal, fraudulent tactics involving the creation of some 2 million fake customer accounts to "sandbag" retail banking fees. That assumption, however, may need revision now that CNN reportsthat it has heard from former Wells Fargo workers - some of whom were named - around the country, who tried to put a stop to the bank's illegal tactics only to be met with harsh, prompt and severe retaliation by the bank.

"Almost half a dozen workers who spoke with us say they paid dearly for trying to do the right thing: they were fired", CNN says, which if confirmed would promptly make this a criminal case, which implicate virtually every senior management member, as such retaliatory practices would suggest not only awareness of what was happening at the bank, but also an even more dramatic response by management seeking to keep these practices under wraps.

Some of the named witnesses made it very clear that the narrative spun by Stumpf in Senate was a lie:

"I endured harsh bullying ... defamation of character, and eventually being pinned for something I didn't do," said Heather Brock, who was fired earlier this month as a senior business banker at a Wells Fargo branch in Round Rock, Texas.

"They ruined my life," Bill Bado, a former Wells Fargo banker in Pennsylvania, told CNNMoney.

Bado not only refused orders to open phony bank and credit accounts. The New Jersey man called an ethics hotline and sent an email to human resources in September 2013, flagging unethical sales activities he was being instructed to do. Eight days after that email, a copy of which CNNMoney obtained, Bado was terminated. The stated reason? Tardiness.
