Family returns to bloodied home after dog attacks intruder

A Virginia family came home to find their floors and walls splattered with blood after their German Shepherd attacked an intruder while they were out.

At first Tristan Murrin and his mother didn't notice anything out of the ordinary when they walked into their Richmond home on Thursday night.

But when Murrin saw his beloved dog Oden waiting to greet them at the front door, he knew something was wrong.

German dog may be owned by a trump voter brutality attacked a person... Blood everywhere this is not what our nation is about... sorry folks I was working on CNN headline.

The law is clear on using a dog, especially a guard dog, to protect property (and not your lives). The couple is liable if the perp chooses to sue for his / her injuries. There are many legal precedents on this. They better hope that the perp DOESN'T get caught because his lawyer is going to go for personal injury damages. It would be different if they were home at the time of the break in, but they were not. The dog was no different than a bobby trap. You can't use "deadly force" to protect unoccupied property, no matter how you feel about the crime, or you are liable under law for the consequences. Talk to a lawyer before you consider following that homeowners advice.

Just saw the pictures. Holy Cow that dog was not fooling around. I hope that person thinks twice the next time and hopefully he doesn't return to that house to harm the dog.

11:41 No trespassing signs and beware of dog signs give adequate warning to intruders, unless the dog is a specifically trained attack dog.

What you say about suing the homeowners may be true, I think I have heard of similar cases, but doesn't that strike anyone else as outrageous? If the homeowner had been home and shot but only wounded the intruder would he be sued? I think not. So why would he be sued because the family dog did its' job and protected his home and family?

So maybe the moral of the story is to kill any intruder and avoid such ridiculous lawsuits?

That's probably what I would do. I would just need some help disposing of the body.

You always shoot to kill if you discharge a firearm. Don't move or touch the body if you are in the right. Call LEO and be unarmed when they arrive.

11:41 and what law would that be? You are off base. Newsflash there isn't a lawyer walking the face of the earth that would take a case like this because it is a lose Lose LOSE situation. It would not even see a courtroom-just the circular file. There's no basis.
The dog was confined-in a home. The intruder went willingly into that confined space. No one was there telling him the dog was harmless etc.

11:41 Where did you get your law degree? You need to immediately go and demand a refund.
No the intruder can not sue. In order to sue someone over injuries you have to prove negligence on th3e behalf of the dog's owner.
The dog was in the home. Hardly negligence on behalf of the homeowner.
Also the law is very clear on uninvited intruders (burglars.) When a burglar enters someone's home they are putting themselves at risk and willingly accepting whatever dangers could potentially happen.
But anyway I'm curious-can you cite the "many legal precedents on this"?

No basis for a lawsuit. Negligence would have to be proven AND also that the negligence was known.

Right. No way to sue. Besides negligence other elements have to be established they too can not be. When a dog even a trained guard dog attacks an intruder inside a confined area it's consider provocation: The unknown intruder invaded the dog's space provoking the dog to attack. When provocation occurs any lawsuit goes right out the window. This true too outside the home and even in public spaces.

Most if not all states have strict dog bite statutes under which the dog's owner is liable for any injuries caused by his or her pup UNLESS the person injured was either trespassing or provoking the dog.
I too am curious about the "many legal precedents on this" 11:41 is claiming.

The dog should receive a medal and the "perp" as you call him and his rights be damned. We had a German Sheppard for 11 years that protected our home and neighbors for years, they said other dogs in the neighborhood barked but when they heard our dog growl they immediately searched for the trouble. The best dogs ever. Maybe this" perp" will change his ways after this.

No need to sue, Oden was defending himself. The turd after entering illegal, would surely try to make Oden fearful by threatening him. Oden should be happy he lives in VA and not MD. Maryland would probably prosecute, convict and sentence the good pup.
Glad the dog is okay....thank you Oden.

Wait so your telling me it's the home owners fault that a stranger entered his home unlawfully and because the home owners pet attacked said stranger in HIS home when the owners weren't there that the man (criminal) who broke into the home can sue. So he simply has to say it's not a guard dog and there is no reason to have control over your pet when it's safely locked up in your home. I agree with 3:08 not if I was on the jury. I'd say the dog needs compensated for his time worked.
