Class action lawsuit filed against Dead Freddies

Ten employees have joined a class-action suit filed in federal court in Baltimore as plaintiffs against Dead Freddies LLC alleging they are owed unpaid overtime and minimum wages.

The complaint was filed on Aug. 27, and while the defendant has until Oct. 19 to respond, the company already challenged claims made by two plaintiffs as of Sept. 30.

According to court records, plaintiff Melanie Mason of Pocomoke City was a tipped “front of house” server from Feb. 2013 to August 2015.

Mason, however, alleges she was not paid for all of the hours she worked, was forced to pay for customer walk-outs, mis-rung or rejected food and drink and was forced to perform excess amounts of “side work” including rolling silverware, cleaning tables and both cleaning and stocking service areas.

Seriously, excessive amount of side work? Rolling silverware, stocking service stations? What a joke Ms Mason and her generation is.

rolling silverware and stocking service stations might not seem like much but if you are making tip rates you are working for peanuts and loosing tips at the same time

This is why the owners in OC like the foreign workers. They don't complain or sue even though they are being exploited. They are just happy to be here.

Get tough and do the job you are expected to do or quit and go somewhere else to work or loaf. Poor thing had to do side work.

Good! Im glad these employees are going after this business. So many are not paying overtime, or making servers pay for walkouts, which is illegal. Its a big problem in Ocean City. I lost my job last year for refusing to pay for a walkout. I can understand if it was happening repeatedly. I also worked overtime and received paychecks for exactly 40 hours, no overtime, no pay at all for the extra hours. I don't agree with the normal sidework part that is part of the job. But some employers go overboard like making tipped employees do excessive amounts of work like deep cleaning during closed hours for $3.63 an hour or nothing at all. Its time they started treating employees as the law states that they should.

I guarantee if it was you, you wouldn't be saying that. You probably make $15-20 an hour or else you are a manger and you treat your employer's the same way.

Besides if they are doing someone else's job, then they should be getting their pay also.!!!
