U.S. District Court sets date for Berlin Fire Company trial

A trial date has been set for the civil case of Zackary Tyndall versus the Berlin Fire Company, for Jan. 11-22 at U.S. District Court in Baltimore.

In July, U.S. District Court Judge Ellen Lipton Hollander denied the Fire Company’s motion for a partial summary judgment.

Tyndall, a former fire company employee, originally filed a harassment complaint in August 2013.

Lipton’s 63-page opinion said the case concerned allegations of employment discrimination and “intentional infliction of emotional distress” against two former coworkers of Tyndall, Bryon Trimble and Derrick Simpson.

According to Tyndall, he was fired from the job in retaliation for reporting certain activities at the department. Among his allegations was that the defendants created a hostile work environment that led to his severe depression.

And the same two idiots are still Berlin leaders, Trimble a Chief. Shows the stupidity of the organization. Gee Williams saw through the entire mess from day one.

They will settle, they (BFC) thought Zac would go away. The department hasn't learned one thing. Trimble and Simpson need to be sued individually, then justice would prevail.

Derrick Simpson was a paid firemen in Salisbury and his mentors were John Tull and Rick Hoppes.

Huh? Say what? Yep, it's a matter of time before this happens in the Salisbury Fire Department.

It happens daily in the work place.I am the only black where I work and I told management about the racial problem in work place.We underwent a series of workshops and they don't talk or should I say they are here and I am here,now there are no more racial jokes,nothing directed towards me.Although one co-worker did assault me I used the companys policies to handle that and not a word out of his mouth since.I give this guy credit for using his brain not his brawn.More of these situations occur people turn it over to an agency like EEOC or something,you must stop it .

Trimble has been the most miserable SOB ever since this happened, but not unlike his old man, is entirely to selfless to leave, and the Dept to weak to show him the door.

Berlin FD used to be a great organization, then they refused to change or adapt with the times. The downfall with Trimble and Simpson was just the tip of the iceburg. After the insurance company settles this suit, hopefully the Town will take over their operation and bring some credibility back, otherwise the doors should close. When the Council elected to make them accountable, it was obvious they had a lot to hide.

11:20 Who are you kidding! They have always been a back room, good ole boy, inbred bunch of hillbillies that took advantage of every dollar the Town could muster their way. Trimble and Simpson are 3rd and 4th generation worthless wannabe firefighters that couldn't make it in the real world. Pay day has come, and the public is still to blind to see the truth.
