Shirtless Wade McCree May Be Heading To The Supreme Court

Judge of the Millennium Wade McCree has a special place in the hearts of ATL’s writers. The former Wayne County circuit judge had a penchant for disrobing for shirtless selfies and sex in his chambers, and was consequentlydisrobed by the Michigan Supreme Court.

On Monday, the Sixth Circuit correctly (if you mean “applying the law as it currently exists,” and “incorrectly” if you mean “adopting the better policy”) held that Judge McCree is immune from a civil suit brought by a man McCree slapped with a tether and high child support payments. The man’s complaint is that while Judge McCree was coming down hard on him, Judge McCree was also coming down hard on the child’s mother — specifically sexting her from the bench and carrying on an affair that ultimately ended in an abortion. The man and his lawyer are seeking an appeal to the Supreme Court.

Is absolute judicial immunity a doctrine worth keeping? Probably not…

Lawsuit Seeks Damages From EPA, ‘A Toxic Waste Dump of Lawlessness’

(CNSNews.com) – A conservative legal group is asking a federal judge to punish the Environmental Protection Agency for destroying or failing to preserve emails and text messages requested in August 2012 under the Freedom of Information Act.

The Landmark Legal Foundation believes the requested -- but never delivered -- messages to outside groups would have revealed EPA attempts to influence the 2012 presidential election.

"The EPA is a toxic waste dump for lawlessness and disdain for the Constitution,” said Landmark Legal President Mark Levin.

His legal group wants the federal court to fine the EPA “in an amount sufficient to deter future wrongdoing.”

Dems pump up impeachment talk in appeal for support, campaign bucks

In a matter of days, Democrats looking to head off Republican gains in November have turned scattered talk of President Obama's impeachment into a sustained rallying cry -- even managing to fundraise off the perceived threat.

The campaign arm for House Democrats has been sending out a barrage of fundraising emails warning of the impeachment threat, and claims to have raised roughly $2 million in their latest push.

The president and first lady Michelle Obama have warned of that possibility on the stump. And a top White House official even said Friday “it would be foolish to discount” a bona fide impeachment push by Republicans.

Missing After World War I: The Tomb of the Unknown Civilian

On 28 July 1914 the Austro-Hungarian Empire declared war on Serbia and set in motion the events that led one week later to the clash of nations that became World War I.

This conflict caused casualties in unprecedented numbers, with the final total of deaths approximately 17 million. The roster of battles and their military deaths remain seared into the collective memory of the major combatant nations: France at the battle of the Frontiers on 22 August 1914 suffered 27,000 dead; Britain on 1 July 1916 (to this day remembered simply as the First Day of the Somme) lost 21,000 dead; the extended battle of Verdun of 1916 at Verdun cost the French and German armies some 300,000 dead. Some battles became defining moments in national identity, such as Vimy Ridge in 1917 for the Canadians and Gallipoli in 1915 for Australia and New Zealand. Other battles are recalled for stunning defeats: the Russians at Tannenberg in 1914 and the Italians in 1917 at Caporetto.

What is often not part of this tragic story is that of the 17 million dead, about 7 million were civilians. What led to such a high number of civilian deaths and who now speaks for the civilian dead? One answer is disease, for the flu pandemic of 1918 killed worldwide. Great Britain and the Commonwealth nations had 180,000 deaths, Italy 432,000 dead of flu-related causes and both France and Germany endured 200,000 deaths. In 1915, 150,000 Serb civilians died from typhus.

US Police have Used Fake Mobile Base Stations to Spy on Citizens

US government has concealed police use of fake mobile base stations which can spy on citizens without requiring search warrants since at least 2009

A civil liberties group has discovered emails showing that the US government has concealed police use of fake mobile base stations which can spy on citizens without requiring search warrants since at least 2009.

Emails obtained by the American Civil Liberties Union show that federal law enforcement officials insisted police in Sacramento, Florida conceal their use of the devices, known as “StingRay”, in order to prevent criminals from learning how to get around them.

