Update On Last Nights Shooting In Salisbury

A Sgt. of the MSP went out to inspect a vehicle with an equipment failure that had allegedly been repaired.

As he approached the vehicle he could clearly smell the aroma of pot emitting from the vehicle. 

He casually called another Officer who had just left the barracks and asked him to return. The suspect realized he was in trouble and got in the car and started the engine.

The Sgt. immediately reached into the vehicle to turn off the engine and the suspect started backing up. We're told the Sgt. hot his hand stuck in the steering wheel. He demanded the suspect stop the vehicle and he refused. 

The Sgt. then reached for his weapon as he was being dragged by the vehicle and he shot off one round. The other MSP Officer pulled into the barracks and started shooting off rounds that apparently hit the door but did not penetrate the door.

I'm told the one initial shot the Sgt. got off was the bullet that struck the suspect and he eventually bled out, so we're told. 

Mind you, this is what we have been told by a reliable source and has NOT been confirmed. We are still awaiting an official press release from the MSP.

SUSPECT FATALLY WOUNDED BY TROOPER IN WICOMICO CO.

(SALISBURY, MD)
– Maryland State Police continue their investigation into a trooper involved shooting which fatally wounded a man who struck and dragged a trooper with his car to avoid further police investigation last night, at the Salisbury Barrack.

The deceased is identified as Winfield C. Fisher, 32, of the 6100 block of Westbrooke Drive, Salisbury, Md. Fisher was transported to Peninsula Regional Medical Center by emergency medical personnel from the Wicomico County Fire Department. He was pronounced dead by medical personnel at the hospital. The deceased will be transported to the Office of the Chief Medical Examiner’s Office for an autopsy.

The preliminary information indicates Fisher entered the Salisbury Barrack around 8:30 p.m. on March 18, 2014 and asked the duty officer to check a vehicle repair made after receiving a safety equipment repair order. The duty officer went outside to the parking spaces in front of the barrack with the Fisher.

Moments later, the duty officer came back inside and requested the dispatcher to call for back up. As he returned to the vehicle, the dispatcher immediately contacted another trooper who had just left the barrack. That trooper returned to assist.

Details are preliminary but it is believed both troopers fired their Department issued pistols. The duty officer was found lying along the edge of the parking lot near the entrance to Rt. 13. He had sustained injuries consistent with being struck and/or dragged by a vehicle.

Fisher was found in his vehicle about 150 yards north of the barrack on Rt. 13. His vehicle had struck the center median guardrail on the northbound side of Rt. 13.

EMS personnel responded and transported the suspect and the duty officer to the Peninsula Regional Medical Center. Fisher was pronounced dead at the hospital. The duty officer has been treated and released.

Maryland State Police investigators obtained a search warrant for the vehicle. State Police crime scene technicians processed the vehicle and the barrack parking lot for evidence. Marijuana was recovered from the suspect’s vehicle.

Investigators from the Maryland State Police Homicide Unit responded and are conducting the investigation, which is procedure in police involved shootings. They will be reviewing evidence developed in this investigation. Investigators will also present the Wicomico State’s Attorney’s Office with their completed investigation for review, which is also procedure in police involved shootings.

Corporal Anthony Meyers is a nine-year veteran of the Maryland State Police. Trooper Jeffrey Wilkins is a three year veteran of the Maryland State Police. Both have been placed on routine administrative leave, which is procedure in police involved shootings. The State Police Internal Affairs Unit will also be conducting an investigation.

Sounds very similar to last year involviing trooper on Johnson Road. How interesting that started out with all kinds of big talk charges and the individual shot ended up getting barely a year on lesser charges. Looks like they learned from that one, no bother with court.

and the whole thing could have been avoided it some idiot didnt take his weed to the state police barracks with him. i don't understand how people can be so stupid. because of one really stupid decision, someone is dead and someone else is injured. several families have had their lives changed for the worse. the suspect may not have even intended to injure the officers but in trying to escape from a situation he brought on himself, many people's lives have been altered. it's very sad for everyone involved.

Why would the trooper get any charges? If that suspect lived he would be charged with attempted murder as he should be!! The officers life was in danger and he did what he had to do. Why would the idiot go to a police station with drugs in a vehicle? Why was that repair order so necessary that it had to be looked at at 8:30 at night? I call the suspect idiot of the year. Noone deserve a death but hello, how dumb can you be? The troopers do not deserve punishment. .they did their job! Another druggie off our streets.

