WBI Press Release April 7, 2016 - Bennett High School - Att. 1st Degree Rape

Incident: Attempted First Degree Rape
Date of Incident: April 6, 2016
Location: Bennett High School 300 College Ave, Salisbury, MD
Suspect: Juvenile being charged as an adult.

On April 6, 2016 at approximately 1:20 PM a female student at Bennett High School was led by a male student to a back stairwell. The male began trying to kiss the female and she was fighting to prevent him from doing so. The struggle continued for approximately 10 minutes. The male suspect was trying to pull the cloths off the female as well as get his own genitals exposed. During the assault he was controlling her movement physically to include choking her, pulling her hair, pinning her down on the stairwell and the floor and against the wall. Ultimately the assault was seen to be occurring by a staff member on video in the office. That staff member ran to stop the assault. Staff then escorted the parties to the office and began processing the assault. The School Resource Officer (SRO), a Wicomico Deputy, was contacted, after the victim and suspect had been released from school. He began his investigation at this point. After viewing the video of the incident, the SRO contacted The Wicomico Bureau of Investigation (WBI) and the WBI took over the investigation. On 4/7/16 the suspect was taken into custody and charged as an adult. He was released to the Wicomico Detention Center and his disposition is not known at this time.

Charges: Attempted First Degree Rape, Attempted Second Degree Rape, 3rd Degree Sex Offense, Sexual Contact without Consent, Assault 1st Degree, Assault 2nd Degree, Unlawfully Detain, Attempted 1st Degree Sex Offense, Attempted 2nd Degree Sex Offense

I hope that the victim is given rape counseling. This is a traumatic event, even though the assault was interrupted.

I am a 69 year old Veteran and have no children in local schools. I will be glad to stand with others to monitor halls as it's obvious that there is no discipline. This cover up must stop because numbers games.

No different then what has gone on at westside intermediate and then at Salisbury Middle...same kid 3 years in a row....what he did at sby middle April of 2014 got the same EXACT charges as this kid.

Why cover up the name he is charged as an adult. Is it Black on White crime? If so the Whites need to burn up the WalGreens and steal everything in sight. Then block the roads. There are lots of us veterans teaching in the schools, trying to maintain a sense of decency, and quite often getting reprimanded for how we do it. We would welcome veterans into our classrooms. Make it happen!

There are many people asking why we are not publishing the suspects name if Police are charging him as an adult.

Here's the deal. Law enforcement chose to charge him as an adult. He is 15 years old.

Until the proper authorities and experts determine this case will move forward as an "adult" we will refrain from publishing his name.

From the description on this blog, it sounds like the school did a good job of intervening. They should be commended for getting it right this time. Liberal policies have tied the hands of officials who want change.

1:33, In my personal opinion, no. It is the charging Officer that chose to charge him as an adult but that does not mean that will stick.

I will say at this point that other authorities have reviewed the evidence and agreed to move forward with adult charges but that does not mean that a doctor or judge will ultimately agree.

That being said, the Internet is forever. Placing his name out there right now would be irresponsible.

Thank you 12:14 for putting yourself out there and volunteering to act as monitor. I seriously doubt the school board would allow the public to come in to serve because what is really going on is keeping things buttoned up and a keeping a lid on what is going on in the schools so kids and parents don't panic. This is the only place you can read what is really going on.

WTF do we even pay for the Deputies in the schools if they are not involved in these criminal offenses.

I want the "Office Staff" fired for not doing their jobs!!

Some of the schools are trying to sponsor groups of Dads and Granddads to come into the schools and help us monitor the halls and bathrooms. We need men's and women's groups from our faith communities to help us teach children how to be productive, decent, mannered little humans. Stop the batching and complaining and come and walk the talk.

MD law provides that juvenile who commit certain offenses must be charged as adults. I list the exclusionary offenses below for juveniles 14 years and older:

* First Degree Murder
* First Degree Rape
* First Degree Sex Offense
* Any attempts or conspiracies to commit the above offenses.

Regardless of what any "doctor or judge will ultimately agree" makes no difference whatsoever as MD law is clear and the attempted rape and the attempted SO will be handled in the adult system.

For certain crimes committed by juveniles
of specified ages, charges are to be
placed on the Statement of Charges
(form DC/CR2) because jurisdiction is automatically waived

certain crimes are waived
to adult court are:
1.
A child at least
14 years old
alleged to have done an act which, if committed by an adult, would be
a crime
punishable by death or life imprisonment
, as well as all other charges against the child arising out of the
same incident:

First degree murder (CR 2-202)

Attempted first degree murder (CR 2-205)

First degree rape (CR 3-303)

Attempted first degree rape (CR 3-309)

First degree sexual offense (CR 3-305)

Attempted first degree sexual offense (CR 3-311)

He was initially held without bail (commissioner) then today had a bail review hearing (before a District Court judge) and was still held without bail.

Massive failure with cameras not being monitored for 10 minutes. Why wasn't deputy sent to respond? Rape is horrible, but what if a stabbing was going on? What's the point of having cameras if they aren't watched? Lots of questions!!!

