Senate Gives Initial OK to Vehicle Smoking Ban

ANNAPOLIS, Md. - Maryland residents would not be able to smoke in a vehicle with a passenger younger than 8, under a measure that has received preliminary approval in the state Senate.

The Senate blocked two amendments Monday night that were offered by Sen. Edward Reilly, R-Anne Arundel.

Reilly tried to change the bill so a violation of the law would be a secondary, rather than a primary, offense. As a primary offense, a police officer would be able to pull someone over for the offense.

Senators also shot down an amendment that would have prevented a child from riding in a vehicle in which someone had smoked at all.

Supporters of the measure as it currently stands say it is needed to protect children from second-hand smoke.

The sad part is that we need a law to tell us not to do this... I think as parents or just as responsible adults you should be able to see how bad this is for a child. It pisses me off when i see people smoking in cars with kids, especially infants and the windows are barely cracked open. Oh and btw.. I am a smoker.

Another excuse that cops have to pull you over when you are doing nothing wrong. Oh I thought I saw a kid in here, anyway license and registration...

this is just step 1
step 2:
you have children, no smoking in your home

step 3:
you have children, no alcohol in your home

step 4: no smoking within 100 miles of a school.

step 5: no alcohol within 100 miles of a school

......

They'll pass this law and it'll be just as worthless as the seatbelt law, the child restraint law and the cell phone/texting laws.
It won't be enforced!
I see kids riding in cars all the time who are not restrained.
Which is worse? A kid not restrained or a kid in a car with an adult smoker?
I'd say the non-restrained is far more dangerous.
I'm not in favor of smoking in a car with kids but it's not the same as far as the danger.
Just another law to make the lawmakers LOOK like they're doing something!

Are the police going to get some kind of training (the kind I've never heard of....) that will allow them to differentiate between a nine year old kid and an eight year old kid? 9:44 has it right...ANOTHER excuse to pull people over for a close up & personal look and another chance to search a vehicle....in the greater sense, more "conditioning" of the citizenry to accept intrusive and unwarranted searches and surveillance. Our children are growing up thinking its perfectly OK for the government to listen to, watch, photograph, monitor, search, and seize anything they want at any time. Made possible by their heel-clicking Nazi loving PARENTS who think that they NEED someone to think for them. Massive, unconquerable debt, a totally corrupt political system, and a police state. What a great job we've done. What a legacy....

Why not just make smoking illegal? Because you can't tax something that is illegal.