@3:19 actually, if you read the reports, ALOT of the arrests for possession during a traffic stop happen because a suspect was speeding or texting or had faulty equipment or some other completely stupid infraction that would be obvious to most halfway intelligent people. i've been sitting in traffic at the beach and have been able to smell marijuana smoke coming from other vehicles nearby, in broad daylight where anyone can see them. so yes, i believe some idiots are driving down the highway, texting, speeding and all kinds of other things that you would think someone trafficking drugs would be smart enough to not do while transporting illegal substances. you are giving the criminals too much credit. they feel they are above the law and that cops are stupid and they wont get caught. or they just dont think at all, either way, i think you may be the one who isnt being realistic.

Now as far as this cop smelling weed coming from a the car goes. Sounds like BS to me. This guy goes into the police station right after smoking some weed talks to police inside mind you but, no one smells a thing. He then goes outside with winds of 10mph and gust of even higher and all of the sudden this cop now has the nose of a k9. This is the same ploy police use daily to to conduct legal searches. Simply say you smell pot and your in.

Did this guy do wrong by trying to drive away ? Yes he did. But should this guy for smoking a joint ? NO!

Sounds to me like this cop should have just stepped back since he already new the mans name and waited for his backup and not try to be a hero and murder someone for smoking a damn joint.

The man was instructed to turn the vehicle off and follow ORDERS by a law enforcement officer. He tried to run him over and almost succeeded and you say for NOTHING!

He tried to kill a Police Officer for crying out loud.

He died because is was either his life or the Officers life.

When this man was shot he was then dragged from the car placed on the ground and bleed out because none that's right not one of the officers had enough humanity to put pressure on his wounds he was simply allowed to lay there and die while officers stood over him discussing among them selves how the shooting was handled.

Shame on you officers on the seen for not helping this man he's now died and might have lived if one of you had simply had the heart to help stop the bleeding.

Call it what you want even if this cop rightly shot this man he or others on seen could have helped him.

I didn't see the shooting but I did see the aftermath . And it was shame full

I'm sure that I'm in the minority in that I feel sorry for all parties involved. The man is dead due only to his own choice to live a high risk lifestyle, which to me is a shame and a waste of what could have been a productive life. At this point in time, pot is illegal. That's all that matters. Any time you do something illegal no matter how insignificant some think it may be, they quite possibly could be risks. Very rarely does anything good every come out of someone breaking the law.

Well, gee Mikey, did you forget that you shot and killed a motorist on the Salisbury Bypass years ago when he allegedly drove at you with his car??? Taking the life of a citizen for a nonviolent crime is not the prerogative of the police(that belongs to juries and judges). While I believe in obeying the law the dead man did not put the Officers life in jeopardy. The Officer put his own life in jeopardy when he unwisely stuck his arm in the mans vehicle when he had plenty of other options.

If you remember Mike Lewis retired only as a lowly sgt. He didn't have the brains to make it to Lt., Captain or higher. He knows nothing about MSP or the troopers these days.

I think it is sad that people justify the cops mistake of reaching into a vehicle to illegally try and turn the car off, which resulted in this tragedy for all involved. I do not believe that someones mistake that results in a death should be exonerated.

Look...I was irate when a rookie city cop pointed his weapon at my head for five minutes when he perceived a threat from my muzzleloading hunting rifle (unloaded of course) after a traffic stop for accidentally squeeling my tires. This incident is 100% different and unless proven otherwise, I see this as a justified use of deadly force.

Just from the information provided, the party who died what an idiot. Pot or not, when he didn't stop as ordered, trapped the Sgt. with his hands in the steering wheel and attempted to drive away dragging along the Sgt., that is assault with a deadly weapon.

Response was with deadly force is validated--period.

The driver was an idiot.

If there is other information not already listed then that will have to come under review.

However, the facts that are stated to date, the driver of the car had a death-wish over pot.

I feel very sorry for his family, all the families involve.

Lee Clarke is one of the most honorable men I know. A decorated Veteran, USMC. And a field officer level --- after being an enlisted man. He is an excellent lawyer, with integrity. And, he knows the law and should be able to make an opinion on here without being attacked. I don't think this is as squeaky clean as some obvious LEO's think it is. A man is dead, instead of standing trial and being convicted for what appears to be minor crimes. I'm sure Lee can educate us as to whether the entry into someone's car is a legal search or not. Lee, you have a lot of support in this community. And WE respect YOUR opinion. Thank you!!!

I'm throwing in with 3:19. "The strong odor of marijuana" is the go-to excuse for anything they want to do. They are in CYA mode. When a safety equipment ticket devolves into a killing such as this, there is something very wrong.

