MPIA REQUEST RESPONSE UPDATE

Salisbury is demanding $75/hour and over $500 total for copies of their speed camera calibration certificates and a few of their daily setup logs.

Their contractor, Brekford, just got nailed for using expired calibrations in Hagerstown and Greenbelt.

Furthermore, they have conceeded that they do not keep these documents 'on file' as state law requires.

Why not just post this information online for all to see since the mayor claims to be so transparent?? Seems this could end a lot of controversy or maybe the city/mayor does have something to hide concerning this matter. This would be a simple solution for all since it's considered to be public information.

I hope they need to refund all the fines as these were NOT FOR SAFETY ,THEY JUST NEED MORE OF OUR MONEY WITH OUT CALLING IT A TAX , maybe they could make it a toll road instead

4:37....THEY work for US? Do you really think that concept has EVER occurred to them? And I suppose they also think they can pick and choose which laws they will abide by. Which, again, shall remind all of you that the laws are made for the serfs and peasants, not them. Laws which will be strictly enforced against YOU, but waived for the ruling elite. Keep cheering, which is akin to a woman yelling encouragement to her rapist.

The speed camera lobby is huge. They sell these cameras to municipalizes and counties with the catch phrase of it being "free money" and the stooges making the decision to implement them fall for it hook line and sinker because they are too stupid to look at the big picture. The department within the state has a "program" that "oversees" these cameras and has a budget of like 50 million and approx. 50 state employees, so any money is not free at all. In the end the only entity making any money are the speed camera vendors and to a lessor degree those people who were hired by the state.

I travel the same road several times daily. Never in my life have I ever gotten a speeding ticket, because I truly don't speed. Got TWO IN ONE DAY. Appealed via letter, asked if cameras were not operating properly that day, etc. Got a NASTY phone call from Sheriff's Dept. - tough luck for me. $80 down the drain for something I DID NOT DO. Give up, folks, you can't win. The county and city just want our $$$.

The short answer is that the cities of Greenbelt and Hagerstown use the same contractor, and both of them had to issue refunds when it was found that Brekford had used cameras with expired calibrations. Salisbury's cameras have been in use longer than either city, and the contractor's delay makes it seem likely that there is s similar issue there.

State law requires calibration records to be "kept on file". And the MPIA requires that "a custodian shall permit a person or governmental unit to inspect any public record at any reasonable time.” and forbids using excessive fees to either generate profit from requests or to obstruct a request. So why is the city's for-profit contractor allowed to decide who has access to which records and at what cost, and only after a 50 day delay when state law requires documents to be released within 30?
Brekford's bottom line is on the line if the records reveal a problem with the calibrations.

8:00....thx for the legal update...I hope it helps someone. But I must repeat --- the law is NOT made for them. Only for you and I. From the president down to the local county council member and city cop --- they are essentially immune from the law. The pride of our country - "rule of law" -- has been corrupted so badly and perverted so completely that you and I go to PRISON for what the makers and enforcers do on a daily basis. And they often get rich doing it. Keep cheering.
