UPDATE: Durham v. Somerset County, MD

UPDATE to Delmarva Daily Times article dated April 30, 2013 entitled "Somerset County asks judge to recuse himself in deputy's lawsuit"

See attached Memorandum and Order dated November 6, 2013:
The new Judge, James K. Bredar assigned to Durham's $5million lawsuit against Somerset County and Sheriff Robert "Bobby" Jones (in his official capacity) has ordered the case to move forward and also states in the attached Memorandum and Order that,

" the County's assertions that the court never ruled on the matter.... are factually inaccurate and, frankly, insulting to the court. Counsel for the County [Kirk Simpkins] is cautioned not to use similarly intemperate language in the future."
"None of the County's arguments has any merit. It's motion to reconsider (ECF No. 42) is herby DENIED.

The County and its attorney are repeatedly clutching at straws in this case, and are now officially spanked for it.
Give it up, Somerset, and pay up. The guy won the suit.

"The undersigned has already cautioned counsel about the inappropriateness of vitriolic and disrespectful
language in either communications with opposing counsel or filings with the Court. See Letter Order, May 9, 2013,
ECF No. 56. This motion, with its inappropriate argument, predated that warning. However, the County’s reply
(ECF No. 67), filed with complete awareness of the Court’s warning, also contains insulting language (e.g., “It is an
opinion that never should have escaped chambers . . . .”). (Id. at 2-3.) To remedy this problem, the Court will strike
the reply."

Thank you Joe for posting these updates. Its pretty obvious the DT is once again doing a great job of choosing NOT to inform and update the public -- especially when the story shines a light on the county (mmmmm?) Interesting ... the DT had no problem writing a story about the county's request for the judge to recuse himself but there was no follow-up until now.
It sounds like from this new judge that the county just helped make Durhams case for continued retaliation even stronger!
Hang in there, Deputy Durham - 2014 election time will be here soon!

The county certainly needs fresh legal advice from a new county attorney. It's the commissioners job to make that happen.

Somerset commissioners have made many horribly decisions over the last several years. They should be held accountable as well as the attorney they hired.

Why would Durham want to be sheriff? You people in Somerset County just keep those check coming.

How many years has this been dragging on? Why are the citizens and taxpayers of Maryland allowing their government officials to use their hard-earned money to fight a losing battle and support this corruption? Do you people not realize that your tax money is being spent by the thousands (maybe millions) for the MD Attorney Generals Office to support and represent this sheriff!
I don't know this deputy but sure would like to meet him and shake his hand....we need more officers like him
