Va. Woman Sues Ocean City Amusement Park

BALTIMORE (AP) -- A Virginia woman whose son was allegedly knocked down and dragged while on a ride at an Ocean City amusement park is suing the park for $1 million.

The Daily Record of Baltimore (http://bit.ly/1uoVwER ) reports that Raffinee McNeill is seeking damages for an injury her son suffered while riding a children's ride called the "Hampton I" at Trimper's Amusements.

The lawsuit filed in federal court in Baltimore alleges that in 2012 McNeill's son got out of his car when an operator stopped the ride to let another child off and was then knocked down and dragged when the ride started again.

I hope she has medical records to prove that he indeed did have a skull fracture and also that he has suffered lasting effects from the injury. Otherwise her claim will be seen for what it likely is, a get rich quick scheme.

Insurance company will evaluate the lawsuit and either fight it or settle - whichever is less expensive.

I don't understand why the kid got out on his own. My children were taught from a VERY young age, that the attendant will get you out.
I wonder if there was a sign.

A lawsuit like that can finish trimpers off very quickly...the ride attendant is at fault and its a pretty simple case. Trimpers and ocean city have a tremendous amount to lose here.......

The state of Maryland has a contributory negligence statute that states if a persons actions causes an injury their ability to collect compensatory damages may be voided. The cause of this accident was the child getting off the ride without being told to do so. However, the ride operator should have been positive that it was safe to restart the ride which it clearly wasn't. This case will be interesting to follow..