Sgt. Ken Castro of the Sarasota Police Department sent emails to members of the North Port Police Department in April 2009, informing them that the US Marshals Service requested that police not disclose StingRay in court depositions, but instead refer to it as “information from a confidential source regarding the location of the suspect”.

The North Port Police Department implemented the new rules and continues to avoid mentioning StingRay, according to the emails.

Maryland Solicits Foster Parents For Migrant Youths As O’Malley Meets With Faith Leaders

Maryland stepped up its efforts Monday to recruit foster parents and solicit other assistance from the public to help with the flood of unaccompanied migrant children coming into the country from Central America.

An appeal for help was posted on the state Web site as Gov. Martin O’Malley (D) met in Annapolis with a group of religious leaders for the second time in as many weeks to talk about ways to assist the federal government with the crisis.

O’Malley administration officials also indicated that they had passed along several potential temporary housing sites to the federal government and that Montgomery County was among the jurisdictions that could host a facility.

Obama quietly expands government’s ‘watchlist’

You don't have to be terror suspect to be chosen

The Obama administration has quietly rewritten the rules on how it goes about designating Americans as terrorists, according to a new report by Glenn Greenwald’s Intercept online investigations project.

The report details how Obama has expanded the terrorist watchlist system, “authorizing a secret process that requires neither ‘concrete facts’ nor ‘irrefutable evidence’ to designate an American or foreigner as a terrorist,” according to a key government document obtained by the Intercept.

Instead of actual evidence, all the government needs is the nebulous “reasonable suspicion,” which is considered one of the lowest standards of proof in the American legal system. It’s less than “probable cause,” which is required to make an arrest.

Greenwald, a former investigative reporter for the U.K.-based Guardian who broke the Edward Snowden story about NSA spying on Americans, left the newspaper late last year to start the Intercept.

The Vacant Presidency

The world is aflame and our leader is on the 14th green.

The president’s demeanor is worrying a lot of people. From the immigration crisis on the Mexican border to the Islamic State rising in Mesopotamia, Barack Obama seems totally detached. When he does interrupt his endless rounds of golf, fundraising, and photo ops, it’s for some affectless, mechanical, almost forced public statement.

Regarding Ukraine, his detachment — the rote, impassive voice — borders on dissociation. His U.N. ambassador, Samantha Power, delivers an impassioned denunciation of Russia. Obama cautions that we not “get out ahead of the facts,” as if the facts of this case — Vladimir Putin’s proxies’ shooting down a civilian airliner — are in doubt.

The preferred explanation for the president’s detachment is psychological. He’s checked out. Given up. Let down and disappointed by the world, he is in withdrawal.

Perhaps. But I’d propose an alternative theory that gives him more credit: Obama’s passivity stems from an idea. When Obama says Putin has placed himself on the wrong side of history in Ukraine, he actually believes it. He disdains realpolitik because he believes that, in the end, such primitive 19th-century notions as conquest are self-defeating. History sees to their defeat.

The Era Of Big Government ... Is Bankrupting You

THE BLEEDING OF AMERICA CONTINUES …

“The center cannot hold.”

That’s an expression we’re fond of using as it relates to the American experiment … and when people realize it’s the truth, some things might actually start changing in this country. We might decide at that point it’s not such a good idea to continue incentivizing dependency amongst our non-working poor – or continued granting subsidies, bailouts or loan guarantees for multi-millionaire corporate executives.

Why not? Because the people picking up the tab for this largesse (a.k.a. the people in the middle) are going broke.

According to a new study funded by the Russell Sage Foundation, the rise of big government under “Republican” George W. Bush and Democrat Barack Obama has had a profoundly deleterious impact on American incomes.

(Thank your government-run schools if you need to visit Merriam-Webster for the definition of deleterious).

How deleterious?

Americans Say Obamacare Is Hurting Families

The American people hate Obamacare and recognize the lasting damage it is inflicting, according to a new national poll.

