Another Judicial Roadblock to Census Citizenship Question

The legal wrangling over the citizenship question on the 2020 census took another bizarre turn Tuesday, when U.S. District Judge Jesse M. Furman ruled that the Justice Department cannot replace nine lawyers working on implementing the question so late in the game without sufficient explanation. With just three days remaining in the appeal process, Furman wrote, “Defendants provide no reasons, let alone ‘satisfactory reasons,’ for the substitution of counsel.”

Furman is the same judge who initially blocked the question itself in January, so this is no surprise.

A brief refresher is in order...

So this idiot Judge is telling me if I don't like my attorney I cannot fire them and get another attorney without an in depth explanation. That is pure BS.

The question will be on the census. It's been there all through history until Obama weighed in.

Switching lawyers would provide grounds for a delay of some sort while the new team got 'up to speed' on the larger and smaller points of the case so it's not totally wrong for the judge to be miffed.

IIRC the judge 'started this' by declining to accept the agency's routine rationale for its actions which rarely happens. They hadn't expected that kind of a reception and obviously had workaday lawyers on the case.

Now they want to bring in better talent to meet the deadline the judge gave for arguments with a more persuasive presentation, with an eye to getting his approval, and just as importantly to ensure they have grounds for appeal if he doesn't change his mind. He knows he's likely to be reversed if the case is appealed but he's putting wrenches in the gears at his disposal.

At the end of the day, the blooming idiocy of counting without tallying will be evident and the country will get the info it needs and is entitled to. That benefits all US citizens.
