Four good reasons why you should always request a trial for a speed camera citation

Motorists in Maryland who receive a speed camera citation have the option of requesting a trial. Most motorists don't request a trial and simply pay the $40 fine. However, there are several good reasons to ALWAYS request a trial, even if you think that you might decide to just pay the fine before trial.
  • Requesting a trial forces the county (or city) that issued the citation to create an evidence package. As we saw with the Baltimore camera scandal, citation evidence can often be erroneous. During creation of the evidence package, the citation is sometimes "administratively voided" and you never even have to appear in court. Conversely, if you pay the citation without requesting a trial, no further review of the citation is performed. In other words, if you don't request a trial, you lose $40 even if you did nothing wrong.
  • If you go to trial and win, you save $40. The county (or city) gets nothing.

Always subpoena the traffic camera into court

Most law enforcement agencies have a traffic officer dedicated to going to court for these subpoenas. So if you think that requesting a trial in hopes the officer doesn't show up think again. Iv received a camera ticket in DC that was $200. So stop whining and pay the $40 and move on with your day or better yet stop speeding.

Do your math. Get a 100 foot tape and measure the photo locations. LOOK at the photo data, do both photos have time AND distance stamped on them? Mine had one stamp missing. Without both numbers, there is no MILES per HOUR!

My tape measure said 27 mph in a 25, the ticket said 38.

Also, the camera company for Salisbury is in Baltimore. If they wanted to defend 10 tickets a day by sending an expert here, it would cost them more than they would make on the tickets!

I walked out of court a winner that day along with EVERYONE else!

All that proof I had and the sumbich didn't show up to get stomped! Boy, was I pi$$ed!

I didn't say to subpoena the traffic cam officer. I said subpoena the traffic camera.

I don't care if they have some cop assigned to go to court on camera cases. If he didn't witness it, or personality operate the calibrated and certified camera, he can't testify as a "witness".
