Salisbury WalMart North Violating Your 4th Amendment Rights?

Just wanted to let you know of a disturbing new policy at the North Salisbury Walmart. They have begun checking receipts at the door causing a backup of people trying to get out the door. Walmart is not a membership store (like Sam's) so there is no contract between them and customers to allow this. 

These searches are unlawful and a violation of your 4th amendment rights! Unless they observed you conceal items they cannot force you to show a receipt. You have purchased items at the register, firmly decline these searches of yourself and your property. Ridiculous they are using associates that should be ringing up people or helping customers and instead have them harassing customers. 

The whole time I was in the store customers were paging for assistance multiple times in site to store, the fish department, the fabric department and there was a huge line at the pharmacy with one cashier only, and only like 3 regular cashiers for 25 checkout lanes. Now they want to hold you up longer to wait for a receipt check!

Publishers Notes: I have personally experienced the same thing and wondered if what they were doing is legal. From this point forward I will tell them absolutely not, call the Police if they so choose.

Umm, just say "no," and move on. If they continue to pester you, just leave. Its a search-and-seizure issue only if it is the government, not private entities. Wal mart is a business.

Shrinkage is the chief money loss for retailers especially around the holidays. It is also responsible for escalating prices. If you don't like it, don't shop there. Can understand why they do it and if it helps keep their prices down, I'll put up with the inconvenience.

Violating the 4A would entail them doing a body search or illegally searching your handbag without probable cause not checking your receipt. 215 is absolutely right. Private entities can do this without infringing on a person's 4A. Sorry.

I worked in LP 4 years and they said that we Cannot STOP
Anybody , and stop their Movement Unless, we can Prove they
Shoplifted from the store. And we could Not Chase them !!
Plus, common sense, You have been threw the Frigg'in
Register , if they care to Observe you there, so there is
No need to try to stop you in the first place !!!!
This causes Lines too long on the way out the door and is
Not Necessary.
I say it is NOT Legal , and I DARE them to try and Force me
OR anyone to stop , against their WILL .....they just may
Get Sued !!!! Hint Hint

This receipt check is done at the Wal- Marts in Florida as well. Must be a nationwide company policy.

Our bill of rights are there to stop the government from abusing power. This has nothing to do with private industries' practices as you are not forced to shop at Walmart.

If you don't like Walmart's practices, shop elsewhere, like Target, where a strange man with mental issues can help your daughter, sister or wife go to the bathroom.

Joe, answer me this, If you buy a ticket to a sports venue, that ticket is clearly yours, why would you need to show it at the arena to get in?

The answer is to show that you bought that product or service.

These retail stores are getting hammered with theft. This is their attempt to curtail it and they are not frisking you down to do so.

The sad thing is that a lot of these people who " guard " the doors are older men and women who have retired and are just trying to make a few extra dollars. All it's going to take is just one person with a bad attitude and knock one of them in the face or down and run. Is Walmart going to pay for the hospital bill or for the law suit that is filed against them?

Look at the photo. Is Gramma, who is getting paid minimum wage, really going to stop you if you decline to display a receipt for purchases you made? I doubt it. The amount of thievery in this world creates a need for these inconveniences. I liken it to the way toys are packaged like the contents hold the Holy Grail. There would not be a reason for it if theft was not so common. It is not a statewide practice at all stores in Florida, unlike a prior poster noted. Just like how it does not occur at the Fruitland store, it is likely based on the amount of shrink at that location. With the way crime is increasing here in our little Baltimore, I’m not surprised.

Isn't it always so nice when these articles bring out the degenerates and illiterates in our society? Just because you're a product of the criminal justice system doesn't mean you KNOW the laws. A business can check your receipt without fear of legal recourse, especially when they have self-service because some are just not honest folks. If you don't like the way Walmart does business, don't shop there. There's always other alternatives. Guess what? Walmart knows it, too and they don't care if you're inconvenienced or shop some place else.

If shoplifters only think they may be checked, it will deter them trying to steal. Nobody seems to care about being checked in Sam's Club. I don't see the big deal.

Sure, I'm not forced to shop at Walmart, I'm also under no legal obligation to show them my receipt when I walk from a cash register where I paid to the door. (now if they have me on camera or an associate saw me shove something in my pants, maybe) This has been held up multiple times in court in multiple states. In fact, in all but 7 states you're not even required to stop if the door alarm goes off.

