While Flynn is among several Trump associates to have been charged with making false statements as part of the Russia probe, no one interviewed during the FBI’s Clinton email investigation was hit with false statement charges – though investigators believed some witnesses were untruthful.
According to Flynn's legal team, FBI agents in his case deliberately did not instruct Flynn that any false statements he made could constitute a crime, and decided not to "confront" him directly about anything he said that contradicted their knowledge of his wiretapped communications with former Russian ambassador Sergey Kislyak. (The FBI would not have been legally required to warn Flynn of his Miranda rights in order to use his statements against him in court, as long as the conversation was ruled voluntary, and Flynn was not effectively in custody at the time of the questioning.)

I have a really good feeling that this case will get tossed once it's in front of a judge.
Dave T: With disgraced FBI Investigator, Andrew McCabe and Peter Strzok as investigators surrounding him how is any of this legitimate? After seeing their performance as FBI agents there is no doubt who are the real criminals. These two losers, combined with James Comey have permanently marred the reputation of what once was a highly respectable organization, and they both should rightfully be prosecuted to the fullest extent of the law. Both Strzok and McCabe give new meaning to the word "disgrace."
Should be an automatic dismissal and Flynn made whole.
Hillary had something like six lawyers present for her FBI chat. Flynn should have taken the hint.
No matter if you are innocent or not, as a retired cop, never, ever talk to any law enforcement without a lawyer. You can have one anytime for free. Part of your constitutional rights.
We have to convict someone after many hours of investigations, so why not you?
