DON'T BE SO QUICK TO PASS JUDGMENT ON RUARK

While every source of media is all over the recent arrest of former States Attorney Davis Ruark, I wouldn't be so quick to pass judgment.

As each and every one of you know there are two sides to every story, some say three sides. His, hers and the truth.

Consider the fact that this man spent more than 20 years prosecuting people for these very same reasons. Unless Davis Ruark is completely out of his mind, believe me, there's another side to this story.

When all of this came up months ago, I chose to sit back and wait it out. Today, the information delivered to Salisbury News forced us to publish the information. Have I heard both sides, yes. However, NOT from the horses mouth and this left me to wait until the Peace Order went to Court.

"This wreaks of vindictiveness" said Ruark in an interview moments ago. Before you pass judgment, let the system do its thing and allow a Judge to hear both sides and pass judgment. Some of the comments coming in are just unbelievable. Like him or not, Davis Ruark served this County well for many years.

That being said, we have a new States Attorney who is very insecure, young and out to make a MARK. Unfortunately, news like this will probably go national and we could be seeing a one term position for Maciarello.

Joe, this is your opinion. Some of us knew Dallas, Davis' father. He was an honorable man. Davis was not. In my opinion and in many voters' eyes, Davis was not the man or prosecutor you thought he was. Just another opinion. Hope he gets the same treatment he gave to others.

His liberalism is why he is not in office anymore....Clearly from his past actions, maybe he has a drinking problem, which effects many people differently..The Police don't arrest you for their health. They must have had some pretty good reason to arrest Mr. Davis. Why does Matt Maccerelli's name have to get in the middle of Ruark's problems? I don't see how he fits into the picture. Whether he serves one term or ten, I don't think his re-election will revolve around Davis Ruark's issues.

Joe, don't get caught in the middle of this. Davis needs HELP. He is a friend of mine as I hope I am a friend of yours but please don't hang out on this one. Davis needs to get professional help and until he does he will continue to spiral down. This is so, so sad.

Maciarello already let me down by firing people and hiring that fool who lost his own election but the biggest lie ever was taking Leggs to court seeking death.

His arrest had nothing to due with the States Attorney's office. Get Davis the help he needs.

Lay off Matt for now..I want to give him two years, then pass judgement.
As for Davis, the truth will come out. I know that Davis is no saint, but neither is he the devil being portrayed. I am proud to count Davis among the many people that has helped me over the years. Mr. Ruark more than likely does not remember me or the circumstances that brought us together.

get over the Legg's case. It's done with. Matt is doing a great job. He's clean cut, family man, and does not have the baggage Ruark did and does

Joe wants to fan the flames again and get in the middle. Matt wouldn't have had him arrested without just cause

what goes around comes around. how many people were found guilty by mr. Ruark these past 20 yrs were victims of vindictiveness.

Matt hired Joel Todd... that has to say something about his lack of judgement...
Look, Davis was known as a friend to law enforcement and that's good enough for me. He also was in the process of filing a case to make the protective order go away. He was doing things the right way. None of us knows what happened the last 24 hours so, before ya rush to judgement. let this play out.
Anyone can fake a case to get a protective order against anyone... Davis did a lot of good things for the citizens of Wicomico County over the years... it's a shame so many are ready to throw him under the bus.

7:00 p.m. so are so right...I wouldn't wish this on anyone, but Davis Ruark, you finally got what was coming to you...And how doe Mr. Maccerelli come into this picture??? Could it be becuase he's doing his job???? Mr. Albero, you do not want to fuel to the fire on this one...

I had the pleasure of working for Davis when I served on a jury panel or two and then on a grand jury. With the grand jury experience, which lasted a good many days, I had the opportunity to see him in action. He was well prepared every day; as the saying goes, he always had "his ducks in a row." Working with him was a positive experience, not the negative one that so many people think serving on a jury will be.

Certainly, I regret his personal problems. I do hope that he can turn those around, as he has so much to offer as a lawyer.

As for Matt, "insecure" is not a word I would use for him. I have gotten to know him personally and have heard him speak numerous times; I am quite impressed with him.

They are right, Joe...you chose the wrong horse. So did Matt the knife. He fired some of the best people to keep Ruark for one case (ignoring voters, decisions to toss him out) and bring in crony Joel Todd.....who has done nothing but complain about his terrible workload here. Ruark favored certain young women in his staff at the expense of those who cared most about justice and our county. Matt was only too happy to accept this scoundrel's counsel and advice. And now we can all see it for what it was. Or, we can stay in denial like you Joe.

You people need to remove your blinders. This stuff does not discriminate and is not subject to professional and financial status. Those are only the ones who can hide it better.

Craig, I am a friend of yours but you had better back on this one. You are McDermott's mouth piece and he doesn't need this crap on his resume. Davis has big problems and today's arrest is nothing compared to what his problems are. You need to back off and allow it to happen. I am sick at what is happening but it appears that bottom will be the only thing that might help and I'm unsure that will make a difference either.

anonymous 8:52, PLEASE do tell me you and I aren't FRIENDS. You see, I tend to be a true BROTHER to my Friends. The "horse" I chose, (while it may not be as POPULAR) at this time, it's a horse I know will NOT kick me when I'm down.

You know nothing about Friendship and Brotherhood. That goes for Lewis and Maciarello too. You see, they ONLY want the horse that wins every race. They live very sad lives. Trust me on this one, I know many people who USED to be their friends.

anonymous 8:56, that's right Craig, do like this commenter says and kick them when they're down.

