Cop cleared in Eric Garner chokehold death

A Staten Island grand jury cleared an NYPD cop Wednesday in the chokehold death of Eric Garner during his caught-on-video arrest for peddling loose cigarettes, The Post has learned. The panel voted a “no-bill” and dismissed all potential charges against Officer Daniel Pantaleo, sources said.

Another situation when simply complying would've worked.

So now cops have the legal cover to kill you for failing to pay cigarette taxes.

Anonymous said...

3:34 that would possibly be true, if choke holds were legal in NY, but they are not.

Garner was killed by an illegal technique only for selling loose cigarettes

Medical examiner ruled it a homicide.

Blue covers blue.

4:17 just so you know anytime a human kills another human it is a homicide regardless of situation. That is the definition of homicide. Look it up!

Never mind. I see your point..

He was never in a choke hold. And we don't get to pick the laws we want to obey and police don't get to choose laws they will enforce. If you want to blame then blame the greedy NYC government for taxing smokes all the way up to 14 dollars a pack and then creating a law where it's illegal to sell one out of your pack.

To elaborate on the definition of homicide, not all homicides are crimes. Example being a state that has the death penalty. When you are executed, the death certificate manner of death will be homicide.

Homicide is a one of the manners of death, others being natural, accidental, suicide and sometimes it's necessary to class a death as unknown.
When the ME determines homicide was the manner, then they have to come up with a cause, gun shot, stabbing, etc.
From there the states attorney's office takes over and will decide if the homicide was illegal and what degree of murder applies. Some homicides like justifiable self defense aren't illegal.

Go watch the video and tell me that man deserved to die. There's absolutely no defense for ending that man's life.
#ComplyOrDie is the new mantra for "law enforcement." Which in itself is a joke as there has been a complete disparity in who said law applies to. Wake up people before it's too late.

I am proud of these jurors. This could quite possibly a case of nullification.
In a civil society we can not let criminals of any kind get away with resisting arrest. If LE has to use what some consider excessive force then so be it. Should have complied-Period-End Of Story.
If we start limiting the force that can be used to arrest someone, every criminal under the sun would resist arrest.
What were the cops supposed to do, let him go?
Yeah it was cigarettes but then what happens when someone who just killed someone resists? Supposed to let them go?
It's time for some ground rules to be set, with criminals.
Crime has sky rocketed especially within the black communities since Obama took office. Where as before these neighborhoods were cesspools they are now war zones. Blacks esp are thinking they are invincible because of Obama and it's time to take the country back and it seems these jurors who were both black and white think so to.

What compels you to take a page out of Sharpton or the naacp's playbook? Or are you related to Michael Brown or something?
If we are going to tell a story, then let's tell it accurately or don't tell it at all.
He died after a series of events which included his choice to resist arrest so either tell it the way it is or don't tell it.
I'm sick of those like you who haven't an drop of honesty flowing in their blood and will stoop so low and lie, just so it fits their agenda.

5:13 I did watch the video.
The question to be asked is why he resisted arrest? What did he think, laws don't apply to him?
He's dead because of his own actions-No More No Less. Police can not be letting everyone go who resists and if they have to use excessive force than it's not their fault. It's the person's fault who for whatever dumb reason didn't comply.

I guess if the law doesn't apply to this man than the RULES don't apply to police right? I agree with the outcome of Ferguson. I DO NOT agree with this one. The police use an illegal choke hold and the man died. The cop is just as guilty for using it as the man was for resisting.

There is nothing legal or illegal about "choke holds" when it comes to LE. It's either department policy or it's not. Get off the illegal nonsense.

Anonymous said...

No such thing as an "illegal choke hold." It's either something that is a department's policy or it isn't. I don't know where it's coming from but it's totally inaccurate.

5:13 he wasn't complying, period! Sometimes when you don't comply it end well sometimes you get seriously hurt or die. SIMPLE AS THAT!

I think the jurors came to their decision because first off there was no chokehold. Chokehold is where the cop from behind takes someone by the neck with his arm. The bend (elbow) of the cops arm would be around the front of someone. The hand of other arm would be used to hold the back of the person's head.
Google would have pics is anyone is interested in learning what a chokehold actually is instead of shooting from the hip.
The cops used a take down technique which if you do watch the video you will see.
Med examiner also ruled that preexisting conditions also contributed to his death. In other words, a healthy person without these specific preexisting conditions most likely would have survived.

I think the decision was reached because grand jury thought the cops actions weren't the cause of the man's death, but were only associated with his death. His death being caused by his asthma and the asthma attack was brought on by cop's actions. DA in NY has applied to have the court release the transcripts so we will know more about the testimony and evidence then.

20 years ago a NYPD officer was sentenced to 7 and 1/2 years for the Baez choking death.Baez had thrown either a football or a basketball that hit the patrol car.Since then the NYPD officers have only had vacation days taken away from them for choking incidents.

Since when based on our constitution, you know the foundation of this country, do you have to comply to whatever a police officer says, lawful or unlawful? The problem is the militarization and federalization of our police. Mraps, humvees, sound cannons a la Faluja, NSA spying via Threat Fusion Centers down to the local level. Our constitution is being raped peeps.

If somebody suffers from medical.conditions why would they insist on tangling with anybody, much less the police? That's just asking for trouble.

10:04 I guess if you wanna play street lawyer you're rolling the dice.

You're both shortsighted lemmings. A completely illegal chokehold--as per 1993 ruling in NYC--used to kill a guy over a cigarette. Unauthorized. Unnecessary. Illegal. Don't worry, you'll figure it out when the police state directly affects you in a effed up way. Just hope that someone speaks up for you when you're put down like cattle over something extremely trivial. Wake up, police apologists.

some idiot on here just wasted everyone's time by saying it is not technically a choke hold because bend of elbow....hand not soemwhere....blah blah blah?!

So I guess Eric was NOT choked to death? He really could breathe? NY officials were lying or mistaken when they themselves said it was a banned chokehold applied by this kop?

Gee, I'm SO glad we have people like that to correct the ones who REALLY know what they are talking about.
