So around here, when you have 5 or more seated together and when the bill comes, they automatically added 15%, is that legal? Just because 5 people were sat together?
The new clarity follows a lawsuit filed against famous NY-based chef Mario Batali who was sued by waitstaff at his restaurants for allegedly withholding tips made on credit cards.

If you have a problem tipping 15% for a party of five you don't have enough money to eat out and should just stay home.
sure they can add an auto 15%, and thats what they will get. i typicall tip more then that, but if they want to legislate it makes it easier for me

Yes it is legal.
What is illegal is when they charge the tip but don't give it to the wait staff.