Americans seem to recognize that the Obamacare law will boot people out of their health care plans, encourage idleness, drive wages down, increase the government’s tax take, and fail to put a dent in the number of Americans without health insurance coverage.

“Obamacare is helping some people; mostly Americans with preexisting conditions and those who are eligible for very generous subsidies,” Townhall’s Guy Benson observes. “But it’s hurting far more people. And a substantial majority oppose the law.”

Indeed, after but a wee taste of the deadly horrors of government-run health care, Americans now say by a 2-to-1 margin that it has hurt their families, according to a new CNN/ORC International poll.

When asked what impact the Obamacare law has had, 18 percent of respondents said their families were better off as a result of the law, compared to 35 percent who said Obamacare has made them worse off.

Americans continue to hate Obamacare overall, disapproving of the program by a dramatic margin of 59 percent to 40 percent.

Pending Home Sales Tumble From Recovery Highs, Biggest Miss In 2014

Following last week's collapse in new home sales [6] (and last month's massive beat and surge in pending home sales), it was likely not a total surprise that pending home sales would slow, but the -1.1% MoM print is the worst in 2014 (and the biggest miss in 2014). The median existing home price continues to rise (up 4.3% year-over-year) but this is the slowest rate of gain since March 2012. NAR is quick with the excuses and this time.. no weather is to blame.

From biggest beat to biggest miss in 2014...

Local Governments Turning Red Lights Into Green

Red light cameras are pulling in big dollars for local governments in the Washington, D.C., area, according to new data from AAA Mid-Atlantic.

Red light camera programs in cities like D.C. and Rockville, and Montgomery, Prince George's and Arlington counties raked in $21 million combined in 2013, the data show.

Montgomery County, Maryland saw the biggest boost. In 2012, its 22,616 tickets pulled in $1,919,602 in ticket revenue; in 2013, that number jumped to $2,806,690 with 43,522 tickets issued -- a 94 percent increase.

As of March, the county has earned $2,805,125 from 46,109 red light runners. That puts them on course to shatter last year's total, thanks in part to 10 new cameras.

New-Home Slowdown Pressures Recovery

New home sales plunged 8.1 percent in June, putting the decline at 4.9 percent for the first half of the year, and that's not good news for the economy.

"Housing has clearly been a notable area of persistent sluggishness beyond early-year weather disruptions," Ted Wieseman, an economist at Morgan Stanley, told The Wall Street Journal.

The economy contracted 2.9 percent in the first quarter, though many analysts expect it to grow nearly 3 percent for the rest of the year.

Mass Incarceration: 21 Amazing Facts About America’s Obsession With Prison

Nobody in the world loves locking people behind bars as much as Americans do. We have more people in prison than any other nation on the planet. We also have a higher percentage of our population locked up than anyone else does by a very large margin. But has all of this imprisonment actually made us safer? Well, the last time I checked, crime was still wildly out of control in America and for the most recent year that we have numbers for violent crime was up 15 percent. The number of people that we have locked up has quadrupled since 1980, but this is not solving any of our problems. Clearly, what we are doing is not working.

Nobody wants more crime. And it seems logical that locking more people up and keeping them in prison for longer terms would “clean up our streets” and make our communities safer. But instead, we have spawned a “prison industrial complex” that costs taxpayers more than 60 billion dollars a year but that does very little to turn the lives of the men and women inside around. The chart posted below is a bit old, but it shows that we have a massive problem with recidivism in this country…

Todd explained this was a larger indicator that the country as a whole has grown fatigued of Obama, but did not this fatigue to Democratic Party as a whole.

Court: Doctors can’t ask about gun ownership

'A valid regulation of professional conduct'

(GUNS.COM) —
A Federal Court of Appeals overturned a 2011 injunction Friday won by Florida doctors against a state firearms owner’s privacy law.

The suit, brought in part by the Florida chapters of the American Academy of Family Physicians and the American Academy of Pediatrics, had won an injunction by a lower court in what became known popularly as the “Docs vs. Glocks” case. That injunction was struck down this week in a 2-1 ruling by a panel of judges from the U.S. Court of Appeals for the Eleventh Circuit in Atlanta.