2:36 & 2:39, Thanks for the info. I wonder WHY the states attorneys office didn't tell me that when I spoke with them today? I questioned it and they could have easily told me what you've commented but they didn't. Very interesting.

Nevertheless, it still doesn't mean I'd publish a 15 year old's name until the proper authority put it in a press release.

So just what is going to satisfy you people? Some seem so desperate, (as if they're being cheated) to know this kids name. Get a life.

What does over testing have to do with a girl being raped at a school that has no discipline? You must be from the WCEA MSEA teachers union who has done NOTHING to take a stand for teachers and students in regards to the serious discipline issues going on. All you talk about is too many tests. But oh yeah you issued a survey about discipline. Big deal that really solved the problem.

1:58 I agree 100%. Why are we paying Deputy's to be in the schools if they are not notified of such a horrific crimes when it is happening. The students should have not been released from school until the Deputy investigated/watched the video. The put the Deputy's in back offices when they should be in the front office and making appearances in the hallways during class changes and during classes looking for kids up to no good.

Thank God this wasn't my daughter I would own this county.

Get em Joe. People so ready to convict but are unsure of the facts. I reiterate, many young males around here have been falsely accused & not until the investigation were many cleared. Girls hold a lot of weight in their comments. A person caught to kids engaged in a sexual act and authorities said there appeared to b consent, but if the girl says other wise... . Who is commenting on these sites, adults or lynch mobs. If it s true then i most definitely agree w/ the masses on what he deserves but if its not this child could b ruined mentally for life. Foreal if some of these parents knew what these daughters text/inbox these boys they d harm their selves

It is a liability issue as well. If a volunteer monitor is injured, or if a volunteer injures a child, liability insurance attorneys will have a field day.

In the old days the girl's father would punish the boy's parents for being bad parents. The boy's parents would then move to another town because of the shame.

To enlighten your ignorant self, I am not a member of any union. I came into teaching from industry. If you had any understanding of the system, you'd realize the connection between the worship of testing and the loss of teaching time and thus the loss of control over behavior. The system is required to keep everyone in school so they can be tested to add to the numbers. Educate yourself.

Did u see what led up to the incident, have you seen the post on her facebook that insinuate she is more than willing to perform specific sexual acts? If i saw the video i would not b on a blog bragging in a anonymous manner how i saw it. Professionally speaking, if u saw the video you have NO business on here communicating what "u saw.". Like i said earlier, im leaving the case to law enforcement & the courts to make judgement, not a ...who may have just put the case i jeopardy. "Lose lips sink ships". Honestly this is something parents need to discuss w/ both there males & females. I tell my sons if a female says go & stop, you go for good cause she s playing games dnt even entertain her. Ive told my daughter u have to b careful in the message u send males, because hormones & not being taught any better could result in a dangerous situation.

Going after a boy and his parents for trying to rape your daughter is not by any means bigotry. It's old fashioned revenge. I'm not saying if it's right or it's wrong..but that is what it is. I'm sure they would like to string him up regardless of the color of skin. At the time you posted that, it wasn't publicly know what color he is. So who is the bigot?

I agree with 4:01. Testing has nothing to do with it so stop being rude 8:10! It doesn't matter how many tests students are given because little criminals like this one walking the schools could care less about any of their classes or grades let alone some state or county test! No matter what work or test a student is given it should be expected that students behave in accordance with the rules and conduct themselves in a civilized manner. My child attends this school and he says there are students running down the halls, being loud in the hallways, and walking around the school skipping class and doing whatever the hell they want. With all that going on no wonder something like this happened. So please don't tell us parents the loss of control over behavior is a result of testing.

I have sons & have read the filth girls his age and he s a teen have inboxed him saying what they will do to him sexually, unprompted. Girls of all races & financial classes & knowing what i do have warned him about stop & goers. & i have 2, a girl & a woman. & before & after we would beat his @$/, either way i would still tell my daughter to carry her self in a manner that reiterates a male to maybe think differently. And if i knew my daughter was on face book portraying herself in such manner id say the same & she d tell u i would. It may not stop a animal but realistically it sometimes its the difference. I work n the community & i have had some males approach me & tell me my daughter is a good girl, wife material & at 15 & they treated her that way with respect. she wasnt posting post that insinuated she down for what ever. She is graduating college next year sweetheart & just this week matter of fact, weds my son showed me her instagram & there was a pic which she recently took & i felt it it gave a easy look. I told her just what i said i would above, she s an adult & took it down. So u see i get it. My thoughts are mines just like yours are yours. However it takes a village so when you are on here or on facebook tell ur friends when their sons or daughters are portraying dangerous characters. Its easy to say what he should ve done. Well i think he shouldnt got 10 min into the act & they should have never been in that area, neither one if they wasnt suppose to b. Thank god she wasnt raped but there s a lesson to be learned here both ways. AND LIKE I SAID EARLIER IF HE IS FOUND GUILTY HE DESERVES ALL HE GET & help cause he ll b back in the community.
