HUSBAND DEAD WIFE IN HOSPITAL AFTER OVERNIGHT SHOOTING IN DORCHESTER CO.

(RHODESDALE, MD) -- A man is dead and his wife is in the hospital after an apparent violent domestic situation ended in a homicide overnight in Dorchester County.

The deceased is identified as Eugene W. Tolley, 59, of the 5700-block of Galestown Reliance Rd., Rhodesdale, Md. He was pronounced dead at the scene.

The injured person is identified as Nancy J. Tolley, 57, the deceased’s wife, of the same address. She is undergoing treatment at Dorchester General Hospital for an injury to her head and other complications.

No charges have been filed at this time. The Dorchester County state’s attorney has been briefed on the preliminary investigation and is expected to present evidence in this case to a Grand Jury for consideration of charges.

Just before 3:00 a.m. today, Maryland State Police at the Easton Barrack received a 911 call from a female at the victim’s address reporting a shooting. The caller identified herself as the victim’s wife.

Arriving troopers found a man, later identified as Eugene Tolley, lying in the driveway. He appeared to have sustained at least one gunshot wound. A handgun was found on the ground not far from the body. EMS personnel responded and pronounced the victim deceased.

Maryland State Police Homicide Unit investigators responded to conduct the investigation. They were assisted by personnel from the State Police Criminal Enforcement Division, the Crime Scene Unit and Easton Barrack personnel.

The preliminary investigation indicates the victim and his wife became involved in a domestic argument early this morning in the garage of their home. Investigators developed information indicating the victim may have been assaulting his wife, which included inflicting the injury to her head. While he was continuing to threaten her, preliminary evidence indicates Mrs. Tolley retrieved a gun from the house and shot her husband as he approached her.

Investigators are looking into a history of domestic violence involving the victim. Further information is being obtained from scene evidence and ongoing interviews.

I feel for this woman. She is going to prison. There is no self-defense law in Maryland. I know it will have to be decided still by the D.A office and consideration is placed. But law is law.

in maryland the Accused must have had reasonable grounds to believe themselves in apparent imminent danger or death or seriously bodily harm from his assailant..... If they charge her, all the woman in the State of Maryland should be outraged!!!! So true 5:20 pm!!!

Sometimes it's best to keep your mouth shut and be thought a fool than to open your mouth and remove all doubt. There absolutely IS self defense in Maryland. In fact I don't know any state in the union where your prohibited from defending yourself. AND, we don't have a DA or District Attorney. We have States Attorney's. Sounds cut and dry to me. Self defense. Watch and see.

Wrong. Ask any cop. If a guy robs you at gun point and you retaliate by shooting him your getting some type of charge. Again Maryland does give some room for women in certain cases.I forgot to say states attorney. Your right , another state money generator.

There you go again. You said "you retaliate" . Retaliation isn't self defense.... It's punishment. If you genuinely feel your life is in danger or there is a threat of serious bodily injury, you have a God given right to defend yourself by using deadly force- regardless of your sex.

So sad a friend of mine has to go in such an unjust way i know all yall outsiders listen to the story and think damn she was in fear of hear life and she had to protect or defend herself is what you dont know is that there garage thats in question is roughly about 75yds from the door and you mean to tell me that she couldnt find any sacutary in the whole house after she ran 75yds now into and retrieved this firearm and where was the firearm right at the front door because it seems to me

This sh*t is Horrible im so sorry to see my friend gunned down like an animal in his driveway my heart goes out to the Tolley boys and the Tolley family yall Dad was a good man he helped alot of people and he will be greatly missed.... Now people commenting about eugene tolley didnt know the man he loved his wife i never heard him say bad word about her at all as for him being a wifebeater i believe that is completly false but i dont know what happen out there early Easter morning but what I do know is the layout of the property and where the garage is thats in question is roughly 75yds from the side door of the house which they use. So you mean to tell me that his wife ran skipped whatever into the house and retrieved this firearm which by the way where was this firearm located was it by the door or did she have to go further into the house to get it. I cant let this man go out like that I Luv Yu Gene imma miss yu Bro as far as self defense go if this true what happened to her im sorry for her but because i slap kick and punch a person that does not give permission for that person to execute another if yu have all the seperation from a person to run inside retrieve a gun and still manage to shoot your husband before he gets up the driveway into the house that you ran into and thats where he got killed at in the Driveway where she left dropped the gun after she had been in the house all according tu her the only Witness. So sad to see homie go out like that.

Retaliate doesn't necessarily mean at a later date or time.. What do you have to pull your weapon at the same time as the perp? God forbid its two seconds later or after a shots fired. I was charged and found guilty for shooting a guy that was robbing me at gun point. I was told by the judge I should've let him do his thing then call police. Quit filling the heads of our fine citizens with new ways to screw themselves. Folks believe what you want. If you shoot somebody that's robbing you you will be charged.

The situation is unfortunate. I have known the family my whole life. I have seen gene beat his first wife and I know that he did the same to Nancy. He had an alcohol and drug problem which made it worse. I hope that she is treated fairly and what people don't realize is that she will live with this guilt forever. The entire family has issues with drugs and violence and alcohol.

Sorry to say this but glad he won't live another day to beat a woman! Glad she finally had enough good for her. There are just some evil bastards in this world. Also if she gets charged I hope it goes national because that would simply be an injustice to all women in this country. Praying she will recover soon!