If any of you have ever entered the barrack, you would know that there is glad in front of the officer area which you have to talk through. The officer wouldn't have smelled marijuana on the suspect until he exited the building and approached the vehicle.

Another dangerous pot smoker off the streets (Thank God)....Killed over the aroma of a God given plant...Say what you want, but if the arcane drug laws were not in effect at this time, no Officer would be hurt and a dead guy wouldn't be dead. He would just be in jail for DWI...Killed over the smell of pot, smdh...For the record, the Police always use the smell of pot as an excuse to search your vehicle. Whether the "actual" smell exists or not...And that's the truth as much as the good Cops will deny it.

What makes people think a repeat drug offender would not come up to the barricks without drugs? And then of course once he's caught again attempts to flee? I'd be curious how much weed he had in the car? Before we play judge and jury lets see his this investigation plays out. Others sources have stated the officer was hit not drug...

On another note Mike Lewis-The novelty has worn off! I'm personally sick of him thinking he needs to be the mouth piece for all local police agencies. Stop taking credit/limelight for events you had nothing to do with and furthermore refused to assist in.

Was there 2 shooting victims or not? The MSP made it sound like there were 2 shooting victims. The SFD was clearly dispatched to a shooting in the parking lot of the MSP barracks. The Delmar FD was sent to a shooting down the road from the MSP Barracks in front of Beracah Homes?

THere are clear lines in the sand being drawn here. There are many people who still believe and support the fact that police are justified in everything they do. Then there are those who believe that all police are evil no matter what. Then there are the rest of us that are in the middle asking questions trying to find answers. The only trouble is that the answers given don't make sense and if you use logic on many of these it is clear that we are being lied to. Americans are being murdered by police in numbers greater than the casualties of all the wars we are currently perpetrating. That is a scary thought.

What matters in this case is this officer did not do the right thing plain and simple. If you think for one instant this officer was trained to jump in a moving car and put his life and the drivers life (aka the dead man) in danger you people are sadly mistaken. The officer lost control of the situation make no mistake about it. No officer is trained to do this . To think this officer put his life and motorist in the area in danger simply because he smelled pot shows a major issue in training. Let's not forget this man was not known to be violent. He had no guns. He had gone to the police for help in getting his car legal again and now he's dead . Simple as that.

Not to worry I'm sure it will all be worked out and this desk jockey of a cop will be made out to be a hero. He will have a medal pinned to his chest and be paraded in front of the MSN for all to .. so no worries Salisbury your quaint lil town is free from this pot smoking thug and all is well.

People should not assume that Winfield, who committed crimes (the same one over and over) is guilty, because that is wrong... but lets prosecute the cop (with no criminal history) because that's ok??

Every single person on here judging without ALL the facts has probably also done everything in their power to get out of jury duty when called... all these judges yet it's difficult to get people to sit on a jury. hmmmm

As Lee Clark said there was an arrest by this Trooper of this man in 2000. Maybe the guy wanted to kill Myers. Maybe this was some sort of payback for the said arrest. We dont know what was in the head of a dead man that drove to the State Police Barrack smelling of MJ. In possesion of quanity indicating disribution.

As Clark pointed out there is a history there. I did not see Clark pointing in any specific direction with his statement. So lay off. lol Yes I am a cop but Lee Clark is a good attorney. I know I said it lol.

So Myers knows, God knows, Fisher knew. It will all come out. I think all shooting can be avoided in the end. The issue is Myers had spolit seconds to make a call and as far as I am concerned he made the right one.

The person killed showed wanton disregard for a ban on marijuana, that is all. A disregard shared by many, many people. Does he have any record showing a propensity for violence?
Now how about the officer? Were his action violent? They most certainly were.

When someone threatens you the natural response in ALL OF US, I repeat ALL of us, is to flee the situation or fight. With this in mind it is pretty clear who the violent person here was.

Now I ask is it okay to kill an person who is unarmed and actively retreating ? Not in this state. Yet here we see that the law that applied to the citizenry is not applied equally.

Don't ever lose site of who we are. WE are the inhabitants of this are and WE being treated like subjects. Police do not see a person they assume you are a threat first and then violate your rights until you give them cause to react in the manner they were seeking to justify. Some don't take the bait. Others take it all to willingly, like this person who was shot.

I wonder how long it will take to get that footage so this can all be put to rest. If the officer acted in an appropriate manner release the footage now.

The footage is evidence, evidence that does not HAVE to be released at your demand. The evidence will be reviewed over and over and over again by many people before we will ever know what is on the video tape.

