Violinist Sues Ocean City Over Noise Ordinance

OCEAN CITY, Md. (AP) — A violinist is suing Ocean City, saying police hassled him over his music while enforcing a restrictive noise ordinance.

The American Civil Liberties Union has sued on behalf of William F. Hassay Jr., who says he stopped playing on the Boardwalk last year for fear of being arrested and had to perform “in less lucrative settings.”

Hassay is trying to recover any money he says he lost.

I normally don't side with some of the off the wall boardwalk nuts but, in this case, a violin should not be silenced in favor of a Harley. If you have a rule enforce it but not selectively based upon how much money it brings in to the Government.

I have to side with this guy because he's right. Decibels of normal activity on the boards regularly exceed this level without a violin player. What BS.

I've seen him. Phantom of the opera guy. You can barely hear him for all the arcade, street and boardwalk activity.
He's ticked them all off now no matter what. O.C.P.D. will keep him out as he's doing it in response to their harassment in the first place.
Hope he wins.

Baltimore's Inner Harbor has an amphitheater for performers, where they schedule times for their performances. They are not allowed on the sidewalks or on the wide promenade around the harbor.
This sounds like the right idea for everyone.
Can anyone tell me how this is different from OC's boardwalk? Why doesn't OC do this?

Does he pay taxes on the money he makes? Maybe the IRS can look into this character.

I agree with the idea of OC having an amphitheater for performers to schedule their performances. Something should be done. Hopefully OC can do something about the businesses that have speakers aimed at the boardwalk blaring their music. It's too the point where you can't even hear the Ocean from the boardwalk which you were able to do years ago. So sad. OC is slowly losing it's relaxing charm.