“We find that the Act is a valid regulation of professional conduct that has only incidental effect on physicians’ speech,” wrote Circuit Judge Gerald Tjoflat for the majority in the mammoth 161-page ruling in the case of Wollschlaeger v. Governor of the State of Florida published Friday.

You’ve Got Mail: Judge Grants Feds Unrestricted Access To Gmail Account

In giving law enforcement unfettered access to search for “some needles” in one individual’s “computer haystack,” a judge fans the flames of the data debate

Privacy advocates were dealt a major blow on July 18, when a federal judge in New York ruled that law enforcement has the legal authority to search the entire email account of an unnamed individual who police believe was involved in a money laundering scheme.

Google is now legally required to hand over the entire contents of the unnamed individual’s Gmail account — including all emails sent, received and drafted, all contacts, and other information — to federal prosecutors.

In his 23-page ruling, U.S. Magistrate Judge Gabriel Gorenstein wrote that email accounts should be treated like hard drives when it comes to search and seizure principles. In other words, Gorenstein believes law enforcement should be able to go through an individual’s entire email account if prosecutors can demonstrate probable cause showing a “sufficient chance of finding some needles in the computer haystack.”

“For example, in a drug investigation, it might be obvious based on information from an informant or other source that emails referring to the purchase or importation of ‘dolls’ refers to cocaine, but investigators might only learn as the investigation unfolds that a seemingly innocuous email referring to purchase of ‘potatoes’ also refers to a cocaine shipment,” the judge wrote.

Here Are The Countries That Smoke The Most Marijuana

A recent United Nations report on drug use reveals drug trends around the world, including which countries have the highest rates of cannabis use.

The United States, Canada, Nigeria, and Australia rank the highest, with over 10% of the population over age 15 admitting to using the drug.

Western European countries also see fairly high rates of marijuana use, but did not rank in the highest category.

Although much of America's pot comes from Mexico, the southerly country has a surprisingly low rate of use, according to this data.

ORTEL: Note to Janet Yellen: The American bubble is popping

This week, guests will interact with Federal Reserve Chair Janet L. Yellen and colleagues inside a benign bubble that no outsider can prick — a scripted symposium, manufactured for the select few in Jackson Hole, Wyoming.

Perhaps privileged attendees will finally dare to confront sobering truth — reckless suppression of benchmark U.S. dollar interest rates, as the Fed has done since 2008, locked all Americans into a dangerous financial bubble that rivals and enemies are sure to pierce, perhaps quite soon.

Cursory review of financial statements reveals extraordinary measures by which the Federal Reserve System has intervened in capital and currency markets since 2006. Yet, from recent testimony, we already know that Ms. Yellen, like predecessor Ben Bernanke, refuses to recognize the omnipresent bubbles that resulted.

The single most important clue for discerning financial excess inside the U.S. is the interest rate the U.S. Treasury pays on its 10-year notes. Professional investors who control the bulk of the world's wealth price securities in reference to this rate — the lower it falls, the higher prices climb for most assets.

Vaccines and the Peanut Allergy Epidemic

Have you ever wondered why so many kids these days are allergic to peanuts? Where did this allergy come from all of a sudden?

Before 1900, reactions to peanuts were unheard of. Today almost a 1.5 million childrenin this country are allergic to peanuts.

What happened? Why is everybody buying EpiPens now?

Looking at all the problems with vaccines during the past decade, [2] just a superficial awareness is enough to raise the suspicion that vaccines might have some role in the appearance of any novel allergy among children.

But reactions to peanuts are not just another allergy. Peanut allergy has suddenly emerged as the #1 cause of death from food reactions, being in a category of allergens able to cause anaphylaxis. This condition brings the risk of asthma attack, shock, respiratory failure, and even death. Primarily among children.