MM's office's decision to prosecute Mrs Baker's family for the lessor neglect charges and not the abuse charges is sickening. The poor woman was found weighing 60 lbs with sores all over her body. If this wasn't abuse then what is?
Oh and BTW Todd was the prosecutor.

i don't know either party in this case personally however, mr. ruark is a lawyer and has been for a long time so in my opinion, unless he is suffering from mental distress of some sort, he would know exactly what he could and couldn't do with regards to a protective order, making it highly unlikely that he would be so stupid and to continually harrass someone if he wanted this to go away. i'll just wait until he has his day in court and let the judge hear the facts and rule before i declare that i know what happened and so should everyone else, unless they have first hand knowledge that the rest of us aren't privy to.

For those of you choosing to send lengthy comments you know I won't publish, try sending it to my personal e-mail instead of hoping we'll slip with your supposed words of wisdom. In the mean time, thanks for the laugh.

Somethings not right here. A criminal summons seems in order, Not hand cuffs. This seems more vendictive.
Now, Im not a Ruark Supporter. When I was a CO at WCDC, he pleaded out an inmate to 10 mnth for splitting my head open. Putting the rest of the charges on a stet docet, and when he committed again didn't, he chose not to open the stet So, no one can say I'm bias.
This looks to political. I have never seen a man, with no criminal record, actually arrested for a first attempt on such a trivial charge.

Thank you Joe for blocking Idiots that don't like him Personally. Rememder, He Was Ellected and was Unellected. He should be treated just like everyone else, Why wasn't He?

No criminal record Tow Sawyer. Have you forgot about the DUI while packing a loaded weapon? Many folks are in jail today for that offense.

The Baker case was dropped by the previous administration and was reviewed by the new admin and the case was tried and won. The SBY police chose to arrest Mr. Ruark for violating the protective based on a complaint from the other party. The states atty office does not file charges against anyone, they issue warrents and prosecute based on what the police bring them.

Even if an alcoholic is "dry" it can take years for the brain to re-wire itself from the decades it spent soaked in alcohol. That's why even "reformed" drunks can still make very bad and impulsive decisions. Consequently Davis has a problem reading other people, taking "no" for an answer, or being told to back off.

There's too much local baggage and drama here for him. To be successful Davis needs to move out of the area and start over again with a fresh slate somewhere else.

Joe--friends or no friends, get off this horse. It's stuck in the mud and not going anywhere right now except down. Then, that's when his friends need to help him and be there for him. And, please everyone give him a break. He's lost his family, his job and his identity as a person.

Anonymous said...

brotherhood or no brotherhood. The law is the law. The 52.2% of women population in Wicomico County thanks you.

Joseph Albero said...

anonymous 7:26, you are not judge and jury. Let it takes its course and see what comes out in the end.

Anonymous said...

6:11 is correct. The thing left unsaid is that Ruark needs to realize he is in trouble. He hasn't done so and until he hits rock bottom I'm not sure he will. This is just tragic seeing a person who was so respected fall from grace in the public's eye.

I know and really like Davis, and he did a great job as our SA. But Davis needs to stay off Face Book and other places trying drum up support. He need to seek some counseling, he has hurt his wife, two sons and daughter who loved him dearly. It is time to stop being so selfish, and rememember, what we read, they read. You are not the VICTIM, they are!!!!!

What pissed me off in the whole thing is how the press was notified to take the picture.

So our City Police leaked the info to the press?

This is what is ridiculous. Our own cops can't be trusted.

Anonymous said...

As someone who does not know any of the parties personally it seems that you all are looking for someone to kick. Why cant you just let people go in peace taking care of their personal problems with a modicum of respect and privacy which is due any human being.

Anonymous said...

why does a misdemeanor arrest hit the news? because it's mr. ruark, i presume.
a serious threat to someone would be shrugged off like yesterday's news. it's a MISDEMEANOR, for God's sake! who cares?

Anonymous said...

and mr. ruark found NO ONE guilty...the courts did!

Anonymous said...

Since he's a lawyer, wouldn't he know not to email or text someone who has in place a peace order preventing any and all contact? I assume she has copies of what he sent or he wouldn't have been arrested. Of all people, he should know to let the court drop the peace order or continue it, but he should not decide to contact her, especially more than once.

Anonymous said...

To me this woman sounds like she thrives on the drama. If someone were truly that alarmed over someone calling and texting them like she claimed is the basis for the peace order why didn't she change her number? That is the first thing I would have done.
Then when I read in the paper about the coffee throwing incident which to me shows a lack of control and an attention seeking action on her part I see this whole situation as nothing more than someone who thrives on drama.

Anonymous said...

You are right, there are three sides to the story. Joe, I agree with you. I am sure there is more information out there, that no one knows. Time will tell.

You can find 60 lb people with bed sores all over them in just about any nursing home.

Many people just shove their no longer needed loved one into a home so they don't have to take care of them.

The paper said she was under weight and had sores but didn't indicate that she was rolling around in urine and fecus.

She died 3 months later in the nursing home. She may have lived longer in her own home. We'll never know now.

Anonymous said...

No you will not "find 60 lb people with bed sores ALL OVER THEM in just about ANY nursing home.", 10:25. And you will not find residents in nursing homes suffering from significant malnutrition either.
You are lying in order to protect someone for whatever reason.
The SA's office is doing exactly what may have cost Ruark the election. Dropping the more serious charges, prosecuting the less serious in order to look like your conviction rate is high.

Anyone can pickup someone else's cell phone and send a text message from that phone....also anyone can send an email to someone else using another person's email account. It makes you wonder if someone was trying to "frame" him.
