Upon approach to Sabato, the deputy observed that the engine of Sabato’s vehicle was on and Sabato was sitting behind the wheel with his seat belt on, but Sabato was slumped over in his seat.
The deputy managed to rouse Sabato and detected a strong odor of an alcoholic beverage emanating from Sabato and observed that Sabato was unsteady and had trouble maintaining his balance. Sabato stated that he had planned to catch a flight at the airport. The deputy also discovered that Sabato’s privilege to drive had been revoked by the State of Delaware due to a previous DUI.
Sabato was released pending a future court date. Sabato was unable to make his flight.
