The police aren't constitutional lawyers.They should have arrested his stupid ass.Their job is to resolve the immediate problem.The court handles the disposition.

which problem did they resolve? cops are schooled on the constitution? or don't have enough sense of their own to know what is legal or not? isn't that their job to know?
8:30 the prisons are over flowing now. how the hell are we gonna lock up every idiot out there? unfortunately being stupid is not a crime, but it ought to be!
