MAN SHOOTS, KILLS DRUNK INTRUDER WHO BROKE INTO HIS HOME AND ATTACKED HIS SON – SO WHY ARE POLICE INVESTIGATING CASE AS A HOMICIDE

Police are investigating a potential homicide in Ontario, Calif., after a resident shot and killed a drunk intruder who broke into his apartment and attacked his sleeping son.

In California, citizens have a right to protect themselves and their families, however, there are stipulations in the state.

“The homeowner, the citizen, has to be able to articulate or apply the appropriate amount of force that was done against them,” Ontario Police Sgt. David McBride told NBC Los Angeles, later adding that Manzano was unarmed at the time of the shooting.

Sounds quite justified to me, what's the problem?

Even if it's justified, which it sounds like it in this case, it is still technically considered a homicide. When a cop shoots and kills someone in the line of duty it is considered a homicide.

There are many levels of homicide. In this case it sounds like justifiable homicide.

If an intruder breaks into your house, he gives up any rights he had.
Manzano’s uncle, “Alfonso stated “Just because you have a gun and its registered, doesn’t give you the right to kill somebody,” he said. If you break into some ones home, then it sure does give you the right.
