- On 06/27/2014, at approximately 8:02 pm, Worcester County Sheriff's Office Deputies stopped a vehicle in the area of Golf Course Road and Sunset Avenue, Ocean City, Maryland after observing the operator utilizing a telephone while the vehicle was in motion. Deputies identified the operator as Peter J. Monti, W/M, age 27, of Florida and noted him to be extremely nervous. Deputies detected the odor of suspected marijuana emanating from the passenger compartment of the vehicle. During a search of the vehicle a loaded .380 Colt semi automatic handgun, hashish oil, and drug paraphernalia were located. The handgun was reported stolen in Florida.
Mr. Monti was charged with possession of the stolen handgun. Mr. Monti was also charged with two counts of marijuana less than 10 grams, and three counts of drug paraphernalia. Mr. Monti was later released on his personal recognizance pending his court appearance.

This is typical of Maryland's judicial system and in particular the lower shore court commissioners
It's based on facts of arrest in case. Most likely it was unlawful search and district court commissioner knew that.

Some cases make no sense like this one but the contractor who defrauded a homeowner of 1500.00 gets 10 years?

1)a stolen handgun from out-of-state,
2)hash oil (concentrated marijuana),
3)weed,
4)drug paraphernalia,
and is talking on his cellphone while driving.
Walks away, with court case pending. Good luck on ever seeing his hairy self again in O.C. or in Worcester County court.
He will go to jail for 1 year for being on cell phone.
All other charges will be dropped!

10:12 A.M. Of course I was being sarcastic. Seems to me caught with a stolen handgun or other firearm anywhere, and particularly in MD, should mean instant incarceration. I believe it is true that many gun laws throughout the country are not prosecuted to the extent they should be. Most of the people who did the recent mass killings broke at least one existing gun law before they did their terrible deeds.
