If the homeowner was telling the truth then they should have made good faith payments into an escrow account until the matter was resolved.Sounds like they just don't want to pay!
If what the contractor said was true, he should have taken the matter to the courts. Now he will be in criminal court as a defendant instead of small claims court as a plaintiff.

who cares? buy something and don't pay for it, i guess then you should keep it?
He broke into a house and stole a furnace. Now he is the criminal. I'm sure he felt he was right but what he did was illegal.
As a contractor I have wanted to do just that on a couple occasions. But try that here in Maryland and you will end up in Jail!
