JUST IN: Ocean City Council Passes Emergency Ordinance While Awaiting AG Opinion

Ocean City, Maryland – (June 10, 2017): While the Worcester County States’ Attorney waits for an opinion from the Maryland Attorney General’s Office, the Ocean City Council has passed local legislation after a woman expressed her desire to be bare-chested on Ocean City’s beach. The woman, an advocate to “normalize bare-chestedness,” believes it is her constitutional right under equal protection to be bare-chested in public.

Ocean City officials disagree. The Council met on Saturday, June 10, to pass an emergency ordinance that prohibits offenses involving public nudity or those in a state of nudity. The ordinance states “there is no constitutional right for an individual to appear in public nude or in a state of nudity. Whatever personal right one has to be nude or in a state of nudity that right becomes subject to government interest and regulation when one seeks to exercise it in public.”

Further, the ordinance reads, “equal protection clause does not demand that things that are different in fact be treated the same in law, nor that a government pretend there are no physiological differences between men and women.”

The council voted unanimously in favor of the emergency ordinance.

Big expensive court case coming. Haven't we been having this same basic argument over bathrooms and who can use which bathroom for the last year.

Bottom line(or maybe top line) in 3-4 years OC will have to designate a section of beach as topless. Maybe even have to do like they do with the surfers have a different section designated every day.

I didn't see a constitutional right debate coming to reach this decision. Look for it to be challenged, both in the court and on the beach.

OC just took a step onto a very slippery slope. This is one that their insurer, LGIT, propably won't want to touch with a ten foot pole. The cost to defend against litigation is going to be plenty. New York State did the same thing a couple of decades ago and it didn't go all that well for them.

Instead of this they should have just instructed the PD to arrest for disorderly conduct. This is what they are doing in municipalities where going topless is legal. The disorderly charge almost always stands.

Maybe if Frosh wasn't so busy worrying about what Trump may do he would worry about what is going on in his own state. He has had this case for way to long and no decision has been made. They need to fire his butt for not doing his job!

One woman. She was charged with disorderly conduct and it didn't stick so she sued for false arrest and won an insignificant amount of money-Less then $50,000.
There are many more who have tried going topless and the disorderly charge has held.

Children in a family resort town, should not have to be subjected to naked women because they wanted to be treated like men! Go to a nude beach! This everything has to be the same mentality is getting old!

One thing I have come to realize after living on the shore for almost 20 years and now living in a different state for 4 is how inept anyone on the shore is in regards to simple things....living in Florida we have many beaches were it is ok to be topless or more....not an eye is batted....and no big deal is made.....the shore I have come to realize does nothing with any scale of intelligence....look around folks....I'm not wrong.....

Another one for the Time Capsule.
This is one of those events that some years from now people will look back upon and wonder "what the hell were they thinking?"
Who remembers the law that men had to wear shirts on the boardwalk at ALL times?
You think that's ancient history?
The old-timers will remember that that law was on the books AND strictly enforced up until about 1968 or '69. Not so long ago.
I'm paraphrasing here, but the gist of it was "men had to wear a shirt while on the boardwalk, and anywhere west of the edge of the boardwalk throughout Ocean City."
There was also a law against carrying a blanket on the boardwalk around the mid-'60's.
I'll give topless for the ladies about 10 years out.
European countries have done it for decades, notably France, and in Miami, Key West, and many others.
It hasn't ended civilization at those places...

To all who are saying it's common in France or anywhere else in Europe that is not true. It is not common at all. I spent half my life there (born in France, lived in Monaco, spent many summers all over Europe)and since being in the US have made nearly 200 trips back. Very few people go topless in Europe and it is mostly Americans. Europeans look at it as uncivilized and low class.

Knee jerk is a commonality each/every year with advisement on legal issues being the same source - Guy Ayers. Maybe its past time for Guy Guy and his girth to retire! I know there's a Bunting lawyer out there who's a bit better in tune and would always spend spend spend the taxpayer's dollar - then just SETTLE!!!

You are correct. Permitted at many waterfront hotels - not the public beaches. But it has never been enforced.

Women who go topless are not doing it because they don't see the big deal, they are doing it for attention. I was raised to believe there is no such thing as a woman with too much class and nothing compares to a classy woman. If it delights a woman to turn the heads of my sons or that of my husband, go for it. But only the bottom dwellers with little to offer will value you. If your right to go nude is more important to you than a young family's comfort, that shows your integrity.

Any woman who walks around topless in public has ZERO self-respect. Something is wrong in her head. Sad.
