Three Officers Cite "Defect" In Prosecution As Grounds For Dismissal

Three of the four remaining officers who face trial in the death of Freddie Gray are asking for their case to be dismissed arguing a "defect in the institution of prosecution."

In motions posted on the Court's website, Lt. Brian Rice, Officer Garrett Miller and Sgt. Alicia White, are all seeking the dismissal.

The request is based on what attorneys say are "defects" raised at the District Court and Circuit Court levels.
 

Attorneys for all three officers cite an affidavit unsealed last week by Baltimore City Sheriff's Major Sam Cogen, who, along with State's Attorney Marilyn Mosby, was also sued for wrongful arrest by the three officers.

All of the cases should be dismissed. Then the officers should sue the city. Their lives have been ruined by poor decisions made by city officials. Will they be compensated for their lost wages?

The "defect" is in Marilyn Mosby's brain.

12:21 PM, you are correct therefore, all 3 of these people cases should be dismissed and Mosby should be fired and lose her license to practice law, any kind of law.

Detective Dawnyell Taylor has also said that when the members of the grand jury began to ask her questions about the case, prosecutors intervened and answered. So you had prosecutors acting as sworn witnesses in a grand jury proceeding. Mosby who has a propensity for lying, showing off and playing to the camera needs to close down this disaster and resign. A states attorney needs to be ethical and not someone who is a pathological liar and so perpetually angry that her jaw is permanently clenched in an under bite. She's a stain on the justice system.

And Stephanie Hyphen-Hyphen should have to pay back to the City of Baltimore the more than $6 million dollars she wrongfully gave to Freddie Gray's "family".

Why would someone like Mosby be made a prosecutor in the first place?

Mosby was not "made" the States Attorney. The voters of Baltimore elected her. That says a lot about the intelligence of the average Baltimore resident. BTW, as an elected official she can not be fired. Impeached or indicted, maybe, but not fired.

5:27 She can be "fired." There's been a complaint filed w/the MD Bar Association. If she is found in violation she will have to either resign or she will be "fired" because election qualifications are she has to be a member of the MD Bar. The MD Attorney can also "fire" a SA and/or suspend their pay.

So egregious has been Mosby’s conduct that even the editorial board of the Baltimore Sun a hotbed of Social Justice Warriors disguised as journalists and certainly no bastion of conservatism by any stretch of the imagination, has called for Mosby to cease her prosecutions of the remaining officers.

David A. Plymyer, a former assistant state’s attorney for Anne Arundel County, is calling in the Baltimore Sun for an investigation of Mosby’s office, stating:

"The disturbing revelation by The Sun this weekend that Baltimore State’s Attorney Marilyn Mosby or one of her prosecutors may have used a misleading summary of evidence to persuade a grand jury to indict the six Baltimore police officers charged in the death of Freddie Gray demands a formal investigation."

Mosby is a POS and so is Mary Ashanti from the local NAACP. Ashanti couldn't wait to ram her head up the rectum of this farce by saying on FB how proud she was of Mosby when the charges were announced. If Ashanti had any morals and decency about her she would be on the BPD FOP page saying how sorry she was that BLACK Officer Caesar Goodson had to spend a year of what amounted to hell on earth waiting for a judge to declare him NOT Guilty of ALL charges. People like Mosby and Ashanti will get theirs. God hates their ugliness. God sees right through their fake Christian nonsense and will see to it that they spend their eternities in hell. When they take their last breaths they will find themselves propelled through the gates of hell right into the fires burning for eternity.

I imagine her legal career is over but she'll end up with a job at the NAACP or another one of the race baiting organizations. That's where the filth always ends up.
