On December 18, 2009, at about 0811 hrs., a Worcester County Sheriff’s Office Deputy stopped a vehicle on Rt. 113 in Newark for 69 M.P.H. in a posted 55 M.P.H. zone. The driver was identified as Cody H. Phillips 18 years of age from Berlin Md. Mr. Phillips had a loaded 30-30 rifle partially concealed between the driver’s seat and the driver’s door nest to his left arm. Mr. Phillips was arrested and charged with possession of a concealed deadly weapon. Mr. Phillips was seen by the commissioner and released on his own recognizance.

As a LEO I have potential problem with this, how can something be "partially concealed" either it is or it isn't. and this IS the Eastern Shore and I believe deer season ended the 19th for rifle. IF he has a prior felony conviction that's one thing but I would hate to see a clean record ruined for this. was he spotlighting or shooting from the veh?
As a LEO, your "potential problem" you should see with this is that is was concealed between the door and the driver's seat. WHY, would he have it concealed in such a manner. "Partially" or not, it should not of been there. Oh and btw, deer season ended on the 18th. That rifle should have been in the trunk not sitting next to him in the passenger compartment.

why was he going 69 in a 55 mph zone??
If it were unloaded and lying in plain sight would it have been a problem? I'm just wondering because I've heard in MD it's fine to have an unloaded rifle or shotgun in your vehicle if it's in plain sight.
You can carry a loaded long gun as long as it is not concealed. if they are loaded and "displayed" in the back window of a truck in redneck fashion I do not believe there is any charge. Just as there is no charge for carrying a loaded long gun openly down the street without any intent to do harm to another. I don't write the laws, i just read them. I feel law abiding citizens should be armed, maybe we would have less crime!
3:55 he was arrested on the 18th, so it still would have been deer season. still not the best judgement but had it been next to his right side openly, there wouldn't have been a problem. I hate to speculate but he was probably worried about being pulled over with a gun in the veh so not thinking he probably put it on his left side, albeit not the best judgement.

To answer the question about having loaded weapons in a vehicle...... try again, aint legal in MD (last 25 words or so):
Natural Resources Article 10-410 (c) (1) A person may not shoot at any species of wildlife from an automobile or other vehicle or, except as provided in § 4-203(b) of the Criminal Law Article and Title 5, Subtitle 3 of the Public Safety Article, possess in or on an automobile or other vehicle a loaded handgun or shotgun, or a rifle containing any ammunition in the magazine or chamber.