Some might say well just show them your receipt. But too often these days our rights are infringed upon and if we just allow it to happen, it's gong to get even worse! Plus, I've got things to do besides wait for some apathetic slow associate to look at my receipt and pretend to compare it to what's in my cart, I'm not going to be sixth in line to exit the store after I paid!

OH the things I've seen in Walmart. Yeah...people will swipe things and put them in a bag alone with 2 other items that were not swiped. Then there is the slip the item in the pocketbook that is sitting on the pad next to the bags. I think my favorite has been seeing a mother push food in a teens coat while she plays lookout. Teen goes to the bathroom while mom pays for a few items and then hooks up with mom at the door.

All this means is that I pay more money for these the things I buy so these slicks can walk out with all they want. If you have a way of stopping this....do it.....I don't mind showing my receipt. I have a feeling that this isn't going to be the cure either because people don't want to get involved unless you pay them.

313 Walmart is a private company engaged in commerce. They have the right to refuse service to anyone and can ban you from their property without just cause. If they choose to check your receipt to see if it reconciles with what's in your bags, that's their prerogative. You as the consumer have the right to not shop there, thereby banning yourself from their business. If you choose to self-ban, that's your prerogative.

If that Walmart lady says to you, "I have to check your bags because you're ________ fill in the blank with a racial term." Then you have a discrimination suit. If they remove you from the property for being disorderly (a misdemeanor) then you are the one breaking the law. Legally the 4th amendment doesn’t apply to public companies. Some states have laws that favor the store. While Walmart can’t stop you without cause what they are doing isn’t illegal. If they try to stop you from leaving the store then things change.

In the past two weeks, my receipt was checked one time. The receipt checker (who was also the greeter) said they were looking to see if unbagged items had been paid for. That day I had a large unbagged package of Paper Towels and an unbagged jug of Laundry Detergent, under the cart. I did not feel offended or upset. Actually I thought it a good idea.

I use the large Sam's Club double size bags (not small white or blue plastic Walmart ones) and was not stopped for a receipt check, except when I bought Paper Towels and Laundry Detergent.

A product is not mine unless it was paid for and the only way the retailer can determine that, is to check the sales receipt as you leave the store. IMO the retailer has every right to check the receipt BEFORE customers go out the door with possibly unpaid merchandize. Stopping ALL (with unbagged merchandize) will not result in a discrimination complaint. I have no problem with them stopping all (bagged or unbagged) if it cuts down on stealing.You can thank people who steal for your feelings of inconvenience.

If you feel customers should not be "challenged" how would you deal with unpaid merchandize walking out the door of a business you owned?

I literally JUST left there. I had a cart full of groceries. Nothing was under my basket and I clearly had no electronics. The door greeter stopped me on my way out and said "I need to see your receipt." (No please, nothing.) I jokingly said "I suppose." and I laughed. He never cracked a smile even as I joked with him. He checked my items and said thank you and I walked away. It felt like I was being stopped by a cop lol. I remember thinking that he was letting his power go to his head. Then I come home and see this article.

I have retired and I no longer have a store after decades of serving the public. The longer I did it the more stupid it seemed. Nobody would invite strangers into their home without vetting them first and I was inviting everybody into my store and some of them were the scum of the earth and not just the ones that steal.

Ever wonder how those pieces of towel get on the public bathroom floor? I was in a public bathroom last night and watched two small children drop little pieces on the floor trying to pull a towel down. Dad didn't say anything. They will still be doing this when they are 36. I will tell you they were white so you all don't think they were black. And they were upper middle class.

The public you gotta love them when you serve them and I am glad I no longer serve them. Oh, and I am always nice to the clerks and other employees. There is a reason why they act so frustrated sometimes.

4:02 PM - when (if) the new grocery chain, Aldi, finally opens in Salisbury, you will find Aldi DOES charge the customer for use of shopping carts. "Woe is me", you actually have to pay for the use of the cart BEFORE entering the store. I'm just giving these folks a heads up, so they can investigate what Amendment Aldi is breaking, and demand a free cart.

Also - purchases are dropped back into the shopping cart at checkout, as their employees, who sit there in a chair, while checking you out, bag nothing or even supply free bags for you to pack your own groceries. "Oh my, surely there is a federal law against that". After reading all the comments on here from all you indignant whiners I don't think the majority can handle such a tough situation.