As far as winston not being violent...many people describe some of the most violent of offenders (Ted Bundy for example) as charming, church going folk. We all have bad days. You don't drive to the barracks with marijuana in your car PERIOD... when he attempted to flee with the cop even standing next to the car, he is risking the life of another person, that is violent. He knew the cops arm was in the car, he attempted to run him down with the car, that is violent.

When threatened it is NOT in ALL of us to flee. Some of us stand our ground. That cop wasn't given a chance to flee with his arm stuck in the car.

He was "unarmed" but sorry, I can kill you and have better aim doing so with my car than a bullet. His weapon was about 3,000 pounds heavier than the cops. he tried using his weapon BEFORE the cop did.

I don't lose sight of the fact that all involved are humans, not robots. We all do stupid, sometimes unexplainable things.

3:02... QUIT grouping law enforcement together, believe it or not each one is an individual. That is just as bad as when people group races, religions or sexualities together.

Just as people have good things to say about Winston, I am sure a lot of people have nothing but good to say about this cop. Just as everyone wants to protect Winstons family from people's cruel words, this cop has a family that should be protect as well. A subject is always innocent until proven guilty, yet you are ready to hang the officer without any real details.

3:02-from what we know at this point it didn't happen the way you are saying. According to reports the injured trooper was lying in close proximity to Rt 13. Unless the Trooper walked and fell to that location common sense dictates he was dragged by the vehicle. While he was being dragged was most likely when the shots were fired into the car in an attempt to stop it and prevent further injury to the Trooper.
The car then made it another 150 ft before the driver crashed due no doubt to the results of sustaining a gun shot wound.
To say he was "threatened" is off the wall. The Trooper had called for a backup and if this action makes anyone feel "threatened" then they surely have some psychosis going on. Paranoia comes to mind. I've been pulled over before. On more than one occasion another LE vehicle has shown up. I've not ever felt "threatened" by this. As a rational logical person I have NEVER felt the urge to flee. My forward thinking skills tell me, that could lead to something more than just a simple traffic ticket.

People should not assume that Winfield, who committed crimes (the same one over and over) is guilty, because that is wrong... but lets prosecute the cop (with no criminal history) because that's ok??

Do you think? if the cop had a criminal record he would be a cop?

The cop will be found not guilty even if video evidence suggest other wise its the people vs the goverment and we are loosing cause blacks, whites, rich, poor are all fighting against each other helping the enemy wake up

The cop went to far u got his tag if he tried to escape you don't run to stick your hand in a moving car you made your self get hit. Thats common sense and im sure they are not trained to do so. So it's another senseless murder by police going to far over steping the boundaries. In my opinion the trooper ran a check on Winfield and discovered
Winfield was serving a 2 yr. probation (ending August 2014) for his first and only time for distribution of THC which prompted said trooper to call for back up for a search of Winfield's car assuming THC would be found. Said trooper was released from PRMC and yet no answers to what prompted his need for back up. I have one question at this time....Why were helicopters flying over my house late that night? Was there someone else in his car that fled? And knows what really happened!

Cardi D.-I don't believe people are glad he is dead at all. I think what most believe is that he put himself into a situation involving another person (trooper) where a life or death situation was at stake.
I personally always feel sorry anytime ANYONE loses their life unexpectedly like this. No good ever ever ever comes out of using ANY KIND of illegal substance. If nothing else, it's stupid to spend a cent on something that alters your mind. It's idiotic to put something into your body which has the potential to make you not be in complete control of yourself.

I respect the police. When My neighbors, family, friends have to call 911 they will be here to help. Shame on those comparing our officers to terrorists. While there are a few bad apples in every barrel, there is no information to suggest that is what's going on here. If you think that our officers are terrorists, maybe you should consider moving to country where terrorism is a reality every day.

We already live in such a country. Some just refuse to see it.

Don't you think the ones who are murdered by cops think they are terrorists?

Don't you think the women that are raped by cops think they are terrorists?

Don't you think women who are anally and vaginally searched on the side of the road in full view of motorists and the cops dash cam think the cops are terrorists?

Don't you think the people whose pets are killed by cops think they are terrorists?

That old cliche about bad apples in a barrel would infer that there are good apples in the barrel also. If true, why don't they police their own? Why don't they speak out against these so called bad apples?

When/if they do, then I will believe there are some good apples/cops.

Until then, I will continue to call them as I see them. Thugs/criminals/bullies with badges who terrorize the citizens they are supposed to 'protect and serve'.

It's been a week!!! What is taking so long for the facts of this case to be made public and for the trooper to be held accountable for his actions that ultimately resulted in the death of Winfield C. Fisher, III?
