Del. Rick Impallaria (R-7), the deputy minority whip for this past session of the Maryland General Assembly, will spend only two days in Worcester County jail for DWI instead of the 60 he would have been sentenced to by Circuit Court Judge Thomas Groton because of the actions of the OCPD officer on the night of his arrest.
Assistant State’s Attorney Billy McDermott said under normal circumstances, the sentencing recommendation for a defendant in Impallaria’s position would be ten days, but because of the circumstances, he would be amenable to any amount exceeding that.
Groton, at first, appeared to agree with McDermott by offering a sentence of 60 days in jail, followed by 18 months of supervised probation, a $500 fine and court costs.
The hefty sentence is based on Impallaria’s previous driving record, which includes 52 traffic citations, plus a previous accident that resulted in a fatality though no criminal liability was assigned, and a conviction for assault for attempting to use his car to strike other people, including his own mother and brother.

That guy is a real piece of crap.
I know Judge Groton, and I have served on a jury in his courtroom on a drunken driving case. His sentencing was immediate, and severe, after the jury found the defendant guilty of drunken driving. The defendant's previous drunken driving conviction TEN YEARS PRIOR, was enough for Judge Groton to sentence the defendant to 6 months in jail, to start immediately. He is a no nonsense, no patience, Judge when it comes to drunken drivers in his courtroom.....unless you are a politician, apparently.

There's more than a few bars - especially one in particular in West Ocean City, where the police "lie in wait" for people that have been drinking to get into their cars.
If this is a defense to get a much shortened term, then the people convicted at that bar (and many others) got shafted by their legal representatives.
This is the type of crap that gives citizens a reason to distrust Lawmakers and judges. If I had 52 traffic violations my license would be permanently taken and a Legislator is allowed to continue to operate a motor vehicle. Then a Judge allows him to keep his license and get a slap on the hand. This is corruption at it's best.

There's only 2 ways out, Sunset or Golf Course Rd. Read the Worcester DWI report, those 2 locations are 80% of the arrests.
I guess you could sneak out thru the park and ride but that's chancey as well.
Man oh man, is this odoriferous or what. This actor has no business driving to even get bread and milk. And the good judge placing the burden on the working officers of OCPD. Thank you Pfc. Nathan Kutz for doing the job you are swore to uphold. Keep your head high because there will be more to come in the future. You unfortunately came on tour when there is a war on cops. Bet the politician and judge can't hold their head up. Probably having a double.

This is news? The entire state of Maryland is corrupt to its very core, and the Eastern Shore is the standard that they gauge it by. Doesn't matter what part of state government you're talking about. Planning and Zoning, Building, Coastal Bays, Public Service Comission, the Courts, etc. "Justice", and "Equality" are radically different depending on who you ARE and who you KNOW. This state is total hypocrisy in practice.
Same morals and ethics as DC.
Totally shameful this man is even in The Maryland General assembly at all. The rule is no open alcohol containers in Maryland vehicles and no drinking and driving. The Deputy Minority Whip should be brought up on ethics charges by the Maryland assembly. The judge should be shamed by his peers and disbarred. He also should apologize publicly to PFC Kutz. Guess money talks and political clut talks doesn't it... not a big surprise.

Here's what I do not understand:
I have an absolutely perfect driving record.
Six months ago I received two tickets - both were "paperwork" tickets involving the registration of my truck, that occurred due to a glitch in filling out the forms correctly.
As a result, my insurance increased $90.00 a month - $45 for each - for the next two years. (Yes, I shopped around - to no avail - to find a company that wouldn't penalize me for the innocuous tickets.)
How in the hell does this guy pay insurance premiums???
And this guy had some SERIOUS tickets!!
How do POS like this for one, stay in office, dodge the justice system, and go on in life like nothing happened???? This dude is a fu*%ing loser period.....

OCPD set him up based upon an old open (maybe empty) beer can. He is also a republican. OC is the center of corruption for personal gain. Nothing else needs to be said.

OCPD set him up? Did they put a beer can in the car? That would be setting him up. I don't have a beer can in my car and probably spilled more down my chin than you ever drank. The turd is the blame here and nobody else. Look at his past, not a very considerate person. Do you and your family ride the road while he is out there. You would be better off staying home to do your drinking. Think about it, it has effected your mindset.
Everyone appears to be surprised that this happens ALL THE TIME. Well it does all the time every time things work this way all over it's not what you know it's who. We have all done it at one,point and time in our lives it's a shame that this happens in government but it's also shameful that we don't practice what we bitch about.

The judge is a political appointee. He has to play politics. It's how he got to where he is. It's how all judges got to where they are.
This is why common people do NOT trust the system! If he was a typical Joe Blow he would never drive again! Oh well nothing ever changes!!
I sent a formal complaint to the ethics committee I got a letter saying they were going to do nothing.