People say get rid of the self check outs,and I've seen some shadey stuff at those check outs also because they only have one person working 10 registers that always have issues and need that persons assistance,so it's hard for them to pay attention to what's going on. I tend to use them more often and so do alot of others probably because there are never enough registers open,and the self check out line moves faster.

First no one has fourth amendment protections from other private citizens or companies. The constitution only applies to protections from the government. Surprise! Second a recourse you have from a private search is an assault charge. However they aren't searching anyone or anything. They are asking to see you receipt. They can also tell you not to shop there if you don't want to show them your receipt. You are not entitled to shop there. It's a private business that can refuse service to anyone. Lastly from a loss prevention perspective it does nothing for an old man or woman to circle something on your receipt without really checking what you bought. So it's somewhat of a stupid proactive approach to discourage theft. None the less it is not illegal by any means. Shopkeepers can lawfully detain someone for stealing in Maryland. It's called shopkeepers previlage. Not many places do it anymore because of the amount of bogus lawsuits and bad arrests. However it is not illegal for a shopkeeper to detain someone for the shopkeeper to detain someone by force for th police.

Actually they can arrest you or to be more precise detain you. Shopkeepers previlage allows store owners to detain shoplifters for the police.

This is performed in response to the massive and ever-increasing amount of theft that occurs. Especially, in areas with large numbers of minorities.

This isn't anything new they started, they had greeters a while back and around every holiday season. Just don't shop there, shouldn't be a problem with no one and I'm there all the time.

Sunday afternoon, busiest shopping time of the week, 6 cashiers open. There were more cashiers closed, than open. 30 minute wait in line.
I'm done, I'll pay extra at Target and Food Lion.

Not exactly. Discrimination is based on someones view of race religion sexual orientation gender or other identifiers. If service is refused then you have discrimination. If you are first allowed to shop there then act like an idiot then its your fault you would be banned from a store. They did not discriminate against you because they have a reason for banning you.

People always fund things to complain about. I'm sorry, but I have no problem with them checking my receipt for in bagged items, or to make sure that my water on the bottom of my cart was purchased. Mistakes happen and it costs the company $$. Just follow the rules, take a breath relax and get ur panties out of a bunch. People are just doing what they are told. Stop Getting offended by everything.

Isn’t that what the sensor is for when you leave out of the store? I hear it go off plenty of times. I have no problem stopping if that sensor goes off because I know I’m not stealing anything so there’s no reason to check my receipt ����

As a former Walmart employee if we suspect someone of shoplifting on the store floor we are to give them aggressive hospitality in which means that we approach the suspected shoplifter with the Welcome to Walmart and can we help you with anything line. It's quite simple if you don't want to show a receipt then don't shop at Walmart and if you are a suspicious person the cameras have your description and will notify law enforcement if you walk out the door with something that you didn't pay for. Asset Protection has eyes all over that store so don't think you can get away with stealing. Don't want the opportunity to show a receipt to a courtesy associate then if we have you on camera stuffing stuff down your pants the police will be notified.

If you didn't steal then you have nothing to hide and that is plain and simple...

Walmarts in the city do this allll the time. People steal. Quite often. It is truly not that big of a deal. Eventually you will become that person will not even be asked to stop. Stop finding petty things to complain about. Trust me, Salisbury has more significant issues than being asked to stop so their receipts can be checked. *rolls eyes*

All of them have greeters but they Ain't checking receipts....as big as the store is and the amount of customer....no one should be stopped at the door unless they were caught stealing

It's to cut down on shoplifters. Of which there are plenty in wal-mart. They lose a lot of money in every wal-mart. The one in Berlin lost over $40,000 one year. The one in Fruitland is in a bad neighborhood as it is. Some people buy an item, take it home and remove the new one and put the old one in and reseal it and take it back and get a refund. This happened to me once. We bought a slow cooker and took it home and opened it and someone's used one was in the box. Some people are just garbage. They should check returned items as well.

The fourth amendment protects you from GOVERNMENT seizures. Walmart is a private company. Also, you are on their private property. I agree, if they chased you onto Route 13 then you would have. But as long as you’re in their parking lot or store, that is their property, there a private company, and they have a right to do that.