Sources cited in Heather Fraser’s 2011 book The Peanut Allergy Epidemic suggest a vaccine connection much more specifically. We learn that a class of vaccine adjuvants –excipients – is a likely suspect in what may accurately be termed an epidemic. [1]

But let’s back up a little. We have to look at both vaccines and antibiotics in recent history, and the physical changes the ingredients in these brand new medicines introduced into the blood of children.

End of an Era Nears for GE in Fort Edward NY

As the Hudson River winds its way through Hudson Falls and Fort Edward, atop its banks rest fatigued and vacant buildings, with scant resemblance to the once bustling business within the now-decaying walls.

Nearly 3,000 employees filled those positions at paper, lumber and metal factories in a tiny triangle of industry in the 1940s. Those jobs are now gone, like many manufacturing jobs across the country.

In the mid-1970s, General Electric alone employed nearly 2,700 workers. Today, 167 employees remain on the job in the Fort Edward facility.

The doors at that plant will close for good in early 2015, having employed thousands in the community for the past 73 years.

“It was a very difficult decision,” said GE spokeswoman Chris Horne of relocating operations from the Fort Edward site to Clearwater, Florida.

“We’ve been losing money at Fort Edward for years,” she said. “This is in no way a reflection on the employees. They gave a diligent effort.”

The Typical Household, Now Worth a Third Less

Economic inequality in the United States has been receiving a lot of attention. But it’s not merely an issue of the rich getting richer. The typical American household has been getting poorer, too.

The inflation-adjusted net worth for the typical household was $87,992 in 2003. Ten years later, it was only $56,335, or a 36 percent decline, according to a study financed by the Russell Sage Foundation. Those are the figures for a household at the median point in the wealth distribution — the level at which there are an equal number of households whose worth is higher and lower. But during the same period, the net worth of wealthy households increased substantially.

The Russell Sage study also examined net worth at the 95th percentile. (For households at that level, 95 percent of the population had less wealth.) It found that for this well-do-do slice of the population, household net worthincreased 14 percent over the same 10 years. Other research, by economists like Edward Wolff at New York University, has shown even greater gains in wealth for the richest 1 percent of households.

White House Pursuing Plan to Expand Immigrant Rights

Even as President Obama grapples with the crisis of immigrant children arriving at the Southwest border, White House officials are laying the groundwork for a large-scale expansion of immigrant rights that would come by executive action within weeks.

Officials signaled strongly Friday that Obama's move would shield from deportation large numbers of immigrants living in the country illegally, as advocacy groups have demanded.

Roughly 5 million of the estimated 11 million people who entered the country without legal authorization or overstayed their visas could be protected under a leading option the White House is considering, according to officials who discussed the proposals on condition of anonymity.

Obama said last month that because Congress had failed to act on comprehensive immigration reform, he would take executive action to "fix as much of our immigration system as I can on my own."

No Inflation? Another Liberal Lie

Paul Krugman, liberal New York Times columnist and economist whose erroneous predictions and inflammatory opinions have inspired websites, blogs and columns by others detailing his multitude miscalculations, launched a Buk missile of a column at conservatives warning of inflationary government policies.

Yes, the man who predicted with no uncertainty that Greece would give up the Euro and U.S. unemployment under Obama would never exceed 9 percent (the U-3 unemployment rose over 10 percent and “real” unemployment was around 16 percent for most of his term so far) has decided that there is no inflation and anyone who reports on such increases in costs of living or correctly applies historical results of governmental policies producing inflation needs a twelve-step program.

If Krugman really cared about his readers he would be honest about Americans’ cost of living instead of aiding and abetting this government’s pretense that the CPI (Consumer Price Index) is an accurate gauge of your family’s cost of living. After all, isn’t that what “inflation” really means to you?

The Federal Government keeps reporting inflation as under 2 percent. Yet to you and I who did not major in economics, when the cost of food increases by 22 percent that definitely is real-world inflation. Anything else is semantics. If your income hasn’t increased respective to your food budget increase then that is definitely information worth knowing.

Is the government purposely publishing a falsely low inflation number?
